L. 101–239, title VI, § 6503(a), (c)(2), (4), Dec. 19, 1989, 103 Stat. 2276, 2278.)","seq_in_title":1638,"parent_identifier":"/us/usc/t42/ch7/schV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"MATERNAL AND CHILD HEALTH SERVICES BLOCK GRANT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida6dd724b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704\"><num value=\"704\">§ 704.</num><heading> Use of allotment funds</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6dd724c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Covered services</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except as otherwise provided under this section, a State may use amounts paid to it under <ref href=\"/us/usc/t42/s703\">section 703 of this title</ref> for the provision of health services and related activities (including planning, administration, education, and evaluation and including payment of salaries and other related expenses of National Health Service Corps personnel) consistent with its application transmitted under <ref href=\"/us/usc/t42/s705/a\">section 705(a) of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6dd724d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Restrictions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Amounts described in subsection (a) may not be used for—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd724e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/1\"><num value=\"1\">(1)</num><content> inpatient services, other than inpatient services provided to children with special health care needs or to high-risk pregnant women and infants and such other inpatient services as the Secretary may approve;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd724f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/2\"><num value=\"2\">(2)</num><content> cash payments to intended recipients of health services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd7250-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/3\"><num value=\"3\">(3)</num><content> the purchase or improvement of land, the purchase, construction, or permanent improvement (other than minor remodeling) of any building or other facility, or the purchase of major medical equipment;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd7251-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/4\"><num value=\"4\">(4)</num><content> satisfying any requirement for the expenditure of non-Federal funds as a condition for the receipt of Federal funds;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd7252-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/5\"><num value=\"5\">(5)</num><content> providing funds for research or training to any entity other than a public or nonprofit private entity; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6dd7253-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/6\"><num value=\"6\">(6)</num><chapeau> payment for any item or service (other than an emergency item or service) furnished—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6dd7254-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/6/A\"><num value=\"A\">(A)</num><content> by an individual or entity during the period when such individual or entity is excluded under this subchapter or subchapter XVIII, XIX, or XX pursuant to section 1320a–7, 1320a–7a, 1320c–5, or 1395u(j)(2) of this title, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6dd7255-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/b/6/B\"><num value=\"B\">(B)</num><content> at the medical direction or on the prescription of a physician during the period when the physician is excluded under this subchapter or subchapter XVIII, XIX, or XX pursuant to section 1320a–7, 1320a–7a, 1320c–5, or 1395u(j)(2) of this title and when the person furnishing such item or service knew or had reason to know of the exclusion (after a reasonable time period after reasonable notice has been furnished to the person).</content>\n</subparagraph>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The Secretary may waive the limitation contained in paragraph (3) upon the request of a State if the Secretary finds that there are extraordinary circumstances to justify the waiver and that granting the waiver will assist in carrying out this subchapter.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6dd7256-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Use of portion of funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A State may use a portion of the amounts described in subsection (a) for the purpose of purchasing technical assistance from public or private entities if the State determines that such assistance is required in developing, implementing, and administering programs funded under this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6dd9967-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s704/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitation on use of funds for administrative costs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Of the amounts paid to a State under <ref href=\"/us/usc/t42/s703\">section 703 of this title</ref> from an allotment for a fiscal year under <ref href=\"/us/usc/t42/s702/c\">section 702(c) of this title</ref>, not more than 10 percent may be used for administering the funds paid under such section.</p>\n</content>\n</subsection>\n<sourceCredit id=\"ida6dd9968-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1935-08-14/ch531\">Aug. 14, 1935, ch. 531</ref>, title V, § 504, as added <ref href=\"/us/pl/97/35/tXXI/s2192/a\">Pub.
