<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6da17cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679"><num value="679">§ 679.</num><heading> Collection of data relating to adoption and foster care</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6da17cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a"><num value="a" class="bold">(a)</num><heading class="bold"> Advisory Committee on Adoption and Foster Care Information</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida6da17ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/1"><num value="1">(1)</num><content> Not later than 90 days after <date date="1986-10-21">October 21, 1986</date>, the Secretary shall establish an Advisory Committee on Adoption and Foster Care Information (in this section referred to as the “Advisory Committee”) to study the various methods of establishing, administering, and financing a system for the collection of data with respect to adoption and foster care in the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida6da17cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2"><num value="2">(2)</num><chapeau> The study required by paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da17d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/A"><num value="A">(A)</num><chapeau> identify the types of data necessary to—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida6da17d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/A/i"><num value="i">(i)</num><content> assess (on a continuing basis) the incidence, characteristics, and status of adoption and foster care in the United States, and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida6da17d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/A/ii"><num value="ii">(ii)</num><content> develop appropriate national policies with respect to adoption and foster care;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da17d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/B"><num value="B">(B)</num><content> evaluate the feasibility and appropriateness of collecting data with respect to privately arranged adoptions and adoptions arranged through private agencies without assistance from public child welfare agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da17d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/C"><num value="C">(C)</num><content> assess the validity of various methods of collecting data with respect to adoption and foster care; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da17d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/2/D"><num value="D">(D)</num><content> evaluate the financial and administrative impact of implementing each such method.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida6da17d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/3"><num value="3">(3)</num><content> Not later than <date date="1987-10-01">October 1, 1987</date>, the Advisory Committee shall submit to the Secretary and the Congress a report setting forth the results of the study required by paragraph (1) and evaluating and making recommendations with respect to the various methods of establishing, administering, and financing a system for the collection of data with respect to adoption and foster care in the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida6da17d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="ida6da17d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/A"><num value="A">(A)</num><content> Subject to subparagraph (B), the membership and organization of the Advisory Committee shall be determined by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida6da17d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B"><num value="B">(B)</num><chapeau> The membership of the Advisory Committee shall include representatives of—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="ida6da17da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/i"><num value="i">(i)</num><content> private, nonprofit organizations with an interest in child welfare (including organizations that provide foster care and adoption services),</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da17db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/ii"><num value="ii">(ii)</num><content> organizations representing State and local governmental agencies with responsibility for foster care and adoption services,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3eec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/iii"><num value="iii">(iii)</num><content> organizations representing State and local governmental agencies with responsibility for the collection of health and social statistics,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3eed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/iv"><num value="iv">(iv)</num><content> organizations representing State and local judicial bodies with jurisdiction over family law,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3eee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/v"><num value="v">(v)</num><content> Federal agencies responsible for the collection of health and social statistics, and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3eef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/4/B/vi"><num value="vi">(vi)</num><content> organizations and agencies involved with privately arranged or international adoptions.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida6da3ef0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/a/5"><num value="5">(5)</num><content> After the date of the submission of the report required by paragraph (3), the Advisory Committee shall cease to exist.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6da3ef1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b"><num value="b" class="bold">(b)</num><heading class="bold"> Report to Congress; regulations</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida6da3ef2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="ida6da3ef3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/A"><num value="A">(A)</num><chapeau> Not later than <date date="1988-07-01">July 1, 1988</date>, the Secretary shall submit to the Congress a report that—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="ida6da3ef4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/A/i"><num value="i">(i)</num><content> proposes a method of establishing, administering, and financing a system for the collection of data relating to adoption and foster care in the United States,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3ef5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/A/ii"><num value="ii">(ii)</num><content> evaluates the feasibility and appropriateness of collecting data with respect to privately arranged adoptions and adoptions arranged through private agencies without assistance from public child welfare agencies, and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3ef6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/A/iii"><num value="iii">(iii)</num><content> evaluates the impact of the system proposed under clause (i) on the agencies with responsibility for implementing it.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="ida6da3ef7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/B"><num value="B">(B)</num><chapeau> The report required by subparagraph (A) shall—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="ida6da3ef8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/B/i"><num value="i">(i)</num><content> specify any changes in law that will be necessary to implement the system proposed under subparagraph (A)(i), and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="ida6da3ef9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/1/B/ii"><num value="ii">(ii)</num><content> describe the type of system that will be implemented under paragraph (2) in the absence of such changes.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida6da3efa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/2"><num value="2">(2)</num><chapeau> Not later than <date date="1988-12-31">December 31, 1988</date>, the Secretary shall promulgate final regulations providing for the implementation of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da3efb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/2/A"><num value="A">(A)</num><content> the system proposed under paragraph (1)(A)(i), or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida6da3efc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/b/2/B"><num value="B">(B)</num><content> if the changes in law specified pursuant to paragraph (1)(B)(i) have not been enacted, the system described in paragraph (1)(B)(ii).</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Such regulations shall provide for the full implementation of the system not later than <date date="1991-10-01">October 1, 1991</date>.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6da3efd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c"><num value="c" class="bold">(c)</num><heading class="bold"> Data collection system</heading><chapeau style="-uslm-lc:I11" class="indent0">Any data collection system developed and implemented under this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6da3efe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/1"><num value="1">(1)</num><content> avoid unnecessary diversion of resources from agencies responsible for adoption and foster care;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6da3eff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/2"><num value="2">(2)</num><content> assure that any data that is collected is reliable and consistent over time and among jurisdictions through the use of uniform definitions and methodologies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6da3f00-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3"><num value="3">(3)</num><chapeau> provide comprehensive national information with respect to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6da3f01-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/A"><num value="A">(A)</num><content> the demographic characteristics of adoptive and foster children and their biological and adoptive or foster parents,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6da3f02-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/B"><num value="B">(B)</num><content> the status of the foster care population (including the number of children in foster care, length of placement, type of placement, availability for adoption, and goals for ending or continuing foster care),</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6da3f03-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/C"><num value="C">(C)</num><chapeau> the number and characteristics of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6da3f04-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/C/i"><num value="i">(i)</num><content> children placed in or removed from foster care,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6da3f05-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/C/ii"><num value="ii">(ii)</num><content> children adopted or with respect to whom adoptions have been terminated, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6da3f06-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/C/iii"><num value="iii">(iii)</num><content> children placed in foster care outside the State which has placement and care responsibility,</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6da3f07-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/D"><num value="D">(D)</num><content> the extent and nature of assistance provided by Federal, State, and local adoption and foster care programs and the characteristics of the children with respect to whom such assistance is provided; <ref class="footnoteRef" idref="fn002605">1</ref><note type="footnote" id="fn002605"><num>1</num> So in original. The semicolon probably should be a comma.</note> and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6da3f08-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/E"><num value="E">(E)</num><chapeau> the annual number of children in foster care who are identified as sex trafficking victims—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6da3f09-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/E/i"><num value="i">(i)</num><content> who were such victims before entering foster care; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida6da3f0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/3/E/ii"><num value="ii">(ii)</num><content> who were such victims while in foster care; and</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6da3f0b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/c/4"><num value="4">(4)</num><content> utilize appropriate requirements and incentives to ensure that the system functions reliably throughout the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6da3f0c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s679/d"><num value="d" class="bold">(d)</num><heading class="bold"> Data collection on adoption and legal guardianship disruption and dissolution</heading><content><p style="-uslm-lc:I11" class="indent0">To promote improved knowledge on how best to ensure strong, permanent families for children, the Secretary shall promulgate regulations providing for the collection and analysis of information regarding children who enter into foster care under the supervision of a State after prior finalization of an adoption or legal guardianship. The regulations shall require each State with a State plan approved under this part to collect and report as part of such data collection system the number of children who enter foster care under supervision of the State after finalization of an adoption or legal guardianship and may include information concerning the length of the prior adoption or guardianship, the age of the child at the time of the prior adoption or guardianship, the age at which the child subsequently entered foster care under supervision of the State, the type of agency involved in making the prior adoptive or guardianship placement, and any other factors determined necessary to better understand factors associated with the child’s post-adoption or post-guardianship entry to foster care.</p>
