L. 111–148, title II, § 2952(b), Mar. 23, 2010, 124 Stat. 345.)","seq_in_title":1648,"parent_identifier":"/us/usc/t42/ch7/schV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7","level":"chapter","num":"CHAPTER 7—","heading":"SOCIAL SECURITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch7/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"MATERNAL AND CHILD HEALTH SERVICES BLOCK GRANT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida6e191c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712\"><num value=\"712\">§ 712.</num><heading> Services to individuals with a postpartum condition and their families</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e191c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In addition to any other payments made under this subchapter to a State, the Secretary may make grants to eligible entities for projects for the establishment, operation, and coordination of effective and cost-efficient systems for the delivery of essential services to individuals with or at risk for postpartum conditions and their families.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Certain activities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To the extent practicable and appropriate, the Secretary shall ensure that projects funded under subsection (a) provide education and services with respect to the diagnosis and management of postpartum conditions for individuals with or at risk for postpartum conditions and their families. The Secretary may allow such projects to include the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1b8db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/1\"><num value=\"1\">(1)</num><content> Delivering or enhancing outpatient and home-based health and support services, including case management and comprehensive treatment services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1b8dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/2\"><num value=\"2\">(2)</num><content> Delivering or enhancing inpatient care management services that ensure the well-being of the mother and family and the future development of the infant.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1b8dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/3\"><num value=\"3\">(3)</num><content> Improving the quality, availability, and organization of health care and support services (including transportation services, attendant care, homemaker services, day or respite care, and providing counseling on financial assistance and insurance).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1b8de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/4\"><num value=\"4\">(4)</num><chapeau> Providing education about postpartum conditions to promote earlier diagnosis and treatment. Such education may include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/4/A\"><num value=\"A\">(A)</num><content> providing complete information on postpartum conditions, symptoms, methods of coping with the illness, and treatment resources; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/4/B\"><num value=\"B\">(B)</num><chapeau> in the case of a grantee that is a State, hospital, or birthing facility—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e1b8e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/4/B/i\"><num value=\"i\">(i)</num><content> providing education to new mothers and fathers, and other family members as appropriate, concerning postpartum conditions before new mothers leave the health facility; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida6e1b8e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/b/4/B/ii\"><num value=\"ii\">(ii)</num><content> ensuring that training programs regarding such education are carried out at the health facility.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Integration with other programs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">To the extent practicable and appropriate, the Secretary may integrate the grant program under this section with other grant programs carried out by the Secretary, including the program under <ref href=\"/us/usc/t42/s254b\">section 254b of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Requirements</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall establish requirements for grants made under this section that include a limit on the amount of grants funds that may be used for administration, accounting, reporting, or program oversight functions and a requirement for each eligible entity that receives a grant to submit, for each grant period, a report to the Secretary that describes how grant funds were used during such period.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may provide technical assistance to entities seeking a grant under this section in order to assist such entities in complying with the requirements of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Application of other provisions of subchapter</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e1b8e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), the other provisions of this subchapter shall not apply to a grant made under this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida6e1b8e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exceptions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The following provisions of this subchapter shall apply to a grant made under this section to the same extent and in the same manner as such provisions apply to allotments made under <ref href=\"/us/usc/t42/s702/c\">section 702(c) of this title</ref>:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/A\"><num value=\"A\">(A)</num><content> <ref href=\"/us/usc/t42/s704/b/6\">Section 704(b)(6) of this title</ref> (relating to prohibition on payments to excluded individuals and entities).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/B\"><num value=\"B\">(B)</num><content> <ref href=\"/us/usc/t42/s704/c\">Section 704(c) of this title</ref> (relating to the use of funds for the purchase of technical assistance).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/C\"><num value=\"C\">(C)</num><content> <ref href=\"/us/usc/t42/s704/d\">Section 704(d) of this title</ref> (relating to a limitation on administrative expenditures).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/D\"><num value=\"D\">(D)</num><content> <ref href=\"/us/usc/t42/s706\">Section 706 of this title</ref> (relating to reports and audits), but only to the extent determined by the Secretary to be appropriate for grants made under this section.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/E\"><num value=\"E\">(E)</num><content> <ref href=\"/us/usc/t42/s707\">Section 707 of this title</ref> (relating to penalties for false statements).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/F\"><num value=\"F\">(F)</num><content> <ref href=\"/us/usc/t42/s708\">Section 708 of this title</ref> (relating to nondiscrimination).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/f/2/G\"><num value=\"G\">(G)</num><content> <ref href=\"/us/usc/t42/s709/a\">Section 709(a) of this title</ref> (relating to the administration of the grant program).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida6e1b8f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1b8f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/g/1\"><num value=\"1\">(1)</num><chapeau> The term “eligible entity”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/g/1/A\"><num value=\"A\">(A)</num><content> means a public or nonprofit private entity; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida6e1b8f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/g/1/B\"><num value=\"B\">(B)</num><content> includes a State or local government, public-private partnership, recipient of a grant under <ref href=\"/us/usc/t42/s254c–8\">section 254c–8 of this title</ref> (relating to the Healthy Start Initiative), public or nonprofit private hospital, community-based organization, hospice, ambulatory care facility, community health center, migrant health center, public housing primary care center, or homeless health center.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida6e1e004-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s712/g/2\"><num value=\"2\">(2)</num><content> The term “postpartum condition” means L. 111–148, title II, § 2952(a)</ref>, <date date=\"2010-03-23\">Mar. 23, 2010</date>, <ref href=\"/us/stat/124/344\">124 Stat. 344</ref>, provided that:<quotedContent origin=\"/us/pl/111/148/tII/s2952/a\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Research on Postpartum Conditions.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Expansion and intensification of activities</inline>.—</heading><chapeau>The Secretary of Health and Human Services (in this subsection and subsection (c) referred to as the ‘Secretary’) is encouraged to continue activities on postpartum depression or postpartum psychosis (in this subsection and subsection (c) referred to as ‘postpartum conditions’), including research to expand the understanding of the causes of, and treatments for, postpartum conditions. Activities under this paragraph shall include conducting and supporting the following:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> Basic research concerning the etiology and causes of the conditions.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> Epidemiological studies to address the frequency and natural history of the conditions and the differences among racial and ethnic groups with respect to the conditions.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> The development of improved screening and diagnostic techniques.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> Clinical research for the development and evaluation of new treatments.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><chapeau> Information and education programs for health care professionals and the public, which may include a coordinated national campaign to increase the awareness and knowledge of postpartum conditions. Activities under such a national campaign may—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> include public service announcements through television, radio, and other means; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><chapeau> focus on—</chapeau><subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"I\">     “(I)</num><content> raising awareness about screening;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"II\">     “(II)</num><content> educating new mothers and their families about postpartum conditions to promote earlier diagnosis and treatment; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"III\">     “(III)</num><content> ensuring that such education includes complete information concerning postpartum conditions, including its symptoms, methods of coping with the illness, and treatment resources.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Sense of congress regarding longitudinal study of relative mental health consequences for women of resolving a pregnancy.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Sense of congress</inline>.—</heading><content>It is the sense of Congress that the Director of the National Institute of Mental Health may conduct a nationally representative longitudinal study (during the period of fiscal years 2010 through 2019) of the relative mental health consequences for women of resolving a pregnancy (intended and unintended) in various ways, including carrying the pregnancy to term and parenting the child, carrying the pregnancy to term and placing the child for adoption, miscarriage, and having an abortion.
