<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8e9f52e7-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601"><num value="7601">§ 7601.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e9f52e8-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a"><num value="a" class="bold">(a)</num><heading class="bold"> Regulations; delegation of powers and duties; regional officers and employees</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f52e9-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a/1"><num value="1">(1)</num><content> The Administrator is authorized to prescribe such regulations as are necessary to carry out his functions under this chapter. The Administrator may delegate to any officer or employee of the Environmental Protection Agency such of his powers and duties under this chapter, except the making of regulations subject to <ref href="/us/usc/t42/s7607/d">section 7607(d) of this title</ref>, as he may deem necessary or expedient.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f52ea-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a/2"><num value="2">(2)</num><chapeau> Not later than one year after <date date="1977-08-07">August 7, 1977</date>, the Administrator shall promulgate regulations establishing general applicable procedures and policies for regional officers and employees (including the Regional Administrator) to follow in carrying out a delegation under paragraph (1), if any. Such regulations shall be designed—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f52eb-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a/2/A"><num value="A">(A)</num><content> to assure fairness and uniformity in the criteria, procedures, and policies applied by the various regions in implementing and enforcing the chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f52ec-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a/2/B"><num value="B">(B)</num><content> to assure at least an adequate quality audit of each State’s performance and adherence to the requirements of this chapter in implementing and enforcing the chapter, particularly in the review of new sources and in enforcement of the chapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f52ed-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/a/2/C"><num value="C">(C)</num><content> to provide a mechanism for identifying and standardizing inconsistent or varying criteria, procedures, and policies being employed by such officers and employees in implementing and enforcing the chapter.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e9f52ee-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/b"><num value="b" class="bold">(b)</num><heading class="bold"> Detail of Environmental Protection Agency personnel to air pollution control agencies</heading><content><p style="-uslm-lc:I11" class="indent0">Upon the request of an air pollution control agency, personnel of the Environmental Protection Agency may be detailed to such agency for the purpose of carrying out the provisions of this chapter.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e9f52ef-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/c"><num value="c" class="bold">(c)</num><heading class="bold"> Payments under grants; installments; advances or reimbursements</heading><content><p style="-uslm-lc:I11" class="indent0">Payments under grants made under this chapter may be made in installments, and in advance or by way of reimbursement, as may be determined by the Administrator.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8e9f52f0-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d"><num value="d" class="bold">(d)</num><heading class="bold"> Tribal authority</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f52f1-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/1"><num value="1">(1)</num><chapeau> Subject to the provisions of paragraph (2), the Administrator—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f52f2-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/1/A"><num value="A">(A)</num><content> is authorized to treat Indian tribes as States under this chapter, except for purposes of the requirement that makes available for application by each State no less than one-half of 1 percent of annual appropriations under <ref href="/us/usc/t42/s7405">section 7405 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f52f3-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/1/B"><num value="B">(B)</num><content> may provide any such Indian tribe grant and contract assistance to carry out functions provided by this chapter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f7a04-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/2"><num value="2">(2)</num><chapeau> The Administrator shall promulgate regulations within 18 months after <date date="1990-11-15">November 15, 1990</date>, specifying those provisions of this chapter for which it is appropriate to treat Indian tribes as States. Such treatment shall be authorized only if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f7a05-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/2/A"><num value="A">(A)</num><content> the Indian tribe has a governing body carrying out substantial governmental duties and powers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f7a06-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/2/B"><num value="B">(B)</num><content> the functions to be exercised by the Indian tribe pertain to the management and protection of air resources within the exterior boundaries of the reservation or other areas within the tribe’s jurisdiction; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8e9f7a07-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/2/C"><num value="C">(C)</num><content> the Indian tribe is reasonably expected to be capable, in the judgment of the Administrator, of carrying out the functions to be exercised in a manner consistent with the terms and purposes of this chapter and all applicable regulations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f7a08-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/3"><num value="3">(3)</num><content> The Administrator may promulgate regulations which establish the elements of tribal implementation plans and procedures for approval or disapproval of tribal implementation plans and portions thereof.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f7a09-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/4"><num value="4">(4)</num><content> In any case in which the Administrator determines that the treatment of Indian tribes as identical to States is inappropriate or administratively infeasible, the Administrator may provide, by regulation, other means by which the Administrator will directly administer such provisions so as to achieve the appropriate purpose.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id8e9f7a0a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7601/d/5"><num value="5">(5)</num><content> Until such time as the Administrator promulgates regulations pursuant to this subsection, the Administrator may continue to provide financial assistance to eligible Indian tribes under <ref href="/us/usc/t42/s7405">section 7405 of this title</ref>.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Definition.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">(A)</num><chapeau> For purposes of subsection (a), the term ‘disadvantaged business concern’ means a concern—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> which is at least 51 percent owned by one or more socially and economically disadvantaged individuals or, in the case of a publicly traded company, at least 51 percent of the stock of which is owned by one or more socially and economically disadvantaged individuals; and</content>

<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><clause style="-uslm-lc:I22" class="indent1"><num value="i">(i)</num><chapeau> A for-profit business concern is presumed to be a disadvantaged business concern for purposes of subsection (a) if it is at least 51 percent owned by, or in the case of a concern which is a publicly traded company at least 51 percent of the stock of the company is owned by, one or more individuals who are members of the following groups:</chapeau><subclause style="-uslm-lc:I23" class="indent2"><num value="I">“(I)</num><content> Black Americans.</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="II">“(II)</num><content> Hispanic Americans.</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="III">“(III)</num><content> Native Americans.</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="IV">“(IV)</num><content> Asian Americans.</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="V">“(V)</num><content> Women.</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="VI">“(VI)</num><content> Disabled Americans.</content>

</clause>
<clause style="-uslm-lc:I22" class="indent1"><num value="ii">“(ii)</num><content> The presumption established by clause (i) may be rebutted with respect to a particular business concern if it is reasonably established that the individual or individuals referred to in that clause with respect to that business concern are not experiencing impediments to establishing or developing such concern as a result of the individual’s identification as a member of a group specified in that clause.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><chapeau> The following institutions are presumed to be disadvantaged business concerns for purposes of subsection (a):</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> Historically black colleges and universities, and colleges and universities having a student body in which 40 percent of the students are Hispanic.</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> Minority institutions (as that term is defined by the Secretary of Education pursuant to the General Education Provision Act (<ref href="/us/usc/t20/s1221">20 U.S.C. 1221</ref> et seq.)).</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iii">“(iii)</num><content> Private and voluntary organizations controlled by individuals who are socially and economically disadvantaged.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><chapeau> A joint venture may be considered to be a disadvantaged business concern under subsection (a), notwithstanding the size of such joint venture, if—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> a party to the joint venture is a disadvantaged business concern; and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> that party owns at least 51 percent of the joint venture.</content>
</clause>

<continuation style="-uslm-lc:I31" class="indent1 firstIndent0">A person who is not an economically disadvantaged individual or a disadvantaged business concern, as a party to a joint venture, may not be a party to more than 2 awarded contracts in a fiscal year solely by reason of this subparagraph.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="E">“(E)</num><content> Nothing in this paragraph shall prohibit any member of a racial or ethnic group that is not listed in subparagraph (B)(i) from establishing that they have been impeded in establishing or developing a business concern as a result of racial or ethnic discrimination.</content>
