<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6d7f446-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676"><num value="676">§ 676.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d7f447-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/a"><num value="a" class="bold">(a)</num><heading class="bold"> Technical assistance to States</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may provide technical assistance to the States to assist them to develop the programs authorized under this part and shall periodically (1) evaluate the programs authorized under this part and part B of this subchapter and (2) collect and publish data pertaining to the incidence and characteristics of foster care and adoptions in this country.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d7f448-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/b"><num value="b" class="bold">(b)</num><heading class="bold"> Data collection and evaluation</heading><content><p style="-uslm-lc:I11" class="indent0">Each State shall submit statistical reports as the Secretary may require with respect to children for whom payments are made under this part containing information with respect to such children including legal status, demographic characteristics, location, and length of any stay in foster care.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d7f449-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c"><num value="c" class="bold">(c)</num><heading class="bold"> Technical assistance and implementation services for tribal programs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d7f44a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall provide technical assistance and implementation services that are dedicated to improving services and permanency outcomes for Indian children and their families through the provision of assistance described in paragraph (2).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d7f44b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Assistance provided</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d7f44c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The technical assistance and implementation services shall be to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6d7f44d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/i"><num value="i">(i)</num><content> provide information, advice, educational materials, and technical assistance to Indian tribes and tribal organizations with respect to the types of services, administrative functions, data collection, program management, and reporting that are required under State plans under part B and this part;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d7f44e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/ii"><num value="ii">(ii)</num><chapeau> assist and provide technical assistance to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d7f44f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/ii/I"><num value="I">(I)</num><content> Indian tribes, tribal organizations, and tribal consortia seeking to operate a program under part B or under this part through direct application to the Secretary under <ref href="/us/usc/t42/s679c">section 679c of this title</ref>; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6d7f450-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/ii/II"><num value="II">(II)</num><content> Indian tribes, tribal organizations, tribal consortia, and States seeking to develop cooperative agreements to provide for payments under this part or satisfy the requirements of section 622(b)(9), 671(a)(32), or 677(b)(3)(G) of this title; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6d7f451-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/iii"><num value="iii">(iii)</num><chapeau> subject to subparagraph (B), make one-time grants, to tribes, tribal organizations, or tribal consortia that are seeking to develop, and intend, not later than 24 months after receiving such a grant to submit to the Secretary a plan under <ref href="/us/usc/t42/s671">section 671 of this title</ref> to implement a program under this part as authorized by <ref href="/us/usc/t42/s679c">section 679c of this title</ref>, that shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida6d7f452-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/iii/I"><num value="I">(I)</num><content> not exceed $300,000; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida6d7f453-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/A/iii/II"><num value="II">(II)</num><content> be used for the cost of developing a plan under <ref href="/us/usc/t42/s671">section 671 of this title</ref> to carry out a program under <ref href="/us/usc/t42/s679c">section 679c of this title</ref>, including costs related to development of necessary data collection systems, a cost allocation plan, agency and tribal court procedures necessary to meet the case review system requirements under <ref href="/us/usc/t42/s675/5">section 675(5) of this title</ref>, or any other costs attributable to meeting any other requirement necessary for approval of such a plan under this part.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d7f454-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Grant condition</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6d7f455-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">As a condition of being paid a grant under subparagraph (A)(iii), a tribe, tribal organization, or tribal consortium shall agree to repay the total amount of the grant awarded if the tribe, tribal organization, or tribal consortium fails to submit to the Secretary a plan under <ref href="/us/usc/t42/s671">section 671 of this title</ref> to carry out a program under <ref href="/us/usc/t42/s679c">section 679c of this title</ref> by the end of the 24-month period described in that subparagraph.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida6d7f456-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall waive the requirement to repay a grant imposed by clause (i) if the Secretary determines that a tribe’s, tribal organization’s, or tribal consortium’s failure to submit a plan within such period was the result of circumstances beyond the control of the tribe, tribal organization, or tribal consortium.</p>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d7f457-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Implementation authority</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may provide the technical assistance and implementation services described in subparagraph (A) either directly or through a grant or contract with public or private organizations knowledgeable and experienced in the field of Indian tribal affairs and child welfare.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b68-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Appropriation</heading><content><p style="-uslm-lc:I12" class="indent1">There is appropriated to the Secretary, out of any money in the Treasury of the United States not otherwise appropriated, $3,000,000 for fiscal year 2009 and each fiscal year thereafter to carry out this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d81b69-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d"><num value="d" class="bold">(d)</num><heading class="bold"> Technical assistance and best practices, clearinghouse, data collection, and evaluations relating to prevention services and programs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b6a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Technical assistance and best practices</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall provide to States and, as applicable, to Indian tribes, tribal organizations, and tribal consortia, technical assistance regarding the provision of services and programs described in <ref href="/us/usc/t42/s671/e/1">section 671(e)(1) of this title</ref> and shall disseminate best practices with respect to the provision of the services and programs, including how to plan and implement a well-designed and rigorous evaluation of a promising, supported, or well-supported practice.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b6b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Clearinghouse of promising, supported, and well-supported practices</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall, directly or through grants, contracts, or interagency agreements, evaluate research on the practices specified in clauses (iii), (iv), and (v), respectively, of <ref href="/us/usc/t42/s671/e/4/C">section 671(e)(4)(C) of this title</ref>, and programs that meet the requirements described in <ref href="/us/usc/t42/s627/a/1">section 627(a)(1) of this title</ref>, including culturally specific, or location- or population-based adaptations of the practices, to identify and establish a public clearinghouse of the practices that satisfy each category described by such clauses. In addition, the clearinghouse shall include information on the specific outcomes associated with each practice, including whether the practice has been shown to prevent child abuse and neglect and reduce the likelihood of foster care placement by supporting birth families and kinship families and improving targeted supports for pregnant and parenting youth and their children.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b6c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Data collection and evaluations</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary, directly or through grants, contracts, or interagency agreements, may collect data and conduct evaluations with respect to the provision of services and programs described in <ref href="/us/usc/t42/s671/e/1">section 671(e)(1) of this title</ref> for purposes of assessing the extent to which the provision of the services and programs—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d81b6d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/3/A"><num value="A">(A)</num><content> reduces the likelihood of foster care placement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d81b6e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/3/B"><num value="B">(B)</num><content> increases use of kinship care arrangements; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6d81b6f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/3/C"><num value="C">(C)</num><content> improves child well-being.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b70-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Reports to Congress</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d81b71-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives periodic reports based on the provision of services and programs described in <ref href="/us/usc/t42/s671/e/1">section 671(e)(1) of this title</ref> and the activities carried out under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida6d81b72-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Public availability</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall make the reports to Congress submitted under this paragraph publicly available.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6d81b73-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Appropriation</heading><content><p style="-uslm-lc:I12" class="indent1">Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated to the Secretary $1,000,000 for fiscal year 2018 and each fiscal year thereafter to carry out this subsection.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6d81b74-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s676/e"><num value="e" class="bold">(e)</num><heading class="bold"> Evaluation of State procedures and protocols to prevent inappropriate diagnoses of mental illness or other conditions</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall conduct an evaluation of the procedures and protocols established by States in accordance with the requirements of <ref href="/us/usc/t42/s622/b/15/A/vii">section 622(b)(15)(A)(vii) of this title</ref>. The evaluation shall analyze the extent to which States comply with and enforce the procedures and protocols and the effectiveness of various State procedures and protocols and shall identify best practices. Not later than <date date="2020-01-01">January 1, 2020</date>, the Secretary shall submit a report on the results of the evaluation to Congress.</p>
