The semicolon probably should be a period and the word “and” probably should not appear.</note></content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac10edd7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/2\"><num value=\"2\">(2)</num><content> The term “nonoperational storage tank” means any underground storage tank in which regulated substances will not be deposited or from which regulated substances will not be dispensed after <date date=\"1984-11-08\">November 8, 1984</date>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac10edd8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/3\"><num value=\"3\">(3)</num><content> The term “operator” means any person in control of, or having responsibility for, the daily operation of the underground storage tank.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/4\"><num value=\"4\">(4)</num><chapeau> The term “owner” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/4/A\"><num value=\"A\">(A)</num><content> in the case of an underground storage tank in use on <date date=\"1984-11-08\">November 8, 1984</date>, or brought into use after that date, any person who owns an underground storage tank used for the storage, use, or dispensing of regulated substances and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/4/B\"><num value=\"B\">(B)</num><content> in the case of any underground storage tank in use before <date date=\"1984-11-08\">November 8, 1984</date>, but no longer in use on <date date=\"1984-11-08\">November 8, 1984</date>, any person who owned such tank immediately before the discontinuation of its use.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/5\"><num value=\"5\">(5)</num><content> The term “person” has the same meaning as provided in <ref href=\"/us/usc/t42/s6903/15\">section 6903(15) of this title</ref>, except that such term includes a consortium, a joint venture, and a commercial entity, and the United States Government.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/6\"><num value=\"6\">(6)</num><content> The term “petroleum” means petroleum, including crude oil or any fraction thereof which is liquid at standard conditions of temperature and pressure (60 degrees Fahrenheit and 14.7 pounds per square inch absolute).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/7\"><num value=\"7\">(7)</num><chapeau> The term “regulated substance” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/7/A\"><num value=\"A\">(A)</num><content> any substance defined in <ref href=\"/us/usc/t42/s9601/14\">section 9601(14) of this title</ref> (but not including any substance regulated as a hazardous waste under subchapter III), and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/7/B\"><num value=\"B\">(B)</num><content> petroleum.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/8\"><num value=\"8\">(8)</num><content> The term “release” means any spilling, leaking, emitting, discharging, escaping, leaching, or disposing from an underground storage tank into ground water, surface water or subsurface soils.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/9\"><num value=\"9\">(9)</num><heading> <inline class=\"small-caps\">Trust fund</inline>.—</heading><content>The term “Trust Fund” means the Leaking Underground Storage Tank Trust Fund established by <ref href=\"/us/usc/t26/s9508\">section 9508 of title 26</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac1114f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10\"><num value=\"10\">(10)</num><chapeau> The term “underground storage tank” means any one or combination of tanks (including underground pipes connected thereto) which is used to contain an accumulation of regulated substances, and the volume of which (including the volume of the underground pipes connected thereto) is 10 per centum or more beneath the surface of the ground. Such term does not include any—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/A\"><num value=\"A\">(A)</num><content> farm or residential tank of 1,100 gallons or less capacity used for storing motor fuel for noncommercial purposes,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/B\"><num value=\"B\">(B)</num><content> tank used for storing heating oil for consumptive use on the premises where stored,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/C\"><num value=\"C\">(C)</num><content> septic tank,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/D\"><num value=\"D\">(D)</num><chapeau> pipeline facility (including gathering lines)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idac1114f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/D/i\"><num value=\"i\">(i)</num><content> which is regulated under chapter 601 of title 49, or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idac1114f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/D/ii\"><num value=\"ii\">(ii)</num><content> which is an intrastate pipeline facility regulated under State laws as provided in chapter 601 of title 49,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">and which is determined by the Secretary to be connected to a pipeline or to be operated or intended to be capable of operating at pipeline pressure or as an integral part of a pipeline,</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/E\"><num value=\"E\">(E)</num><content> surface impoundment, pit, pond, or lagoon,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/F\"><num value=\"F\">(F)</num><content> storm water or waste water collection system,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/G\"><num value=\"G\">(G)</num><content> flow-through process tank,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/H\"><num value=\"H\">(H)</num><content> liquid trap or associated gathering lines directly related to oil or gas production and gathering operations, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac1114fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s6991/10/I\"><num value=\"I\">(I)</num><content> storage tank situated in an underground area (such as a basement, cellar, mineworking, drift, shaft, or tunnel) if the storage tank is situated upon or above the surface of the floor.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">The term “underground storage tank” shall not include any pipes connected to any tank which is described in subparagraphs (A) through (I).</continuation>\n</paragraph>\n<sourceCredit id=\"idac1114ff-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/89/272/tII/s9001\">Pub. L. 105–277, div. C, title III</ref>] (<ref href=\"/us/usc/t42/s3121\">42 U.S.C. 3121</ref> note).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Federal environmental law</inline>.—</heading><chapeau>The term ‘Federal environmental law’ means—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the Oil Pollution Control Act of 1990 (<ref href=\"/us/usc/t33/s2701\">33 U.S.C. 2701</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href=\"/us/usc/t42/s9601\">42 U.S.C. 9601</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> the Solid Waste Disposal Act (<ref href=\"/us/usc/t42/s6901\">42 U.S.C. 6901</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> the Federal Water Pollution Control Act (<ref href=\"/us/usc/t33/s1251\">33 U.S.C. 1251</ref> et seq.); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> any other Federal law that is applicable to the release into the environment of a regulated substance, as determined by the Administrator.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Native village</inline>.—</heading><content>The term ‘Native village’ has the meaning given the term in section 11(b) in <ref href=\"/us/pl/92/203\">Public Law 92–203</ref> (<ref href=\"/us/stat/85/688\">85 Stat. 688</ref>) [<ref href=\"/us/usc/t43/s1610/b\">43 U.S.C. 1610(b)</ref>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Program</inline>.—</heading><content>The term ‘program’ means the Aboveground Storage Tank Grant Program established by subsection (b)(1).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Regulated substance</inline>.—</heading><content>The term ‘regulated substance’ has the meaning given the term in section 9001 of the Solid Waste Disposal Act (<ref href=\"/us/usc/t42/s6991\">42 U.S.C. 6991</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><heading> <inline class=\"small-caps\">State</inline>.—</heading><content>The term ‘State’ means the State of Alaska.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Establishment.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>There is established a grant program to be known as the ‘Aboveground Storage Tank Grant Program’</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Grants</inline>.—</heading><chapeau>Under the program, the Administrator shall award a grant to—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the State, on behalf of a Native village; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the Denali Commission.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Use of Grants</inline>.—</heading><chapeau>The State or the Denali Commission shall use the funds of a grant under subsection (b) to repair, upgrade, or replace one or more aboveground storage tanks that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> leaks or poses an imminent threat of leaking, as certified by the Administrator, the Commandant of the Coast Guard, or any other appropriate Federal or State agency (as determined by the Administrator); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> is located in a Native village—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the median household income of which is less than 80 percent of the median household income in the State;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> that is located—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><chapeau> within the boundaries of—</chapeau><subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"I\">     “(I)</num><content> a unit of the National Park System;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"II\">     “(II)</num><content> a unit of the National Wildlife Refuge System; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"III\">     “(III)</num><content> a National Forest; or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> on public land under the administrative jurisdiction of the Bureau of Land Management; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> that receives payments from the Federal Government under chapter 69 of title 31, United States Code (commonly known as ‘payments in lieu of taxes’).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Reports</inline>.—</heading><chapeau>Not later than 1 year after the date on which the State or the Denali Commission receives a grant under subsection (c), and annually thereafter, the State or the Denali Commission, as the case may be, shall submit a report describing each project completed with grant funds and any projects planned for the following year, to—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the Administrator;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the Committee on Resources [now Committee on Natural Resources] of the House of Representatives;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the Committee on Environment and Public Works of the Senate;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> the Committee on Appropriations of the House of Representatives; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> the Committee on Appropriations of the Senate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Authorization of Appropriations</inline>.—</heading><chapeau>There are authorized to be appropriated to carry out this Act [probably means this section], to remain available until expended—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> $20,000,000 for fiscal year 2001;
