<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac4321f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425"><num value="7425">§ 7425.</num><heading> Measures to prevent economic disruption or unemployment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac4321f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a"><num value="a" class="bold">(a)</num><heading class="bold"> Determination that action is necessary</heading><chapeau style="-uslm-lc:I11" class="indent0">After notice and opportunity for a public hearing—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac4321f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/1"><num value="1">(1)</num><content> the Governor of any State in which a major fuel burning stationary source referred to in this subsection (or class or category thereof) is located,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac4321f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/2"><num value="2">(2)</num><content> the Administrator, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac4321f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/3"><num value="3">(3)</num><content> the President (or his designee),</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">may determine that action under subsection (b) of this section is necessary to prevent or minimize significant local or regional economic disruption or unemployment which would otherwise result from use by such source (or class or category) of—</continuation>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac4321f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/A"><num value="A">(A)</num><content> coal or coal derivatives other than locally or regionally available coal,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac4321f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/B"><num value="B">(B)</num><content> petroleum products,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac4321fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/C"><num value="C">(C)</num><content> natural gas, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac4321fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/a/D"><num value="D">(D)</num><content> any combination of fuels referred to in subparagraphs (A) through (C),</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">to comply with the requirements of a State implementation plan.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac4321fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/b"><num value="b" class="bold">(b)</num><heading class="bold"> Use of locally or regionally available coal or coal derivatives to comply with implementation plan requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">Upon a determination under subsection (a)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac4321fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/b/1"><num value="1">(1)</num><content> such Governor, with the written consent of the President or his designee,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac4321fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/b/2"><num value="2">(2)</num><content> the President’s designee with the written consent of such Governor, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac4321ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/b/3"><num value="3">(3)</num><content> the President</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">may by rule or order prohibit any such major fuel burning stationary source (or class or category thereof) from using fuels other than locally or regionally available coal or coal derivatives to comply with implementation plan requirements. In taking any action under this subsection, the Governor, the President, or the President’s designee as the case may be, shall take into account, the final cost to the consumer of such an action.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac432200-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/c"><num value="c" class="bold">(c)</num><heading class="bold"> Contracts; schedules</heading><chapeau style="-uslm-lc:I11" class="indent0">The Governor, in the case of action under subsection (b)(1), or the Administrator, in the case of an action under subsection (b)(2) or (3) shall, by rule or order, require each source to which such action applies to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac432201-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/c/1"><num value="1">(1)</num><content> enter into long-term contracts of at least ten years in duration (except as the President or his designee may otherwise permit or require by rule or order for good cause) for supplies of regionally available coal or coal derivatives,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac432202-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/c/2"><num value="2">(2)</num><content> enter into contracts to acquire any additional means of emission limitation which the Administrator or the State determines may be necessary to comply with the requirements of this chapter while using such coal or coal derivatives as fuel, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac432203-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/c/3"><num value="3">(3)</num><content> comply with such schedules (including increments of progress), timetables and other requirements as may be necessary to assure compliance with the requirements of this chapter.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Requirements under this subsection shall be established simultaneously with, and as a condition of, any action under subsection (b).</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac432204-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/d"><num value="d" class="bold">(d)</num><heading class="bold"> Existing or new major fuel burning stationary sources</heading><chapeau style="-uslm-lc:I11" class="indent0">This section applies only to existing or new major fuel burning stationary sources—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac432205-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/d/1"><num value="1">(1)</num><content> which have the design capacity to produce 250,000,000 Btu’s per hour (or its equivalent), as determined by the Administrator, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac432206-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/d/2"><num value="2">(2)</num><content> which are not in compliance with the requirements of an applicable implementation plan or which are prohibited from burning oil or natural gas, or both, under any other authority of law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac432207-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/e"><num value="e" class="bold">(e)</num><heading class="bold"> Actions not to be deemed modifications of major fuel burning stationary sources</heading><content><p style="-uslm-lc:I11" class="indent0">Except as may otherwise be provided by rule by the State or the Administrator for good cause, any action required to be taken by a major fuel burning stationary source under this section shall not be deemed to constitute a modification for purposes of section 7411(a)(2) and (4) of this title.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac432208-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/f"><num value="f" class="bold">(f)</num><heading class="bold"> Treatment of prohibitions, rules, or orders as requirements or parts of plans under other provisions</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of sections 7413 and 7420 of this title a prohibition under subsection (b), and a corresponding rule or order under subsection (c), shall be treated as a requirement of <ref href="/us/usc/t42/s7413">section 7413 of this title</ref>. For purposes of any plan (or portion thereof) promulgated under <ref href="/us/usc/t42/s7410/c">section 7410(c) of this title</ref>, any rule or order under subsection (c) corresponding to a prohibition under subsection (b), shall be treated as a part of such plan. For purposes of <ref href="/us/usc/t42/s7413">section 7413 of this title</ref>, a prohibition under subsection (b), applicable to any source, and a corresponding rule or order under subsection (c), shall be treated as part of the applicable implementation plan for the State in which subject source is located.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac434919-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/g"><num value="g" class="bold">(g)</num><heading class="bold"> Delegation of Presidential authority</heading><content><p style="-uslm-lc:I11" class="indent0">The President may delegate his authority under this section to an officer or employee of the United States designated by him on a case-by-case basis or in any other manner he deems suitable.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac43491a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7425/h"><num value="h" class="bold">(h)</num><heading class="bold"> “Locally or regionally available coal or coal derivatives” defined</heading><content><p style="-uslm-lc:I11" class="indent0">For the purpose of this section the term “locally or regionally available coal or coal derivatives” means coal or coal derivatives which is, or can in the judgment of the State or the Administrator feasibly be, mined or produced in the local or regional area (as determined by the Administrator) in which the major fuel burning stationary source is located.</p>
