L. 101–549, title I, § 109(a), Nov. 15, 1990, 104 Stat. 2469.)","seq_in_title":5346,"parent_identifier":"/us/usc/t42/ch85/schI/ptA","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85","level":"chapter","num":"CHAPTER 85—","heading":"AIR POLLUTION PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"PROGRAMS AND ACTIVITIES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85/schI/ptA","level":"part","num":"Part A—","heading":"Air Quality and Emission Limitations","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idac43491e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426\"><num value=\"7426\">§ 7426.</num><heading> Interstate pollution abatement</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac43491f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Written notice to all nearby States</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each applicable implementation plan shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac434920-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/a/1\"><num value=\"1\">(1)</num><chapeau> require each major proposed new (or modified) source—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac434921-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/a/1/A\"><num value=\"A\">(A)</num><content> subject to part C (relating to significant deterioration of air quality) or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac434922-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/a/1/B\"><num value=\"B\">(B)</num><content> which may significantly contribute to levels of air pollution in excess of the national ambient air quality standards in any air quality control region outside the State in which such source intends to locate (or make such modification),</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">to provide written notice to all nearby States the air pollution levels of which may be affected by such source at least sixty days prior to the date on which commencement of construction is to be permitted by the State providing notice, and</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac434923-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/a/2\"><num value=\"2\">(2)</num><content> identify all major existing stationary sources which may have the impact described in paragraph (1) with respect to new or modified sources and provide notice to all nearby States of the identity of such sources not later than three months after <date date=\"1977-08-07\">August 7, 1977</date>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac434924-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Petition for finding that major sources emit or would emit prohibited air pollutants</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any State or political subdivision may petition the Administrator for a finding that any major source or group of stationary sources emits or would emit any air pollutant in violation of the prohibition of <ref href=\"/us/usc/t42/s7410/a/2/D/ii\">section 7410(a)(2)(D)(ii) of this title</ref> or this section. Within 60 days after receipt of any petition under this subsection and after public hearing, the Administrator shall make such a finding or deny the petition.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac434925-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Violations; allowable continued operation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any permit which may have been granted by the State in which the source is located (or intends to locate), it shall be a violation of this section and the applicable implementation plan in such State—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac434926-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/c/1\"><num value=\"1\">(1)</num><content> for any major proposed new (or modified) source with respect to which a finding has been made under subsection (b) to be constructed or to operate in violation of the prohibition of <ref href=\"/us/usc/t42/s7410/a/2/D/ii\">section 7410(a)(2)(D)(ii) of this title</ref> or this section, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac434927-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7426/c/2\"><num value=\"2\">(2)</num><content> for any major existing source to operate more than three months after such finding has been made with respect to it.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">The Administrator may permit the continued operation of a source referred to in paragraph (2) beyond the expiration of such three-month period if such source complies with such emission limitations and compliance schedules (containing increments of progress) as may be provided by the Administrator to bring about compliance with the requirements contained in <ref href=\"/us/usc/t42/s7410/a/2/D/ii\">section 7410(a)(2)(D)(ii) of this title</ref> or this section as expeditiously as practicable, but in no case later than three years after the date of such finding.
