<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac09e95e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947"><num value="6947">§ 6947.</num><heading> Approval of State plan; Federal assistance</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac09e95f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a"><num value="a" class="bold">(a)</num><heading class="bold"> Plan approval</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall, within six months after a State plan has been submitted for approval, approve or disapprove the plan. The Administrator shall approve a plan if he determines that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac09e960-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a/1"><num value="1">(1)</num><content> it meets the requirements of paragraphs (1), (2), (3), and (5) of <ref href="/us/usc/t42/s6943/a">section 6943(a) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac09e961-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a/2"><num value="2">(2)</num><chapeau> it contains provision for revision of such plan, after notice and public hearing, whenever the Administrator, by regulation, determines—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac09e962-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a/2/A"><num value="A">(A)</num><content> that revised regulations respecting minimum requirements have been promulgated under paragraphs (1), (2), (3), and (5) of <ref href="/us/usc/t42/s6943/a">section 6943(a) of this title</ref> with which the State plan is not in compliance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac09e963-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a/2/B"><num value="B">(B)</num><content> that information has become available which demonstrates the inadequacy of the plan to effectuate the purposes of this subchapter; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac09e964-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/a/2/C"><num value="C">(C)</num><content> that such revision is otherwise necessary.</content>
</subparagraph>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The Administrator shall review approved plans from time to time and if he determines that revision or corrections are necessary to bring such plan into compliance with the minimum requirements promulgated under <ref href="/us/usc/t42/s6943">section 6943 of this title</ref> (including new or revised requirements), he shall, after notice and opportunity for public hearing, withdraw his approval of such plan. Such withdrawal of approval shall cease to be effective upon the Administrator’s determination that such complies with such minimum requirements.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac09e965-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligibility of States for Federal financial assistance</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac09e966-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/b/1"><num value="1">(1)</num><content> The Administrator shall approve a State application for financial assistance under this subchapter, and make grants to such State, if such State and local and regional authorities within such State have complied with the requirements of <ref href="/us/usc/t42/s6946">section 6946 of this title</ref> within the period required under such section and if such State has a State plan which has been approved by the Administrator under this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac0a1077-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/b/2"><num value="2">(2)</num><content> The Administrator shall approve a State application for financial assistance under this subchapter, and make grants to such State, for fiscal years 1978 and 1979 if the Administrator determines that the State plan continues to be eligible for approval under subsection (a) and is being implemented by the State.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac0a1078-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/b/3"><num value="3">(3)</num><content> Upon withdrawal of approval of a State plan under subsection (a), the Administrator shall withhold Federal financial and technical assistance under this subchapter (other than such technical assistance as may be necessary to assist in obtaining the reinstatement of approval) until such time as such approval is reinstated.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0a1079-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6947/c"><num value="c" class="bold">(c)</num><heading class="bold"> Existing activities</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this subchapter shall be construed to prevent or affect any activities respecting solid waste planning or management which are carried out by State, regional, or local authorities unless such activities are inconsistent with a State plan approved by the Administrator under this subchapter.</p>
