L. 94–580, § 2, Oct. 21, 1976, 90 Stat. 2802.)","seq_in_title":4978,"parent_identifier":"/us/usc/t42/ch82/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch82","level":"chapter","num":"CHAPTER 82—","heading":"SOLID WASTE DISPOSAL","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch82/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idabfd186d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906\"><num value=\"6906\">§ 6906.</num><heading> Financial disclosure</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabfd186e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Statement</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each officer or employee of the Administrator who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabfd186f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/a/1\"><num value=\"1\">(1)</num><content> performs any function or duty under this chapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabfd1870-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/a/2\"><num value=\"2\">(2)</num><content> has any known financial interest in any person who applies for or receives financial assistance under this chapter</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall, beginning on <date date=\"1977-02-01\">February 1, 1977</date>, annually file with the Administrator a written statement concerning all such interests held by such officer or employee during the preceding calendar year. Such statement shall be available to the public.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabfd1871-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Action by Administrator</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Administrator shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabfd1872-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/b/1\"><num value=\"1\">(1)</num><chapeau> act within ninety days after <date date=\"1976-10-21\">October 21, 1976</date>—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabfd1873-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/b/1/A\"><num value=\"A\">(A)</num><content> to define the term “known financial interest” for purposes of subsection (a) of this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idabfd1874-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/b/1/B\"><num value=\"B\">(B)</num><content> to establish the methods by which the requirement to file written statements specified in subsection (a) of this section will be monitored and enforced, including appropriate provision for the filing by such officers and employees of such statements and the review by the Administrator of such statements; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idabfd1875-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/b/2\"><num value=\"2\">(2)</num><content> report to the Congress on <date date=\"1978-06-01\">June 1, 1978</date>, and of each succeeding calendar year with respect to such disclosures and the actions taken in regard thereto during the preceding calendar year.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabfd1876-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Exemption</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the rules prescribed under subsection (b) of this section, the Administrator may identify specific positions within the Environmental Protection Agency which are of a nonpolicy-making nature and provide that officers or employees occupying such positions shall be exempt from the requirements of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idabfd1877-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6906/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Penalty</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any officer or employee who is subject to, and knowingly violates, this section shall be fined not more than $2,500 or imprisoned not more than one year, or both.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idabfd1878-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/272/tII/s1007\">Pub.
