<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac14496e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i"><num value="6991i">§ 6991i.</num><heading> Operator training</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac14707f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a"><num value="a" class="bold">(a)</num><heading class="bold"> Guidelines</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac147080-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 2 years after <date date="2005-08-08">August 8, 2005</date>, in consultation and cooperation with States and after public notice and opportunity for comment, the Administrator shall publish guidelines that specify training requirements for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac147081-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/1/A"><num value="A">(A)</num><content> persons having primary responsibility for on-site operation and maintenance of underground storage tank systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147082-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/1/B"><num value="B">(B)</num><content> persons having daily on-site responsibility for the operation and maintenance of underground storage tanks systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147083-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/1/C"><num value="C">(C)</num><content> daily, on-site employees having primary responsibility for addressing emergencies presented by a spill or release from an underground storage tank system.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac147084-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Considerations</heading><chapeau style="-uslm-lc:I12" class="indent1">The guidelines described in paragraph (1) shall take into account—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac147085-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/A"><num value="A">(A)</num><content> State training programs in existence as of the date of publication of the guidelines;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147086-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/B"><num value="B">(B)</num><content> training programs that are being employed by tank owners and tank operators as of <date date="2005-08-08">August 8, 2005</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147087-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/C"><num value="C">(C)</num><content> the high turnover rate of tank operators and other personnel;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147088-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/D"><num value="D">(D)</num><content> the frequency of improvement in underground storage tank equipment technology;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147089-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/E"><num value="E">(E)</num><content> the nature of the businesses in which the tank operators are engaged;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac14708a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/F"><num value="F">(F)</num><content> the substantial differences in the scope and length of training needed for the different classes of persons described in subparagraphs (A), (B), and (C) of paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac14708b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/a/2/G"><num value="G">(G)</num><content> such other factors as the Administrator determines to be necessary to carry out this section.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac14708c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b"><num value="b" class="bold">(b)</num><heading class="bold"> State programs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac14708d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 2 years after the date on which the Administrator publishes the guidelines under subsection (a)(1), each State that receives funding under this subchapter shall develop State-specific training requirements that are consistent with the guidelines developed under subsection (a)(1).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac14708e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">State requirements described in paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac14708f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/2/A"><num value="A">(A)</num><content> be consistent with subsection (a);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147090-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/2/B"><num value="B">(B)</num><content> be developed in cooperation with tank owners and tank operators;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147091-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/2/C"><num value="C">(C)</num><content> take into consideration training programs implemented by tank owners and tank operators as of <date date="2005-08-08">August 8, 2005</date>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147092-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/2/D"><num value="D">(D)</num><content> be appropriately communicated to tank owners and operators.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac147093-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Financial incentive</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator may award to a State that develops and implements requirements described in paragraph (1), in addition to any funds that the State is entitled to receive under this subchapter, not more than $200,000, to be used to carry out the requirements.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac147094-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/c"><num value="c" class="bold">(c)</num><heading class="bold"> Training</heading><chapeau style="-uslm-lc:I11" class="indent0">All persons that are subject to the operator training requirements of subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac147095-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/c/1"><num value="1">(1)</num><content> meet the training requirements developed under subsection (b); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac147096-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/c/2"><num value="2">(2)</num><chapeau> repeat the applicable requirements developed under subsection (b), if the tank for which they have primary daily on-site management responsibilities is determined to be out of compliance with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac147097-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/c/2/A"><num value="A">(A)</num><content> a requirement or standard promulgated by the Administrator under <ref href="/us/usc/t42/s6991b">section 6991b of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac147098-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6991i/c/2/B"><num value="B">(B)</num><content> a requirement or standard of a State program approved under <ref href="/us/usc/t42/s6991c">section 6991c of this title</ref>.</content>
