value=\"711\">§ 711.</num><heading> Maternal, infant, and early childhood home visiting programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e00a61-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purposes</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The purposes of this section are—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e00a62-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/a/1\"><num value=\"1\">(1)</num><content> to strengthen and improve the programs and activities carried out under this subchapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e00a63-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/a/2\"><num value=\"2\">(2)</num><content> to improve coordination of services for at risk communities; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e00a64-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/a/3\"><num value=\"3\">(3)</num><content> to identify and provide comprehensive services to improve outcomes for families who reside in at risk communities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e00a65-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requirement for all States to assess statewide needs and identify at risk communities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e00a66-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each State shall, as a condition of receiving payments from an allotment for the State under <ref href=\"/us/usc/t42/s702\">section 702 of this title</ref>, conduct a statewide needs assessment (which may be separate from but in coordination with the statewide needs assessment required under <ref href=\"/us/usc/t42/s705/a\">section 705(a) of this title</ref> and which shall be reviewed and updated by the State not later than <date date=\"2020-10-01\">October 1, 2020</date>) that identifies—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e00a67-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A\"><num value=\"A\">(A)</num><chapeau> communities with concentrations of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e00a68-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/i\"><num value=\"i\">(i)</num><content> premature birth, low-birth weight infants, and infant mortality, including infant death due to neglect, or other indicators of at-risk prenatal, maternal, newborn, or child health;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e03179-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> poverty;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> crime;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/iv\"><num value=\"iv\">(iv)</num><content> domestic violence;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/v\"><num value=\"v\">(v)</num><content> high rates of high-school drop-outs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/vi\"><num value=\"vi\">(vi)</num><content> substance abuse;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/vii\"><num value=\"vii\">(vii)</num><content> unemployment; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0317f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/A/viii\"><num value=\"viii\">(viii)</num><content> child maltreatment;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e03180-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/B\"><num value=\"B\">(B)</num><chapeau> the quality and capacity of existing programs or initiatives for early childhood home visitation in the State including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e03181-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/B/i\"><num value=\"i\">(i)</num><content> the number and types of individuals and families who are receiving services under such programs or initiatives;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e03182-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> the gaps in early childhood home visitation in the State; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e03183-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/B/iii\"><num value=\"iii\">(iii)</num><content> the extent to which such programs or initiatives are meeting the needs of eligible families described in subsection (k)(2); and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e03184-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/1/C\"><num value=\"C\">(C)</num><content> the State’s capacity for providing substance abuse treatment and counseling services to individuals and families in need of such treatment or services.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e03185-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Coordination with other assessments</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In conducting the statewide needs assessment required under paragraph (1), the State shall coordinate with, and take into account, other appropriate needs assessments conducted by the State, as determined by the Secretary, including the needs assessment required under <ref href=\"/us/usc/t42/s705/a\">section 705(a) of this title</ref> (both the most recently completed assessment and any such assessment in progress), the communitywide strategic planning and needs assessments conducted in accordance with <ref href=\"/us/usc/t42/s9835/g/1/C\">section 9835(g)(1)(C) of this title</ref>, and the inventory of current unmet needs and current community-based and prevention-focused programs and activities to prevent child abuse and neglect, and other family resource services operating in the State required under section 205(3) of the Child Abuse Prevention and Treatment Act [<ref href=\"/us/usc/t42/s5116d/3\">42 U.S.C. 5116d(3)</ref>].</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e03186-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Submission to the Secretary</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each State shall submit to the Secretary, in such form and manner as the Secretary shall require—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e03187-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/3/A\"><num value=\"A\">(A)</num><content> the results of the statewide needs assessment required under paragraph (1); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e03188-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/b/3/B\"><num value=\"B\">(B)</num><content> a description of how the State intends to address needs identified by the assessment, particularly with respect to communities identified under paragraph (1)(A), which may include applying for a grant to conduct an early childhood home visitation program in accordance with the requirements of this section.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e03189-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Grants for early childhood home visitation programs</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0318a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authority to make grants</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In addition to any other payments made under this subchapter to a State, the Secretary shall make grants to eligible entities to enable the entities to deliver services under early childhood home visitation programs that satisfy the requirements of subsection (d) to eligible families in order to promote improvements in maternal and prenatal health, infant health, child health and development, parenting related to child development outcomes, school readiness, and the socioeconomic status of such families, and reductions in child abuse, neglect, and injuries.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0318b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Authority to use initial grant funds for planning or implementation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An eligible entity that receives a grant under paragraph (1) may use a portion of the funds made available to the entity during the first 6 months of the period for which the grant is made for planning or implementation activities to assist with the establishment of early childhood home visitation programs that satisfy the requirements of subsection (d).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0318c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Authority to use grant for a pay for outcomes initiative</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An eligible entity to which a grant is made under paragraph (1) may use up to 25 percent of the grant for outcomes or success payments related to a pay for outcomes initiative that will not result in a reduction of funding for services delivered by the entity under a childhood home visitation program under this section while the eligible entity develops or operates such an initiative.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0318d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Grant duration</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall determine the period of years for which a grant is made to an eligible entity under paragraph (1).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0589e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall provide an eligible entity that receives a grant under paragraph (1) with technical assistance in administering programs or activities conducted in whole or in part with grant funds.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e0589f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The requirements of this subsection for an early childhood home visitation program conducted with a grant made under this section are as follows:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e058a0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Quantifiable, measurable improvement in benchmark areas</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e058a1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The eligible entity establishes, subject to the approval of the Secretary, quantifiable, measurable 3- and 5-year benchmarks for demonstrating that the program results in improvements for the eligible families participating in the program in the following areas:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/i\"><num value=\"i\">(i)</num><content> Improved maternal and newborn health.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/ii\"><num value=\"ii\">(ii)</num><content> Prevention of child injuries, child abuse, neglect, or maltreatment, and reduction of emergency department visits.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/iii\"><num value=\"iii\">(iii)</num><content> Improvement in school readiness and achievement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/iv\"><num value=\"iv\">(iv)</num><content> Reduction in crime or domestic violence.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/v\"><num value=\"v\">(v)</num><content> Improvements in family economic self-sufficiency.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e058a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/A/vi\"><num value=\"vi\">(vi)</num><content> Improvements in the coordination and referrals for other community resources and supports.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e058a8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Demonstration of improvements after 3 years</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e058a9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Report to the Secretary</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Not later than 30 days after the end of the 3rd year in which the eligible entity conducts the program, the entity submits to the Secretary a report demonstrating improvement in at least 4 of the areas specified in subparagraph (A).</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e058aa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Corrective action plan</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the report submitted by the eligible entity under clause (i) fails to demonstrate improvement in at least 4 of the areas specified in subparagraph (A), the entity shall develop and implement a plan to improve outcomes in each of the areas specified in subparagraph (A), subject to approval by the Secretary. The plan shall include provisions for the Secretary to monitor implementation of the plan and conduct continued oversight of the program, including through submission by the entity of regular reports to the Secretary.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e058ab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Technical assistance</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"ida6e058ac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/iii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The Secretary shall provide an eligible entity required to develop and implement an improvement plan under clause (ii) with technical assistance to develop and implement the plan. The Secretary may provide the technical assistance directly or through grants, contracts, or cooperative agreements.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"ida6e058ad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/iii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Advisory panel</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The Secretary shall establish an advisory panel for purposes of obtaining recommendations regarding the technical assistance provided to entities in accordance with subclause (I).</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e058ae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/B/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> No improvement or failure to submit report</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the Secretary determines after a period of time specified by the Secretary that an eligible entity implementing an improvement plan under clause (ii) has failed to demonstrate any improvement in the areas specified in subparagraph (A), or if the Secretary determines that an eligible entity has failed to submit the report required under clause (i), the Secretary shall terminate the entity’s grant and may include any unexpended grant funds in grants made to nonprofit organizations under subsection (h)(2)(B).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e058af-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Final report</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than <date date=\"2015-12-31\">December 31, 2015</date>, the eligible entity shall submit a report to the Secretary demonstrating improvements (if any) in each of the areas specified in subparagraph (A).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e058b0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Demonstration of improvements in subsequent years</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e058b1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Continued measurement of improvement in applicable benchmark areas</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The eligible entity, after demonstrating improvements for eligible families as specified in subparagraphs (A) and (B), shall continue to track and report, not later than 30 days after the end of fiscal year 2020 and every 3 years thereafter, information demonstrating that the program results in improvements for the eligible families participating in the program in at least 4 of the areas specified in subparagraph (A) that the service delivery model or models selected by the entity are intended to improve.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e07fc2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Corrective action plan</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the eligible entity fails to demonstrate improvement in at least 4 of the areas specified in subparagraph (A), as compared to eligible families who do not receive services under an early childhood home visitation program, the entity shall develop and implement a plan to improve outcomes in each of the areas specified in subparagraph (A) that the service delivery model or models selected by the entity are intended to improve, subject to approval by the Secretary. The plan shall include provisions for the Secretary to monitor implementation of the plan and conduct continued oversight of the program, including through submission by the entity of regular reports to the Secretary.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e07fc3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/D/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall provide an eligible entity required to develop and implement an improvement plan under clause (ii) with technical assistance to develop and implement the plan. The Secretary may provide the technical assistance directly or through grants, contracts, or cooperative agreements.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e07fc4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/1/D/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> No improvement or failure to submit report</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the Secretary determines after a period of time specified by the Secretary that an eligible entity implementing an improvement plan under clause (ii) has failed to demonstrate any improvement in at least 4 of the areas specified in subparagraph (A), or if the Secretary determines that an eligible entity has failed to submit the report required by clause (i), the Secretary shall terminate the grant made to the entity under this section and may include any unexpended grant funds in grants made to nonprofit organizations under subsection (h)(2)(B).</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e07fc5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Improvements in outcomes for individual families</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e07fc6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The program is designed, with respect to an eligible family participating in the program, to result in the participant outcomes described in subparagraph (B) that the eligible entity identifies on the basis of an individualized assessment of the family, are relevant for that family.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e07fc7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Participant outcomes</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The participant outcomes described in this subparagraph are the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fc8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/i\"><num value=\"i\">(i)</num><content> Improvements in prenatal, maternal, and newborn health, including improved pregnancy outcomes <ref class=\"footnoteRef\" idref=\"fn002613\">1</ref><note type=\"footnote\" id=\"fn002613\"><num>1</num> So in original. Probably should be followed by a period.</note></content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fc9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/ii\"><num value=\"ii\">(ii)</num><content> Improvements in child health and development, including the prevention of child injuries and maltreatment and improvements in cognitive, language, social-emotional, and physical developmental indicators.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/iii\"><num value=\"iii\">(iii)</num><content> Improvements in parenting skills.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fcb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/iv\"><num value=\"iv\">(iv)</num><content> Improvements in school readiness and child academic achievement.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fcc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/v\"><num value=\"v\">(v)</num><content> Reductions in crime or domestic violence.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fcd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/vi\"><num value=\"vi\">(vi)</num><content> Improvements in family economic self-sufficiency.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e07fce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/2/B/vii\"><num value=\"vii\">(vii)</num><content> Improvements in the coordination of referrals for, and the provision of, other community resources and supports for eligible families, consistent with State child welfare agency training.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e07fcf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Core components</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The program includes the following core components:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e07fd0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Service delivery model or models</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e07fd1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Subject to clause (ii), the program is conducted using 1 or more of the service delivery models described in item (aa) or (bb) of subclause (I) or in subclause (II) selected by the eligible entity:</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e07fd2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/i/I\"><num value=\"I\">(I)</num><chapeau> The model conforms to a clear consistent home visitation model that has been in existence for at least 3 years and is research-based, grounded in relevant empirically-based knowledge, linked to program determined outcomes, associated with a national organization or institution of higher education that has comprehensive home visitation program standards that ensure high quality service delivery and continuous program quality improvement, and has demonstrated significant,<ref class=\"footnoteRef\" idref=\"fn002614\">2</ref><note type=\"footnote\" id=\"fn002614\"><num>2</num> So in original. The comma probably should not appear.</note> (and in the case of the service delivery model described in item (aa), sustained) positive outcomes, as described in the benchmark areas specified in paragraph (1)(A) and the participant outcomes described in paragraph (2)(B), when evaluated using well-designed and rigorous—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"ida6e0a6e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/i/I/aa\"><num value=\"aa\">(aa)</num><content> randomized controlled research designs, and the evaluation results have been published in a peer-reviewed journal; or</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"ida6e0a6e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/i/I/bb\"><num value=\"bb\">(bb)</num><content> quasi-experimental research designs.</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e0a6e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/i/II\"><num value=\"II\">(II)</num><content> The model conforms to a promising and new approach to achieving the benchmark areas specified in paragraph (1)(A) and the participant outcomes described in paragraph (2)(B), has been developed or identified by a national organization or institution of higher education, and will be evaluated through well-designed and rigorous process.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e0a6e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Majority of grant funds used for evidence-based models</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">An eligible entity shall use not more than 25 percent of the amount of the grant paid to the entity for a fiscal year for purposes of conducting a program using the service delivery model described in clause (i)(II).</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e0a6e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Criteria for evidence of effectiveness of models</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall establish criteria for evidence of effectiveness of the service delivery models and shall ensure that the process for establishing the criteria is transparent and provides the opportunity for public comment.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e0a6e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Additional requirements</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/i\"><num value=\"i\">(i)</num><content> The program adheres to a clear, consistent model that satisfies the requirements of being grounded in empirically-based knowledge related to home visiting and linked to the benchmark areas specified in paragraph (1)(A) and the participant outcomes described in paragraph (2)(B) related to the purposes of the program.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/ii\"><num value=\"ii\">(ii)</num><content> The program employs well-trained and competent staff, as demonstrated by education or training, such as nurses, social workers, educators, child development specialists, or other well-trained and competent staff, and provides ongoing and specific training on the model being delivered.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/iii\"><num value=\"iii\">(iii)</num><content> The program maintains high quality supervision to establish home visitor competencies.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/iv\"><num value=\"iv\">(iv)</num><content> The program demonstrates strong organizational capacity to implement the activities involved.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/v\"><num value=\"v\">(v)</num><content> The program establishes appropriate linkages and referral networks to other community resources and supports for eligible families.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/3/B/vi\"><num value=\"vi\">(vi)</num><content> The program monitors the fidelity of program implementation to ensure that services are delivered pursuant to the specified model.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0a6ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Priority for serving high-risk populations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The eligible entity gives priority to providing services under the program to the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/A\"><num value=\"A\">(A)</num><content> Eligible families who reside in communities in need of such services, as identified in the statewide needs assessment required under subsection (b)(1)(A), taking into account the staffing, community resource, and other requirements to operate at least one approved model of home visiting and demonstrate improvements for eligible families.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/B\"><num value=\"B\">(B)</num><content> Low-income eligible families.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/C\"><num value=\"C\">(C)</num><content> Eligible families who are pregnant women who have not attained age 21.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/D\"><num value=\"D\">(D)</num><content> Eligible families that have a history of child abuse or neglect or have had interactions with child welfare services.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/E\"><num value=\"E\">(E)</num><content> Eligible families that have a history of substance abuse or need substance abuse treatment.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/F\"><num value=\"F\">(F)</num><content> Eligible families that have users of tobacco products in the home.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/G\"><num value=\"G\">(G)</num><content> Eligible families that are or have children with low student achievement.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/H\"><num value=\"H\">(H)</num><content> Eligible families with children with developmental delays or disabilities.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0a6f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/d/4/I\"><num value=\"I\">(I)</num><content> Eligible families who, or that include individuals who, are serving or formerly served in the Armed Forces, including such families that have members of the Armed Forces who have had multiple deployments outside of the United States.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e0ce09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Application requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An eligible entity desiring a grant under this section shall submit an application to the Secretary for approval, in such manner as the Secretary may require, that includes the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/1\"><num value=\"1\">(1)</num><content> A description of the populations to be served by the entity, including specific information regarding how the entity will serve high risk populations described in subsection (d)(4).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/2\"><num value=\"2\">(2)</num><content> An assurance that the entity will give priority to serving low-income eligible families and eligible families who reside in at risk communities identified in the statewide needs assessment required under subsection (b)(1)(A).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/3\"><num value=\"3\">(3)</num><content> The service delivery model or models described in subsection (d)(3)(A) that the entity will use under the program and the basis for the selection of the model or models.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/4\"><num value=\"4\">(4)</num><content> A statement identifying how the selection of the populations to be served and the service delivery model or models that the entity will use under the program for such populations is consistent with the results of the statewide needs assessment conducted under subsection (b).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/5\"><num value=\"5\">(5)</num><content> The quantifiable, measurable benchmarks established by the State to demonstrate that the program contributes to improvements in the areas specified in subsection (d)(1)(A) that the service delivery model or models selected by the entity are intended to improve.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/6\"><num value=\"6\">(6)</num><content> An assurance that the entity will obtain and submit documentation or other appropriate evidence from the organization or entity that developed the service delivery model or models used under the program to verify that the program is implemented and services are delivered according to the model specifications.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/7\"><num value=\"7\">(7)</num><chapeau> Assurances that the entity will establish procedures to ensure that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce11-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/7/A\"><num value=\"A\">(A)</num><content> the participation of each eligible family in the program is voluntary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce12-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/7/B\"><num value=\"B\">(B)</num><content> services are provided to an eligible family in accordance with the individual assessment for that family.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/8\"><num value=\"8\">(8)</num><chapeau> Assurances that the entity will—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce14-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/8/A\"><num value=\"A\">(A)</num><content> submit annual reports to the Secretary regarding the program and activities carried out under the program that include such information and data as the Secretary shall require; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/8/B\"><num value=\"B\">(B)</num><content> participate in, and cooperate with, data and information collection necessary for the evaluation required under subsection (g)(2) and other research and evaluation activities carried out under subsection (h)(3).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/9\"><num value=\"9\">(9)</num><content> A description of other State programs that include home visitation services, including, if applicable to the State, other programs carried out under this subchapter with funds made available from allotments under <ref href=\"/us/usc/t42/s702/c\">section 702(c) of this title</ref>, programs funded under subchapter IV, title II of the Child Abuse Prevention and Treatment Act [<ref href=\"/us/usc/t42/s5116\">42 U.S.C. 5116</ref> et seq.] (relating to community-based grants for the prevention of child abuse and neglect), and <ref href=\"/us/usc/t42/s9840a\">section 9840a of this title</ref> (relating to Early Head Start programs).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e0ce17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/e/10\"><num value=\"10\">(10)</num><content> Other information as required by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e0ce18-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Maintenance of effort</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Funds provided to an eligible entity receiving a grant under this section shall supplement, and not supplant, funds from other sources for early childhood home visitation programs or initiatives.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e0ce19-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Evaluation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0ce1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Independent, expert advisory panel</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, in accordance with subsection (h)(1)(A), shall appoint an independent advisory panel consisting of experts in program evaluation and research, education, and early childhood development—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/1/A\"><num value=\"A\">(A)</num><content> to review, and make recommendations on, the design and plan for the evaluation required under paragraph (2) within 1 year after <date date=\"2010-03-23\">March 23, 2010</date>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/1/B\"><num value=\"B\">(B)</num><content> to maintain and advise the Secretary regarding the progress of the evaluation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0ce1d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/1/C\"><num value=\"C\">(C)</num><content> to comment, if the panel so desires, on the report submitted under paragraph (3).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0ce1e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Authority to conduct evaluation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">On the basis of the recommendations of the advisory panel under paragraph (1), the Secretary shall, by grant, contract, or interagency agreement, conduct an evaluation of the statewide needs assessments submitted under subsection (b) and the grants made under subsections (c) and (h)(3)(B). The evaluation shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0f52f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2/A\"><num value=\"A\">(A)</num><content> an analysis, on a State-by-State basis, of the results of such assessments, including indicators of maternal and prenatal health and infant health and mortality, and State actions in response to the assessments; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0f530-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2/B\"><num value=\"B\">(B)</num><chapeau> an assessment of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0f531-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2/B/i\"><num value=\"i\">(i)</num><content> the effect of early childhood home visitation programs on child and parent outcomes, including with respect to each of the benchmark areas specified in subsection (d)(1)(A) and the participant outcomes described in subsection (d)(2)(B);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0f532-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2/B/ii\"><num value=\"ii\">(ii)</num><content> the effectiveness of such programs on different populations, including the extent to which the ability of programs to improve participant outcomes varies across programs and populations; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0f533-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/2/B/iii\"><num value=\"iii\">(iii)</num><content> the potential for the activities conducted under such programs, if scaled broadly, to improve health care practices, eliminate health disparities, and improve health care system quality, efficiencies, and reduce costs.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0f534-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than <date date=\"2015-03-31\">March 31, 2015</date>, the Secretary shall submit a report to Congress on the results of the evaluation conducted under paragraph (2) and shall make the report publicly available.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e0f535-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Other provisions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0f536-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Intra-agency collaboration</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall ensure that the Maternal and Child Health Bureau and the Administration for Children and Families collaborate with respect to carrying out this section, including with respect to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0f537-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/1/A\"><num value=\"A\">(A)</num><content> reviewing and analyzing the statewide needs assessments required under subsection (b), the awarding and oversight of grants awarded under this section, the establishment of the advisory panels required under subsections (d)(1)(B)(iii)(II) and (g)(1), and the evaluation and report required under subsection (g); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e0f538-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/1/B\"><num value=\"B\">(B)</num><content> consulting with other Federal agencies with responsibility for administering or evaluating programs that serve eligible families to coordinate and collaborate with respect to research related to such programs and families, including the Office of the Assistant Secretary for Planning and Evaluation of the Department of Health and Human Services, the Centers for Disease Control and Prevention, the National Institute of Child Health and Human Development of the National Institutes of Health, the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice, and the Institute of Education Sciences of the Department of Education.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e0f539-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Grants to eligible entities that are not States</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e0f53a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Indian tribes, tribal organizations, or Urban Indian Organizations</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall specify requirements for eligible entities that are Indian Tribes (or a consortium of Indian Tribes), Tribal Organizations, or Urban Indian Organizations to apply for and conduct an early childhood home visitation program with a grant under this section. Such requirements shall, to the greatest extent practicable, be consistent with the requirements applicable to eligible entities that are States and shall require an Indian Tribe (or consortium), Tribal Organization, or Urban Indian Organization to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0f53b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/A/i\"><num value=\"i\">(i)</num><content> conduct a needs assessment similar to the assessment required for all States under subsection (b); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e0f53c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/A/ii\"><num value=\"ii\">(ii)</num><content> establish quantifiable, measurable 3- and 5-year benchmarks consistent with subsection (d)(1)(A).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e0f53d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Nonprofit organizations</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If, as of the beginning of fiscal year 2012, a State has not applied or been approved for a grant under this section, the Secretary may use amounts appropriated under paragraph (1) of subsection (j) that are available for expenditure under paragraph (3) of that subsection to make a grant to an eligible entity that is a nonprofit organization described in subsection (k)(1)(B) to conduct an early childhood home visitation program in the State. The Secretary shall specify the requirements for such an organization to apply for and conduct the program which shall, to the greatest extent practicable, be consistent with the requirements applicable to eligible entities that are States and shall require the organization to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e11c4e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/B/i\"><num value=\"i\">(i)</num><content> carry out the program based on the needs assessment conducted by the State under subsection (b); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e11c4f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/2/B/ii\"><num value=\"ii\">(ii)</num><content> establish quantifiable, measurable 3- and 5-year benchmarks consistent with subsection (d)(1)(A).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e11c50-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Research and other evaluation activities</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e11c51-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall carry out a continuous program of research and evaluation activities in order to increase knowledge about the implementation and effectiveness of home visiting programs, using random assignment designs to the maximum extent feasible. The Secretary may carry out such activities directly, or through grants, cooperative agreements, or contracts.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e11c52-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e11c53-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/3/B/i\"><num value=\"i\">(i)</num><content> evaluation of a specific program or project is conducted by persons or individuals not directly involved in the operation of such program or project; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e11c54-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/3/B/ii\"><num value=\"ii\">(ii)</num><content> the conduct of research and evaluation activities includes consultation with independent researchers, State officials, and developers and providers of home visiting programs on topics including research design and administrative data matching.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e11c55-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Report and recommendation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than <date date=\"2015-12-31\">December 31, 2015</date>, the Secretary shall submit a report to Congress regarding the programs conducted with grants under this section. The report required under this paragraph shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e11c56-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/4/A\"><num value=\"A\">(A)</num><content> information regarding the extent to which eligible entities receiving grants under this section demonstrated improvements in the areas specified in subsection (d)(1)(A);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e11c57-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/4/B\"><num value=\"B\">(B)</num><content> information regarding any technical assistance provided under subsection (d)(1)(B)(iii)(I), including the type of any such assistance provided; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e11c58-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/4/C\"><num value=\"C\">(C)</num><content> recommendations for such legislative or administrative action as the Secretary determines appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e11c59-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Data exchange standards for improved interoperability</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e11c5a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Designation and use of data exchange standards</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e11c5b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Designation</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The head of the department or agency responsible for administering a program funded under this section shall, in consultation with an interagency work group established by the Office of Management and Budget and considering State government perspectives, designate data exchange standards for necessary categories of information that a State agency operating the program is required to electronically exchange with another State agency under applicable Federal law.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e11c5c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Data exchange standards must be nonproprietary and interoperable</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The data exchange standards designated under clause (i) shall, to the extent practicable, be nonproprietary and interoperable.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e11c5d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Other requirements</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In designating data exchange standards under this paragraph, the Secretary shall, to the extent practicable, incorporate—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e11c5e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/iii/I\"><num value=\"I\">(I)</num><content> interoperable standards developed and maintained by an international voluntary consensus standards body, as defined by the Office of Management and Budget;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e11c5f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/iii/II\"><num value=\"II\">(II)</num><content> interoperable standards developed and maintained by intergovernmental partnerships, such as the National Information Exchange Model; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e11c60-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/A/iii/III\"><num value=\"III\">(III)</num><content> interoperable standards developed and maintained by Federal entities with authority over contracting and financial assistance.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e11c61-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Data exchange standards for Federal reporting</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e11c62-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Designation</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The head of the department or agency responsible for administering a program referred to in this section shall, in consultation with an interagency work group established by the Office of Management and Budget, and considering State government perspectives, designate data exchange standards to govern Federal reporting and exchange requirements under applicable Federal law.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e14373-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The data exchange reporting standards required by clause (i) shall, to the extent practicable—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e14374-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/ii/I\"><num value=\"I\">(I)</num><content> incorporate a widely accepted, nonproprietary, searchable, computer-readable format;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e14375-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/ii/II\"><num value=\"II\">(II)</num><content> be consistent with and implement applicable accounting principles;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e14376-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/ii/III\"><num value=\"III\">(III)</num><content> be implemented in a manner that is cost-effective and improves program efficiency and effectiveness; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida6e14377-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/ii/IV\"><num value=\"IV\">(IV)</num><content> be capable of being continually upgraded as necessary.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e14378-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Incorporation of nonproprietary standards</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In designating data exchange standards under this paragraph, the Secretary shall, to the extent practicable, incorporate existing nonproprietary standards, such as the eXtensible Mark up Language.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida6e14379-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/h/5/B/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in this paragraph shall be construed to require a change to existing data exchange standards for Federal reporting about a program referred to in this section, if the head of the department or agency responsible for administering the program finds the standards to be effective and efficient.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1437a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Application of other provisions of subchapter</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e1437b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), the other provisions of this subchapter shall not apply to a grant made under this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e1437c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exceptions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The following provisions of this subchapter shall apply to a grant made under this section to the same extent and in the same manner as such provisions apply to allotments made under <ref href=\"/us/usc/t42/s702/c\">section 702(c) of this title</ref>:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1437d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/A\"><num value=\"A\">(A)</num><content> <ref href=\"/us/usc/t42/s704/b/6\">Section 704(b)(6) of this title</ref> (relating to prohibition on payments to excluded individuals and entities).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1437e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/B\"><num value=\"B\">(B)</num><content> <ref href=\"/us/usc/t42/s704/c\">Section 704(c) of this title</ref> (relating to the use of funds for the purchase of technical assistance).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1437f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/C\"><num value=\"C\">(C)</num><content> <ref href=\"/us/usc/t42/s704/d\">Section 704(d) of this title</ref> (relating to a limitation on administrative expenditures).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14380-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/D\"><num value=\"D\">(D)</num><content> <ref href=\"/us/usc/t42/s706\">Section 706 of this title</ref> (relating to reports and audits), but only to the extent determined by the Secretary to be appropriate for grants made under this section.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14381-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/E\"><num value=\"E\">(E)</num><content> <ref href=\"/us/usc/t42/s707\">Section 707 of this title</ref> (relating to penalties for false statements).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14382-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/F\"><num value=\"F\">(F)</num><content> <ref href=\"/us/usc/t42/s708\">Section 708 of this title</ref> (relating to nondiscrimination).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14383-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/i/2/G\"><num value=\"G\">(G)</num><content> <ref href=\"/us/usc/t42/s709/a\">Section 709(a) of this title</ref> (relating to the administration of the grant program).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e14384-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Appropriations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e14385-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary to carry out this section—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14386-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/A\"><num value=\"A\">(A)</num><content> $100,000,000 for fiscal year 2010;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14387-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/B\"><num value=\"B\">(B)</num><content> $250,000,000 for fiscal year 2011;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14388-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/C\"><num value=\"C\">(C)</num><content> $350,000,000 for fiscal year 2012;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14389-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/D\"><num value=\"D\">(D)</num><content> $400,000,000 for fiscal year 2013;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1438a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/E\"><num value=\"E\">(E)</num><content> $400,000,000 for fiscal year 2014;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1438b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/F\"><num value=\"F\">(F)</num><content> for fiscal year 2015, $400,000,000;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1438c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/G\"><num value=\"G\">(G)</num><content> for fiscal year 2016, $400,000,000; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1438d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/1/H\"><num value=\"H\">(H)</num><content> for each of fiscal years 2017 through 2022, $400,000,000.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e1438e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Reservations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Of the amount appropriated under this subsection for a fiscal year (or portion of a fiscal year), the Secretary shall reserve—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1438f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/2/A\"><num value=\"A\">(A)</num><content> 3 percent of such amount for purposes of making grants to eligible entities that are Indian Tribes (or a consortium of Indian Tribes), Tribal Organizations, or Urban Indian Organizations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e14390-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/2/B\"><num value=\"B\">(B)</num><content> 3 percent of such amount for purposes of carrying out subsections (d)(1)(B)(iii), (g), and (h)(3).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e14391-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Availability</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e14392-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), funds made available to an eligible entity under this section for a fiscal year (or portion of a fiscal year) shall remain available for expenditure by the eligible entity through the end of the second succeeding fiscal year after award. Any funds that are not expended by the eligible entity during the period in which the funds are available under the preceding sentence may be used for grants to nonprofit organizations under subsection (h)(2)(B).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e14393-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Funds for pay for outcomes initiatives</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Funds made available to an eligible entity under this section for a fiscal year (or portion of a fiscal year) for a pay for outcomes initiative shall remain available for expenditure by the eligible entity for not more than 10 years after the funds are so made available.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e16aa4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/j/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Allocation of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To the extent that the grant amount awarded under this section to an eligible entity is determined on the basis of relative population or poverty considerations, the Secretary shall make the determination using the most accurate Federal data available for the eligible entity.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e16aa5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e16aa6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Eligible entity</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e16aa7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “eligible entity” means a State, an Indian Tribe, Tribal Organization, or Urban Indian Organization, Puerto Rico, Guam, the Virgin Islands, the Northern Mariana Islands, and American Samoa.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida6e16aa8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Nonprofit organizations</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Only for purposes of awarding grants under subsection (h)(2)(B), such term shall include a nonprofit organization with an established record of providing early childhood home visitation programs or initiatives in a State or several States.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e16aa9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Eligible family</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “eligible family” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16aaa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/2/A\"><num value=\"A\">(A)</num><content> a woman who is pregnant, and the father of the child if the father is available; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16aab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/2/B\"><num value=\"B\">(B)</num><content> a parent or primary caregiver of a child, including grandparents or other relatives of the child, and foster parents, who are serving as the child’s primary caregiver from birth to kindergarten entry, and including a noncustodial parent who has an ongoing relationship with, and at times provides physical care for, the child.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e16aac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Indian Tribe; Tribal Organization</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “Indian Tribe” and “Tribal Organization”, and “Urban Indian Organization” have the meanings given such terms in <ref href=\"/us/usc/t25/s1603\">section 1603 of title 25</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e16aad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Pay for outcomes initiative</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “pay for outcomes initiative” means a performance-based grant, contract, cooperative agreement, or other agreement awarded by a public entity in which a commitment is made to pay for improved outcomes achieved as a result of the intervention that result in social benefit and direct cost savings or cost avoidance to the public sector. Such an initiative shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16aae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/4/A\"><num value=\"A\">(A)</num><content> a feasibility study that describes how the proposed intervention is based on evidence of effectiveness;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16aaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/4/B\"><num value=\"B\">(B)</num><content> a rigorous, third-party evaluation that uses experimental or quasi-experimental design or other research methodologies that allow for the strongest possible causal inferences to determine whether the initiative has met its proposed outcomes as a result of the intervention;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16ab0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/4/C\"><num value=\"C\">(C)</num><content> an annual, publicly available report on the progress of the initiative; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e16ab1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s711/k/4/D\"><num value=\"D\">(D)</num><content> a requirement that payments are made to the recipient of a grant, contract, or cooperative agreement only when agreed upon outcomes are achieved, except that this requirement shall not apply with respect to payments to a third party conducting the evaluation described in subparagraph (B).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida6e16ab2-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1935-08-14/ch531\">Aug. 14, 1935, ch. 531</ref>, title V, § 511, as added <ref href=\"/us/pl/111/148/tII/s2951\">Pub.
