<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac06dbb8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d"><num value="6939d">§ 6939d.</num><heading> Public vessels</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac06dbb9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Waste generated on public vessels</heading><chapeau style="-uslm-lc:I11" class="indent0">Any hazardous waste generated on a public vessel shall not be subject to the storage, manifest, inspection, or recordkeeping requirements of this chapter until such waste is transferred to a shore facility, unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/a/1"><num value="1">(1)</num><content> the waste is stored on the public vessel for more than 90 days after the public vessel is placed in reserve or is otherwise no longer in service; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbbb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/a/2"><num value="2">(2)</num><content> the waste is transferred to another public vessel within the territorial waters of the United States and is stored on such vessel or another public vessel for more than 90 days after the date of transfer.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac06dbbc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Computation of storage period</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of subsection (a), the 90-day period begins on the earlier of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbbd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/b/1"><num value="1">(1)</num><content> the date on which the public vessel on which the waste was generated is placed in reserve or is otherwise no longer in service; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbbe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/b/2"><num value="2">(2)</num><content> the date on which the waste is transferred from the public vessel on which the waste was generated to another public vessel within the territorial waters of the United States;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">and continues, without interruption, as long as the waste is stored on the original public vessel (if in reserve or not in service) or another public vessel.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac06dbbf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbc0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/c/1"><num value="1">(1)</num><content> The term “public vessel” means a vessel owned or bareboat chartered and operated by the United States, or by a foreign nation, except when the vessel is engaged in commerce.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac06dbc1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6939d/c/2"><num value="2">(2)</num><content> The terms “in reserve” and “in service” have the meanings applicable to those terms under section 8663 and sections 8674 through 8678 of title 10 and regulations prescribed under those sections.</content>
