<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac06191c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b"><num value="6939b">§ 6939b.</num><heading> Interim control of hazardous waste injection</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac06191d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Underground source of drinking water</heading><chapeau style="-uslm-lc:I11" class="indent0">No hazardous waste may be disposed of by underground injection—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac06191e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/a/1"><num value="1">(1)</num><content> into a formation which contains (within one-quarter mile of the well used for such underground injection) an underground source of drinking water; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac06191f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/a/2"><num value="2">(2)</num><content> above such a formation.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The prohibitions established under this section shall take effect 6 months after <date date="1984-11-08">November 8, 1984</date>, except in the case of any State in which identical or more stringent prohibitions are in effect before such date under the Safe Drinking Water Act [<ref href="/us/usc/t42/s300f">42 U.S.C. 300f</ref> et seq.].</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac064030-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Actions under Comprehensive Environmental Response, Compensation, and Liability Act</heading><chapeau style="-uslm-lc:I11" class="indent0">Subsection (a) shall not apply to the injection of contaminated ground water into the aquifer from which it was withdrawn, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac064031-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b/1"><num value="1">(1)</num><chapeau> such injection is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac064032-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b/1/A"><num value="A">(A)</num><content> a response action taken under section 9604 or 9606 of this title, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac064033-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b/1/B"><num value="B">(B)</num><content> part of corrective action required under this chapter <ref class="footnoteRef" idref="fn003457">1</ref><note type="footnote" id="fn003457"><num>1</num> So in original. </subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">intended to clean up such contamination;</continuation>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac064034-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b/2"><num value="2">(2)</num><content> such contaminated ground water is treated to substantially reduce hazardous constituents prior to such injection; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac064035-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/b/3"><num value="3">(3)</num><content> such response action or corrective action will, upon completion, be sufficient to protect human health and the environment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac064036-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Enforcement</heading><chapeau style="-uslm-lc:I11" class="indent0">In addition to enforcement under the provisions of this chapter, the prohibitions established under paragraphs (1) and (2) of subsection (a) shall be enforceable under the Safe Drinking Water Act [<ref href="/us/usc/t42/s300f">42 U.S.C. 300f</ref> et seq.] in any State—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac064037-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/c/1"><num value="1">(1)</num><content> which has adopted identical or more stringent prohibitions under part C of the Safe Drinking Water Act [<ref href="/us/usc/t42/s300h">42 U.S.C. 300h</ref> et seq.] and which has assumed primary enforcement responsibility under that Act for enforcement of such prohibitions; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac064038-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/c/2"><num value="2">(2)</num><content> in which the Administrator has adopted identical or more stringent prohibitions under the Safe Drinking Water Act [<ref href="/us/usc/t42/s300f">42 U.S.C. 300f</ref> et seq.] and is exercising primary enforcement responsibility under that Act for enforcement of such prohibitions.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac064039-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definitions</heading><content><p style="-uslm-lc:I11" class="indent0">The terms “primary enforcement responsibility”, “underground source of drinking water”, “formation” and “well” have the same meanings as provided in regulations of the Administrator under the Safe Drinking Water Act [<ref href="/us/usc/t42/s300f">42 U.S.C. 300f</ref> et seq.]. The term “Safe Drinking Water Act” means title XIV of the Public Health Service Act.</p>
