<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac29f40d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r"><num value="7384r">§ 7384r.</num><heading> Separate treatment of chronic silicosis</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac29f40e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/a"><num value="a" class="bold">(a)</num><heading class="bold"> Sense of Congress</heading><content><p style="-uslm-lc:I11" class="indent0">Congress finds that employees who worked in Department of Energy test sites and later contracted chronic silicosis should also be considered for inclusion in the compensation program. Recognizing that chronic silicosis resulting from exposure to silica is not a condition unique to the nuclear weapons industry, it is not the intent of Congress with this subchapter to establish a precedent on the question of chronic silicosis as a compensable occupational disease. Consequently, it is the sense of Congress that a further determination by the President is appropriate before these workers are included in the compensation program.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac29f40f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/b"><num value="b" class="bold">(b)</num><heading class="bold"> Certification by President</heading><content><p style="-uslm-lc:I11" class="indent0">A covered employee with chronic silicosis shall be treated as a covered employee (as defined in section 7384<i>l</i>(1) of this title) for the purposes of the compensation program required by <ref href="/us/usc/t42/s7384d">section 7384d of this title</ref> unless the President submits to Congress not later than 180 days after <date date="2000-10-30">October 30, 2000</date>, the certification of the President that there is insufficient basis to include such employees. The President shall submit with the certification any recommendations about the compensation program with respect to covered employees with chronic silicosis as the President considers appropriate.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac29f410-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exposure to silica in the performance of duty</heading><content><p style="-uslm-lc:I11" class="indent0">A covered employee shall, in the absence of substantial evidence to the contrary, be determined to have been exposed to silica in the performance of duty for the purposes of the compensation program if, and only if, the employee was present for a number of work days aggregating at least 250 work days during the mining of tunnels at a Department of Energy facility located in Nevada or Alaska for tests or experiments related to an atomic weapon.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac29f411-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/d"><num value="d" class="bold">(d)</num><heading class="bold"> Covered employee with chronic silicosis</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of this subchapter, the term “covered employee with chronic silicosis” means a Department of Energy employee, or a Department of Energy contractor employee, with chronic silicosis who was exposed to silica in the performance of duty as determined under subsection (c).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac29f412-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e"><num value="e" class="bold">(e)</num><heading class="bold"> Chronic silicosis</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this subchapter, the term “chronic silicosis” means a nonmalignant lung disease if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac2a1b23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e/1"><num value="1">(1)</num><content> the initial occupational exposure to silica dust preceded the onset of silicosis by at least 10 years; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac2a1b24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e/2"><num value="2">(2)</num><chapeau> a written diagnosis of silicosis is made by a medical doctor and is accompanied by—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac2a1b25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e/2/A"><num value="A">(A)</num><content> a chest radiograph, interpreted by an individual certified by the National Institute for Occupational Safety and Health as a B reader, classifying the existence of pneumoconioses of category 1/0 or higher;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac2a1b26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e/2/B"><num value="B">(B)</num><content> results from a computer assisted tomograph or other imaging technique that are consistent with silicosis; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac2a1b27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7384r/e/2/C"><num value="C">(C)</num><content> lung biopsy findings consistent with silicosis.</content>
