<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6d2c4c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b"><num value="673b">§ 673b.</num><heading> Adoption and legal guardianship incentive payments</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d2c4c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grant authority</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to the availability of such amounts as may be provided in advance in appropriations Acts for this purpose, the Secretary shall make a grant to each State that is an incentive-eligible State for a fiscal year in an amount equal to the adoption and legal guardianship incentive payment payable to the State under this section for the fiscal year, which shall be payable in the immediately succeeding fiscal year.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d2c4c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Incentive-eligible State</heading><chapeau style="-uslm-lc:I11" class="indent0">A State is an incentive-eligible State for a fiscal year if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6d2c4c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/b/1"><num value="1">(1)</num><content> the State has a plan approved under this part for the fiscal year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6d2c4c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/b/2"><num value="2">(2)</num><content> the State is in compliance with subsection (c) for the fiscal year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6d2c4c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/b/3"><num value="3">(3)</num><content> the State provides health insurance coverage to any child with special needs (as determined under <ref href="/us/usc/t42/s673/c">section 673(c) of this title</ref>) for whom there is in effect an adoption assistance agreement between a State and an adoptive parent or parents; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6d2c4c9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/b/4"><num value="4">(4)</num><content> the fiscal year is any of fiscal years 2016 through 2020.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d2c4ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Data requirements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2c4cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">A State is in compliance with this subsection for a fiscal year if the State has provided to the Secretary the data described in paragraph (2)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2c4cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c/1/A"><num value="A">(A)</num><content> for fiscal years 1995 through 1997 (or, if the first fiscal year for which the State seeks a grant under this section is after fiscal year 1998, the fiscal year that precedes such first fiscal year); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2c4cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c/1/B"><num value="B">(B)</num><content> for each succeeding fiscal year that precedes the fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2c4ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Determination of rates of adoptions and guardianships based on AFCARS data</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall determine each of the rates required to be determined under this section with respect to a State and a fiscal year, on the basis of data meeting the requirements of the system established pursuant to <ref href="/us/usc/t42/s679">section 679 of this title</ref>, as reported by the State and approved by the Secretary by August 1 of the succeeding fiscal year, and, with respect to the determination of the rates related to foster child guardianships, on the basis of information reported to the Secretary under paragraph (12) of subsection (g).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2c4cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> No waiver of AFCARS requirements</heading><content><p style="-uslm-lc:I12" class="indent1">This section shall not be construed to alter or affect any requirement of <ref href="/us/usc/t42/s679">section 679 of this title</ref> or of any regulation prescribed under such section with respect to reporting of data by States, or to waive any penalty for failure to comply with such a requirement.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d2c4d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Adoption and legal guardianship incentive payment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2c4d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in paragraphs (2) and (3), the adoption and legal guardianship incentive payment payable to a State for a fiscal year under this section shall be equal to the sum of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2c4d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/A"><num value="A">(A)</num><chapeau> $5,000, multiplied by the amount (if any) by which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d2c4d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/A/i"><num value="i">(i)</num><content> the number of foster child adoptions in the State during the fiscal year; exceeds</content>

<clause style="-uslm-lc:I14" class="indent3" id="ida6d2c4d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/A/ii"><num value="ii">(ii)</num><chapeau> the product (rounded to the nearest whole number) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d2c4d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/A/ii/I"><num value="I">(I)</num><content> the base rate of foster child adoptions for the State for the fiscal year; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2ebe7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/B"><num value="B">(B)</num><chapeau> $7,500, multiplied by the amount (if any) by which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebe8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/B/i"><num value="i">(i)</num><content> the number of pre-adolescent child adoptions and pre-adolescent foster child guardianships in the State during the fiscal year; exceeds</content>

<clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebe9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/B/ii"><num value="ii">(ii)</num><chapeau> the product (rounded to the nearest whole number) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d2ebea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/B/ii/I"><num value="I">(I)</num><content> the base rate of pre-adolescent child adoptions and pre-adolescent foster child guardianships for the State for the fiscal year; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2ebec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/C"><num value="C">(C)</num><chapeau> $10,000, multiplied by the amount (if any) by which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/C/i"><num value="i">(i)</num><content> the number of older child adoptions and older foster child guardianships in the State during the fiscal year; exceeds</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/C/ii"><num value="ii">(ii)</num><chapeau> the product (rounded to the nearest whole number) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d2ebef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/C/ii/I"><num value="I">(I)</num><content> the base rate of older child adoptions and older foster child guardianships for the State for the fiscal year; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6d2ebf0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/C/ii/II"><num value="II">(II)</num><content> the number of children in foster care under the supervision of the State on the last day of the preceding fiscal year who have attained 14 years of age; and</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2ebf1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/D"><num value="D">(D)</num><chapeau> $4,000, multiplied by the amount (if any) by which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebf2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/D/i"><num value="i">(i)</num><content> the number of foster child guardianships in the State during the fiscal year; exceeds</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d2ebf3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/D/ii"><num value="ii">(ii)</num><chapeau> the product (rounded to the nearest whole number) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d2ebf4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/D/ii/I"><num value="I">(I)</num><content> the base rate of foster child guardianships for the State for the fiscal year; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6d2ebf5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/1/D/ii/II"><num value="II">(II)</num><content> the number of children in foster care under the supervision of the State on the last day of the preceding fiscal year.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2ebf6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Pro rata adjustment if insufficient funds available</heading><chapeau style="-uslm-lc:I12" class="indent1">For any fiscal year, if the total amount of adoption incentive payments otherwise payable under paragraph (1) for a fiscal year exceeds the amount appropriated pursuant to subsection (h) for the fiscal year, the amount of the adoption incentive payment payable to each State under paragraph (1) for the fiscal year shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2ebf7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/2/A"><num value="A">(A)</num><content> the amount of the adoption and legal guardianship incentive payment that would otherwise be payable to the State under paragraph (1) for the fiscal year; multiplied by</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d2ebf8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/2/B"><num value="B">(B)</num><content> the percentage represented by the amount so appropriated for the fiscal year, divided by the total amount of adoption and legal guardianship incentive payments otherwise payable under paragraph (1) for the fiscal year.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d2ebf9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Increased adoption and legal guardianship incentive payment for timely adoptions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d2ebfa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">If for any of fiscal years 2013 through 2015, the total amount of adoption and legal guardianship incentive payments payable under paragraph (1) of this subsection are less than the amount appropriated under subsection (h) for the fiscal year, then, from the remainder of the amount appropriated for the fiscal year that is not required for such payments (in this paragraph referred to as the “timely adoption award pool”), the Secretary shall increase the adoption incentive payment determined under paragraph (1) for each State that the Secretary determines is a timely adoption award State for the fiscal year by the award amount determined for the fiscal year under subparagraph (C).</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d2ebfb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Timely adoption award State defined</heading><content><p style="-uslm-lc:I13" class="indent2">A State is a timely adoption award State for a fiscal year if the Secretary determines that, for children who were in foster care under the supervision of the State at the time of adoptive placement, the average number of months from removal of children from their home to the placement of children in finalized adoptions is less than 24 months.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d2ebfc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Award amount</heading><content><p style="-uslm-lc:I13" class="indent2">For purposes of subparagraph (A), the award amount determined under this subparagraph with respect to a fiscal year is the amount equal to the timely adoption award pool for the fiscal year divided by the number of timely adoption award States for the fiscal year.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d3120d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/e"><num value="e" class="bold">(e)</num><heading class="bold"> 36-month availability of incentive payments</heading><content><p style="-uslm-lc:I11" class="indent0">Payments to a State under this section in a fiscal year shall remain available for use by the State for the 36-month period beginning with the month in which the payments are made.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d3120e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/f"><num value="f" class="bold">(f)</num><heading class="bold"> Limitations on use of incentive payments</heading><content><p style="-uslm-lc:I11" class="indent0">A State shall not expend an amount paid to the State under this section except to provide to children or families any service (including post-adoption services) that may be provided under part B or E, and shall use the amount to supplement, and not supplant, any Federal or non-Federal funds used to provide any service under part B or E. Amounts expended by a State in accordance with the preceding sentence shall be disregarded in determining State expenditures for purposes of Federal matching payments under sections 624, 629d, and 674 of this title.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d3120f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g"><num value="g" class="bold">(g)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">As used in this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d31210-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Foster child adoption rate</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “foster child adoption rate” means, with respect to a State and a fiscal year, the percentage determined by dividing—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31211-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/1/A"><num value="A">(A)</num><content> the number of foster child adoptions finalized in the State during the fiscal year; by</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31212-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/1/B"><num value="B">(B)</num><content> the number of children in foster care under the supervision of the State on the last day of the preceding fiscal year.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d31213-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Base rate of foster child adoptions</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “base rate of foster child adoptions” means, with respect to a State and a fiscal year, the lesser of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31214-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/2/A"><num value="A">(A)</num><content> the foster child adoption rate for the State for the then immediately preceding fiscal year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31215-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/2/B"><num value="B">(B)</num><content> the foster child adoption rate for the State for the average of the then immediately preceding 3 fiscal years.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d31216-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Foster child adoption</heading><content><p style="-uslm-lc:I12" class="indent1">The term “foster child adoption” means the final adoption of a child who, at the time of adoptive placement, was in foster care under the supervision of the State.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d31217-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Pre-adolescent child adoption and pre-adolescent foster child guardianship rate</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “pre-adolescent child adoption and pre-adolescent foster child guardianship rate” means, with respect to a State and a fiscal year, the percentage determined by dividing—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31218-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/4/A"><num value="A">(A)</num><content> the number of pre-adolescent child adoptions and pre-adolescent foster child guardianships finalized in the State during the fiscal year; by</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d31219-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/4/B"><num value="B">(B)</num><content> the number of children in foster care under the supervision of the State on the last day of the preceding fiscal year, who have attained 9 years of age but not 14 years of age.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d3121a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/5"><num value="5" class="bold">(5)</num><heading class="bold"> Base rate of pre-adolescent child adoptions and pre-adolescent foster child guardianships</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “base rate of pre-adolescent child adoptions and pre-adolescent foster child guardianships” means, with respect to a State and a fiscal year, the lesser of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d3121b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/5/A"><num value="A">(A)</num><content> the pre-adolescent child adoption and pre-adolescent foster child guardianship rate for the State for the then immediately preceding fiscal year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d3121c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/5/B"><num value="B">(B)</num><content> the pre-adolescent child adoption and pre-adolescent foster child guardianship rate for the State for the average of the then immediately preceding 3 fiscal years.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d3121d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/6"><num value="6" class="bold">(6)</num><heading class="bold"> Pre-adolescent child adoption and pre-adolescent foster child guardianship</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “pre-adolescent child adoption and pre-adolescent foster child guardianship” means the final adoption, or the placement into foster child guardianship (as defined in paragraph (12)) of a child who has attained 9 years of age but not 14 years of age if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d3121e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/6/A"><num value="A">(A)</num><content> at the time of the adoptive or foster child guardianship placement, the child was in foster care under the supervision of the State; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d3121f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/6/B"><num value="B">(B)</num><content> an adoption assistance agreement was in effect under <ref href="/us/usc/t42/s673/a">section 673(a) of this title</ref> with respect to the child.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d3393f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12"><num value="12" class="bold">(12)</num><heading class="bold"> Foster child guardianship</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “foster child guardianship” means, with respect to a State, the exit of a child from foster care under the responsibility of the State to live with a legal guardian, if the State has reported to the Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d33940-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/A"><num value="A">(A)</num><chapeau> that the State agency has determined that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d33941-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/A/i"><num value="i">(i)</num><content> the child has been removed from his or her home pursuant to a voluntary placement agreement or as a result of a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d33942-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/A/ii"><num value="ii">(ii)</num><content> being returned home or adopted are not appropriate permanency options for the child;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d33943-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/A/iii"><num value="iii">(iii)</num><content> the child demonstrates a strong attachment to the prospective legal guardian, and the prospective legal guardian has a strong commitment to caring permanently for the child; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d33944-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/A/iv"><num value="iv">(iv)</num><content> if the child has attained 14 years of age, the child has been consulted regarding the legal guardianship arrangement; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d33945-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/g/12/B"><num value="B">(B)</num><content> the alternative procedures used by the State to determine that legal guardianship is the appropriate option for the child.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d33946-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/h"><num value="h" class="bold">(h)</num><heading class="bold"> Limitations on authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d33947-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">For grants under subsection (a), there are authorized to be appropriated to the Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d33948-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/h/1/A"><num value="A">(A)</num><content> $20,000,000 for fiscal year 1999;</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d3605d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i"><num value="i" class="bold">(i)</num><heading class="bold"> Technical assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d3605e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may, directly or through grants or contracts, provide technical assistance to assist States and local communities to reach their targets for increased numbers of adoptions and, to the extent that adoption is not possible, alternative permanent placements, for children in foster care.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d3605f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Description of the character of the technical assistance</heading><chapeau style="-uslm-lc:I12" class="indent1">The technical assistance provided under paragraph (1) may support the goal of encouraging more adoptions out of the foster care system, when adoptions promote the best interests of children, and may include the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36060-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/A"><num value="A">(A)</num><content> The development of best practice guidelines for expediting termination of parental rights.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36061-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/B"><num value="B">(B)</num><content> Models to encourage the use of concurrent planning.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36062-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/C"><num value="C">(C)</num><content> The development of specialized units and expertise in moving children toward adoption as a permanency goal.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36063-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/D"><num value="D">(D)</num><content> The development of risk assessment tools to facilitate early identification of the children who will be at risk of harm if returned home.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36064-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/E"><num value="E">(E)</num><content> Models to encourage the fast tracking of children who have not attained 1 year of age into pre-adoptive placements.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d36065-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/2/F"><num value="F">(F)</num><content> Development of programs that place children into pre-adoptive families without waiting for termination of parental rights.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d36066-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s673b/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Targeting of technical assistance to the courts</heading><content><p style="-uslm-lc:I12" class="indent1">Not less than 50 percent of any amount appropriated pursuant to paragraph (4) shall be used to provide technical assistance to the courts.</p>
