The Deputy Secretary shall act for and exercise the functions of the Secretary during the absence or disability of the Secretary or in the event the office of Secretary becomes vacant. The Secretary shall designate the order in which the Under Secretary and other officials shall act for and perform the functions of the Secretary during the absence or disability of both the Secretary and Deputy Secretary or in the event of vacancies in both of those offices.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8e563b53-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Under Secretary for Science</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e563b54-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/1\"><num value=\"1\">(1)</num><content> There shall be in the Department an Under Secretary for Science, who shall be appointed by the President, by and with the advice and consent of the Senate.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e563b55-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/2\"><num value=\"2\">(2)</num><content> The Under Secretary shall be compensated at the rate provided for level III of the Executive Schedule under <ref href=\"/us/usc/t5/s5314\">section 5314 of title 5</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e563b56-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/3\"><num value=\"3\">(3)</num><chapeau> The Under Secretary for Science shall be appointed from among persons who—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e563b57-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/3/A\"><num value=\"A\">(A)</num><content> have extensive background in scientific or engineering fields; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e563b58-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/3/B\"><num value=\"B\">(B)</num><content> are well qualified to manage the civilian research and development programs of the Department.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e563b59-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4\"><num value=\"4\">(4)</num><chapeau> The Under Secretary for Science shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e563b5a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/A\"><num value=\"A\">(A)</num><content> serve as the Science and Technology Advisor to the Secretary;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e563b5b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/B\"><num value=\"B\">(B)</num><content> monitor the research and development programs of the Department in order to advise the Secretary with respect to any undesirable duplication or gaps in the programs;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e56626c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/C\"><num value=\"C\">(C)</num><content> advise the Secretary with respect to the well-being and management of the multipurpose laboratories under the jurisdiction of the Department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e56626d-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/D\"><num value=\"D\">(D)</num><content> advise the Secretary with respect to education and training activities required for effective short- and long-term basic and applied research activities of the Department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e56626e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/E\"><num value=\"E\">(E)</num><content> advise the Secretary with respect to grants and other forms of financial assistance required for effective short- and long-term basic and applied research activities of the Department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e56626f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/F\"><num value=\"F\">(F)</num><content> advise the Secretary with respect to long-term planning, coordination, and development of a strategic framework for Department research and development activities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e566270-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/b/4/G\"><num value=\"G\">(G)</num><content> carry out such additional duties assigned to the Under Secretary by the Secretary relating to basic and applied research, including supervision or support of research activities carried out by any of the Assistant Secretaries designated by <ref href=\"/us/usc/t42/s7133\">section 7133 of this title</ref>, as the Secretary considers advantageous.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8e566271-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Under Secretary for Nuclear Security</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e566272-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c/1\"><num value=\"1\">(1)</num><content> There shall be in the Department an Under Secretary for Nuclear Security, who shall be appointed by the President, by and with the advice and consent of the Senate. The Under Secretary shall be compensated at the rate provided for at level III of the Executive Schedule under <ref href=\"/us/usc/t5/s5314\">section 5314 of title 5</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e566273-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c/2\"><num value=\"2\">(2)</num><chapeau> The Under Secretary for Nuclear Security shall be appointed from among persons who—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e566274-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c/2/A\"><num value=\"A\">(A)</num><content> have extensive background in national security, organizational management, and appropriate technical fields; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8e566275-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c/2/B\"><num value=\"B\">(B)</num><content> are well qualified to manage the nuclear weapons, nonproliferation, and materials disposition programs of the National Nuclear Security Administration in a manner that advances and protects the national security of the United States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e566276-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/c/3\"><num value=\"3\">(3)</num><content> The Under Secretary for Nuclear Security shall serve as the Administrator for Nuclear Security under <ref href=\"/us/usc/t50/s2402\">section 2402 of title 50</ref>. In carrying out the functions of the Administrator, the Under Secretary shall be subject to the authority, direction, and control of the Secretary. Such authority, direction, and control may be delegated only to the Deputy Secretary of Energy, without redelegation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8e566277-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Under Secretary</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e566278-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/d/1\"><num value=\"1\">(1)</num><content> There shall be in the Department an Under Secretary, who shall be appointed by the President, by and with the advice and consent of the Senate, and who shall perform such functions and duties as the Secretary shall prescribe, consistent with this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e566279-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/d/2\"><num value=\"2\">(2)</num><content> The Under Secretary shall be compensated at the rate provided for level III of the Executive Schedule under <ref href=\"/us/usc/t5/s5314\">section 5314 of title 5</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8e56627a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> General Counsel</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e56627b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/e/1\"><num value=\"1\">(1)</num><content> There shall be in the Department a General Counsel, who shall be appointed by the President, by and with the advice and consent of the Senate, and who shall perform such functions and duties as the Secretary shall prescribe.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id8e56627c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s7132/e/2\"><num value=\"2\">(2)</num><content> The General Counsel shall be compensated at the rate provided for level IV of the Executive Schedule under <ref href=\"/us/usc/t5/s5315\">section 5315 of title 5</ref>.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8e56627d-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/95/91/tII/s202\">Pub.
