and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf73-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/1/B\"><num value=\"B\">(B)</num><content> the head of any other Federal agency that, on a regular basis, procures, or provides Federal funds to pay or assist in paying the cost of procuring, material for cement or concrete projects.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf74-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Cement or concrete project</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “cement or concrete project” means a project for the construction or maintenance of a highway or other transportation facility or a Federal, State, or local government building or other public facility that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf75-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/2/A\"><num value=\"A\">(A)</num><content> involves the procurement of cement or concrete; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf76-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/2/B\"><num value=\"B\">(B)</num><content> is carried out, in whole or in part, using Federal funds.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf77-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Recovered mineral component</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “recovered mineral component” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf78-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/3/A\"><num value=\"A\">(A)</num><content> ground granulated blast furnace slag, excluding lead slag;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf79-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/3/B\"><num value=\"B\">(B)</num><content> coal combustion fly ash; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf7a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/a/3/C\"><num value=\"C\">(C)</num><content> any other waste material or byproduct recovered or diverted from solid waste that the Administrator, in consultation with an agency head, determines should be treated as recovered mineral component under this section for use in cement or concrete projects paid for, in whole or in part, by the agency head.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac0ccf7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Implementation of requirements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf7c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 1 year after <date date=\"2005-08-08\">August 8, 2005</date>, the Administrator and each agency head shall take such actions as are necessary to implement fully all procurement requirements and incentives in effect as of <date date=\"2005-08-08\">August 8, 2005</date> (including guidelines under <ref href=\"/us/usc/t42/s6962\">section 6962 of this title</ref>) that provide for the use of cement and concrete incorporating recovered mineral component in cement or concrete projects.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf7d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out paragraph (1), an agency head shall give priority to achieving greater use of recovered mineral component in cement or concrete projects for which recovered mineral components historically have not been used or have been used only minimally.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf7e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Federal procurement requirements</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Administrator and each agency head shall carry out this subsection in accordance with <ref href=\"/us/usc/t42/s6962\">section 6962 of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac0ccf7f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Full implementation study</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf80-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Administrator, in cooperation with the Secretary of Transportation and the Secretary of Energy, shall conduct a study to determine the extent to which procurement requirements, when fully implemented in accordance with subsection (b), may realize energy savings and environmental benefits attainable with substitution of recovered mineral component in cement used in cement or concrete projects.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0ccf81-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Matters to be addressed</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The study shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0ccf82-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/A\"><num value=\"A\">(A)</num><chapeau> quantify—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idac0ccf83-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/A/i\"><num value=\"i\">(i)</num><content> the extent to which recovered mineral components are being substituted for Portland cement, particularly as a result of procurement requirements; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idac0cf694-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/A/ii\"><num value=\"ii\">(ii)</num><content> the energy savings and environmental benefits associated with the substitution;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0cf695-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/B\"><num value=\"B\">(B)</num><content> identify all barriers in procurement requirements to greater realization of energy savings and environmental benefits, including barriers resulting from exceptions from the law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0cf696-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/C\"><num value=\"C\">(C)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0cf697-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/C/i\"><num value=\"i\">(i)</num><content> identify potential mechanisms to achieve greater substitution of recovered mineral component in types of cement or concrete projects for which recovered mineral components historically have not been used or have been used only minimally;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0cf698-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/C/ii\"><num value=\"ii\">(ii)</num><content> evaluate the feasibility of establishing guidelines or standards for optimized substitution rates of recovered mineral component in those cement or concrete projects; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac0cf699-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/2/C/iii\"><num value=\"iii\">(iii)</num><content> identify any potential environmental or economic effects that may result from greater substitution of recovered mineral component in those cement or concrete projects.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac0cf69a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 30 months after <date date=\"2005-08-08\">August 8, 2005</date>, the Administrator shall submit to Congress a report on the study.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac0cf69b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Additional procurement requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Unless the study conducted under subsection (c) identifies any effects or other problems described in subsection (c)(2)(C)(iii) that warrant further review or delay, the Administrator and each agency head shall, not later than 1 year after the date on which the report under subsection (c)(3) is submitted, take additional actions under this chapter to establish procurement requirements and incentives that provide for the use of cement and concrete with increased substitution of recovered mineral component in the construction and maintenance of cement or concrete projects—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac0cf69c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/d/1\"><num value=\"1\">(1)</num><content> to realize more fully the energy savings and environmental benefits associated with increased substitution; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac0cf69d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/d/2\"><num value=\"2\">(2)</num><content> to eliminate barriers identified under subsection (c)(2)(B).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac0cf69e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6966/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Effect of section</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section affects the requirements of <ref href=\"/us/usc/t42/s6962\">section 6962 of this title</ref> (including the guidelines and specifications for implementing those requirements).</p>\n</content>\n</subsection>\n<sourceCredit id=\"idac0cf69f-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/272/tII/s6005\">Pub.
