<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8e6752f7-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383"><num value="7383">§ 7383.</num><heading> Commission on Safeguards, Security, and Counterintelligence at Department of Energy Facilities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e6752f8-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is hereby established a commission to be known as the Commission on Safeguards, Security, and Counterintelligence at Department of Energy Facilities (in this section referred to as the “Commission”).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e6752f9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b"><num value="b" class="bold">(b)</num><heading class="bold"> Membership and organization</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e6752fa-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1"><num value="1">(1)</num><chapeau> The Commission shall be composed of nine members appointed from among individuals in the public and private sectors who have significant experience in matters related to the security of nuclear weapons and materials, the classification of information, or counterintelligence matters, as follows:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e6752fb-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/A"><num value="A">(A)</num><content> Two shall be appointed by the chairman of the Committee on Armed Services of the Senate, in consultation with the ranking member of that Committee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e6752fc-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/B"><num value="B">(B)</num><content> One shall be appointed by the ranking member of the Committee on Armed Services of the Senate, in consultation with the chairman of that Committee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e6752fd-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/C"><num value="C">(C)</num><content> Two shall be appointed by the chairman of the Committee on Armed Services of the House of Representatives, in consultation with the ranking member of that Committee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e6752fe-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/D"><num value="D">(D)</num><content> One shall be appointed by the ranking member of the Committee on Armed Services of the House of Representatives, in consultation with the chairman of that Committee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e6752ff-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/E"><num value="E">(E)</num><content> One shall be appointed by the Secretary of Defense.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e675300-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/F"><num value="F">(F)</num><content> One shall be appointed by the Director of the Federal Bureau of Investigation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e675301-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/1/G"><num value="G">(G)</num><content> One shall be appointed by the Director of Central Intelligence.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e675302-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/2"><num value="2">(2)</num><chapeau> Members of the Commission shall be appointed for four year terms, except as follows:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e675303-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/2/A"><num value="A">(A)</num><content> One member initially appointed under paragraph (1)(A) shall serve a term of two years, to be designated at the time of appointment.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e675304-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/2/B"><num value="B">(B)</num><content> One member initially appointed under paragraph (1)(C) shall serve a term of two years, to be designated at the time of appointment.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e675305-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/2/C"><num value="C">(C)</num><content> The member initially appointed under paragraph (1)(E) shall serve a term of two years.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e675306-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/3"><num value="3">(3)</num><content> Any vacancy in the Commission shall be filled in the same manner as the original appointment and shall not affect the powers of the Commission.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e675307-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id8e675308-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/4/A"><num value="A">(A)</num><content> After five members of the Commission have been appointed under paragraph (1), the chairman of the Committee on Armed Services of the Senate, in consultation with the chairman of the Committee on Armed Services of the House of Representatives, shall designate the chairman of the Commission from among the members appointed under paragraph (1)(A).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id8e675309-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/4/B"><num value="B">(B)</num><content> The chairman of the Commission may be designated once five members of the Commission have been appointed under paragraph (1).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67530a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/5"><num value="5">(5)</num><content> The initial members of the Commission shall be appointed not later than 60 days after <date date="1999-10-05">October 5, 1999</date>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67530b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/6"><num value="6">(6)</num><content> The members of the Commission shall establish procedures for the activities of the Commission, including procedures for calling meetings, requirements for quorums, and the manner of taking votes.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67530c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/7"><num value="7">(7)</num><content> The Commission shall meet not less often than once every three months.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67530d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/b/8"><num value="8">(8)</num><content> The Commission may commence its activities under this section upon the designation of the chairman of the Commission under paragraph (4).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e67530e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duties</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a1f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/1"><num value="1">(1)</num><chapeau> The Commission shall, in accordance with this section, review the safeguards, security, and counterintelligence activities (including activities relating to information management, computer security, and personnel security) at Department of Energy facilities to—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a20-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/1/A"><num value="A">(A)</num><content> determine the adequacy of those activities to ensure the security of sensitive information, processes, and activities under the jurisdiction of the Department against threats to the disclosure of such information, processes, and activities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a21-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/1/B"><num value="B">(B)</num><content> make recommendations for actions the Commission determines as being necessary to ensure that such security is achieved and maintained.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a22-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2"><num value="2">(2)</num><chapeau> The activities of the Commission under paragraph (1) shall include the following:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a23-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2/A"><num value="A">(A)</num><content> An analysis of the sufficiency of the Design Threat Basis documents as a basis for the allocation of resources for safeguards, security, and counterintelligence activities at the Department facilities in light of applicable guidance with respect to such activities, including applicable laws, Department of Energy orders, Presidential Decision Directives, and Executive orders.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a24-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2/B"><num value="B">(B)</num><content> Visits to Department facilities to assess the adequacy of the safeguards, security, and counterintelligence activities at such facilities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a25-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2/C"><num value="C">(C)</num><content> Evaluations of specific concerns set forth in Department reports regarding the status of safeguards, security, or counterintelligence activities at particular Department facilities or at facilities throughout the Department.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a26-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2/D"><num value="D">(D)</num><content> Reviews of relevant laws, Department orders, and other requirements relating to safeguards, security, and counterintelligence activities at Department facilities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a27-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/c/2/E"><num value="E">(E)</num><content> Any other activities relating to safeguards, security, and counterintelligence activities at Department facilities that the Secretary of Energy considers appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e677a28-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d"><num value="d" class="bold">(d)</num><heading class="bold"> Reports</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a29-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d/1"><num value="1">(1)</num><content> Not later than February 15 each year, the Commission shall submit to the Secretary of Energy and to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives a report on the activities of the Commission during the preceding year. The report shall be submitted in unclassified form, but may include a classified annex.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a2a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d/2"><num value="2">(2)</num><chapeau> Each report—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a2b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d/2/A"><num value="A">(A)</num><content> shall describe the activities of the Commission during the year covered by the report;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a2c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d/2/B"><num value="B">(B)</num><content> shall set forth proposals for any changes in safeguards, security, or counterintelligence activities at Department of Energy facilities that the Commission considers appropriate in light of such activities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e677a2d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/d/2/C"><num value="C">(C)</num><content> may include any other recommendations for legislation or administrative action that the Commission considers appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e677a2e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e"><num value="e" class="bold">(e)</num><heading class="bold"> Personnel matters</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a2f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id8e677a30-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/1/A"><num value="A">(A)</num><content> Each member of the Commission who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under <ref href="/us/usc/t5/s5316">section 5316 of title 5</ref> for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id8e677a31-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/1/B"><num value="B">(B)</num><content> All members of the Commission who are officers or employees of the United States shall serve without compensation by reason of their service on the Commission.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a32-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/2"><num value="2">(2)</num><content> The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5 while away from their homes or regular places of business in the performance of services for the Commission.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e677a33-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id8e677a34-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/3/A"><num value="A">(A)</num><content> The Commission may, without regard to the civil service laws and regulations, appoint and terminate such personnel as may be necessary to enable the Commission to perform its duties.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id8e67a145-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/3/B"><num value="B">(B)</num><content> The Commission may fix the compensation of the personnel of the Commission without regard to the provisions of chapter 51 and subchapter III of chapter 53 of title 5 relating to classification of positions and General Schedule pay rates.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67a146-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/4"><num value="4">(4)</num><content> Any officer or employee of the United States may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67a147-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/e/5"><num value="5">(5)</num><content> The members and employees of the Commission shall hold security clearances appropriate for the matters considered by the Commission in the discharge of its duties under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e67a148-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/f"><num value="f" class="bold">(f)</num><heading class="bold"> Applicability of FACA</heading><content><p style="-uslm-lc:I11" class="indent0">The provisions of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the activities of the Commission.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e67a149-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/g"><num value="g" class="bold">(g)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e67a14a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/g/1"><num value="1">(1)</num><content> From amounts authorized to be appropriated by sections 3101 and 3103, the Secretary of Energy shall make available to the Commission not more than $1,000,000 for the activities of the Commission under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e67a14b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7383/g/2"><num value="2">(2)</num><content> Amounts made available to the Commission under this subsection shall remain available until expended.</content>
