<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac0ad3f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949"><num value="6949">§ 6949.</num><heading> Rural communities assistance</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0ad3f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall make grants to States to provide assistance to municipalities with a population of five thousand or less, or counties with a population of ten thousand or less or less than twenty persons per square mile and not within a metropolitan area, for solid waste management facilities (including equipment) necessary to meet the requirements of <ref href="/us/usc/t42/s6945">section 6945 of this title</ref> or restrictions on open burning or other requirements arising under the Clean Air Act [<ref href="/us/usc/t42/s7401">42 U.S.C. 7401</ref> et seq.] or the Federal Water Pollution Control Act [<ref href="/us/usc/t33/s1251">33 U.S.C. 1251</ref> et seq.]. Such assistance shall only be available—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac0ad3f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/a/1"><num value="1">(1)</num><content> to any municipality or county which could not feasibly be included in a solid waste management system or facility serving an urbanized, multijurisdictional area because of its distance from such systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac0ad3fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/a/2"><num value="2">(2)</num><content> where existing or planned solid waste management services or facilities are unavailable or insufficient to comply with the requirements of <ref href="/us/usc/t42/s6945">section 6945 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac0ad3fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/a/3"><num value="3">(3)</num><content> for systems which are certified by the State to be consistent with any plans or programs established under any State or areawide planning process.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0ad3fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/b"><num value="b" class="bold">(b)</num><heading class="bold"> Allotment</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall allot the sums appropriated to carry out this section in any fiscal year among the States in accordance with regulations promulgated by him on the basis of the average of the ratio which the population of rural areas of each State bears to the total population of rural areas of all the States, the ratio which the population of counties in each State having less than twenty persons per square mile bears to the total population of such counties in all the States, and the ratio which the population of such low-density counties in each State having 33 per centum or more of all families with incomes not in excess of 125 per centum of the poverty level bears to the total population of such counties in all the States.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0ad3fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limit</heading><content><p style="-uslm-lc:I11" class="indent0">The amount of any grant under this section shall not exceed 75 per centum of the costs of the project. No assistance under this section shall be available for the acquisition of land or interests in land.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0ad3fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated $25,000,000 for each of the fiscal years 1978 and 1979 to carry out this section. There are authorized to be appropriated $10,000,000 for the fiscal year 1980 and $15,000,000 for each of the fiscal years 1981 and 1982 to carry out this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac0afb0f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/e"><num value="e" class="bold">(e)</num><heading class="bold"> Additional appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac0afb10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated to carry out this section for the Denali Commission to provide assistance to municipalities in the State of Alaska $1,500,000 for each of fiscal years 2008 through 2012.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac0afb11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I12" class="indent1">For the purpose of carrying out this subsection, the Denali Commission shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac0afb12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/e/2/A"><num value="A">(A)</num><content> be considered a State; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac0afb13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6949/e/2/B"><num value="B">(B)</num><content> comply with all other requirements and limitations of this section.</content>
