<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac150d24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b"><num value="6992b">§ 6992b.</num><heading> Tracking of medical waste</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac150d25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Demonstration program</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 6 months after <date date="1988-11-01">November 1, 1988</date>, the Administrator shall promulgate regulations establishing a program for the tracking of the medical waste listed in <ref href="/us/usc/t42/s6992a">section 6992a of this title</ref> which is generated in a State subject to the demonstration program. The program shall (1) provide for tracking of the transportation of the waste from the generator to the disposal facility, except that waste that is incinerated need not be tracked after incineration, (2) include a system for providing the generator of the waste with assurance that the waste is received by the disposal facility, (3) use a uniform form for tracking in each of the demonstration States, and (4) include the following requirements:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac150d26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/a/A"><num value="A">(A)</num><content> A requirement for segregation of the waste at the point of generation where practicable.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac150d27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/a/B"><num value="B">(B)</num><content> A requirement for placement of the waste in containers that will protect waste handlers and the public from exposure.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac150d28-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/a/C"><num value="C">(C)</num><content> A requirement for appropriate labeling of containers of the waste.</content>
</subparagraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac150d29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Small quantities</heading><content><p style="-uslm-lc:I11" class="indent0">In the program under subsection (a), the Administrator may establish an exemption for generators of small quantities of medical waste listed under <ref href="/us/usc/t42/s6992a">section 6992a of this title</ref>, except that the Administrator may not exempt from the program any person who, or facility that, generates 50 pounds or more of such waste in any calendar month.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac150d2a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/c"><num value="c" class="bold">(c)</num><heading class="bold"> On-site incinerators</heading><content><p style="-uslm-lc:I11" class="indent0">Concurrently with the promulgation of regulations under subsection (a), the Administrator shall promulgate a recordkeeping and reporting requirement for any generator in a demonstration State of medical waste listed in <ref href="/us/usc/t42/s6992a">section 6992a of this title</ref> that (1) incinerates medical waste listed in <ref href="/us/usc/t42/s6992a">section 6992a of this title</ref> on site and (2) does not track such waste under the regulations promulgated under subsection (a). Such requirement shall require the generator to report to the Administrator on the volume and types of medical waste listed in <ref href="/us/usc/t42/s6992a">section 6992a of this title</ref> that the generator incinerated on site during the 6 months following the effective date of the requirements of this subsection.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac150d2b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s6992b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Type of medical waste and types of generators</heading><content><p style="-uslm-lc:I11" class="indent0">For each of the requirements of this section, the regulations may vary for different types of medical waste and for different types of medical waste generators.</p>
