L. 101–549, title IV, § 401, Nov. 15, 1990, 104 Stat. 2584.)","seq_in_title":5457,"parent_identifier":"/us/usc/t42/ch85/schIV–A","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85","level":"chapter","num":"CHAPTER 85—","heading":"AIR POLLUTION PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85/schIV–A","level":"subchapter","num":"SUBCHAPTER IV–A—","heading":"ACID DEPOSITION CONTROL","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idac65503d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651\"><num value=\"7651\">§ 7651.</num><heading> Findings and purposes</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac65503e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Findings</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac65503f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/1\"><num value=\"1\">(1)</num><content> the presence of acidic compounds and their precursors in the atmosphere and in deposition from the atmosphere represents a threat to natural resources, ecosystems, materials, visibility, and public health;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac655040-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/2\"><num value=\"2\">(2)</num><content> the principal sources of the acidic compounds and their precursors in the atmosphere are emissions of sulfur and nitrogen oxides from the combustion of fossil fuels;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac657651-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/3\"><num value=\"3\">(3)</num><content> the problem of acid deposition is of national and international significance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac657652-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/4\"><num value=\"4\">(4)</num><content> strategies and technologies for the control of precursors to acid deposition exist now that are economically feasible, and improved methods are expected to become increasingly available over the next decade;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac657653-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/5\"><num value=\"5\">(5)</num><content> current and future generations of Americans will be adversely affected by delaying measures to remedy the problem;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac657654-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/6\"><num value=\"6\">(6)</num><content> reduction of total atmospheric loading of sulfur dioxide and nitrogen oxides will enhance protection of the public health and welfare and the environment; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac657655-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/a/7\"><num value=\"7\">(7)</num><content> control measures to reduce precursor emissions from steam-electric generating units should be initiated without delay.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac657656-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7651/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Purposes</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of this subchapter is to reduce the adverse effects of acid deposition through reductions in annual emissions of sulfur dioxide of ten million tons from 1980 emission levels, and, in combination with other provisions of this chapter, of nitrogen oxides emissions of approximately two million tons from 1980 emission levels, in the forty-eight contiguous States and the District of Columbia. It is the intent of this subchapter to effectuate such reductions by requiring compliance by affected sources with prescribed emission limitations by specified deadlines, which limitations may be met through alternative methods of compliance provided by an emission allocation and transfer system. It is also the purpose of this subchapter to encourage energy conservation, use of renewable and clean alternative technologies, and pollution prevention as a long-range strategy, consistent with the provisions of this subchapter, for reducing air pollution and other adverse impacts of energy production and use.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idac657657-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1955-07-14/ch360\">July 14, 1955, ch. 360</ref>, title IV, § 401, as added <ref href=\"/us/pl/101/549/tIV/s401\">Pub. L. 91–604, § 14</ref>, <date date=\"1970-12-31\">Dec. 31, 1970</date>, <ref href=\"/us/stat/84/1709\">84 Stat. 1709</ref>, is set out as a Short Title note under <ref href=\"/us/usc/t42/s7401\">section 7401 of this title</ref>.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idac65765a-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Acid Deposition Standards</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/101/549/tIV/s404\">Pub. L. 101–549, title IV, § 404</ref>, <date date=\"1990-11-15\">Nov. 15, 1990</date>, <ref href=\"/us/stat/104/2632\">104 Stat. 2632</ref>, directed Administrator of Environmental Protection Agency, not later than 36 months after <date date=\"1990-11-15\">Nov. 15, 1990</date>, to transmit to Congress a report on the feasibility and effectiveness of an acid deposition standard or standards to protect sensitive and critically sensitive aquatic and terrestrial resources.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idac65765b-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Industrial SO<sub>2</sub> Emissions</heading><p><ref href=\"/us/pl/101/549/tIV/s406\">Pub. L. 101–549, title IV, § 406</ref>, <date date=\"1990-11-15\">Nov. 15, 1990</date>, <ref href=\"/us/stat/104/2632\">104 Stat. 2632</ref>, provided that:<quotedContent origin=\"/us/pl/101/549/tIV/s406\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than <date date=\"1995-01-01\">January 1, 1995</date> and every 5 years thereafter, the Administrator of the Environmental Protection Agency shall transmit to the Congress a report containing an inventory of national annual sulfur dioxide emissions from industrial sources (as defined in title IV of the Act [<ref href=\"/us/usc/t42/s7651\">42 U.S.C. 7651</ref> et seq.]), including units subject to section 405(g)(6) of the Clean Air Act [<ref href=\"/us/usc/t42/s7651d/g/6\">42 U.S.C. 7651d(g)(6)</ref>], for all years for which data are available, as well as the likely trend in such emissions over the following twenty-year period. The reports shall also contain estimates of the actual emission reduction in each year resulting from promulgation of the diesel fuel desulfurization regulations under section 214 [<ref href=\"/us/usc/t42/s7548\">42 U.S.C. 7548</ref>].</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> 5.60 <inline class=\"small-caps\">Million Ton Cap</inline>.—</heading><content>Whenever the inventory required by this section indicates that sulfur dioxide emissions from industrial sources, including units subject to section 405(g)(5) of the Clean Air Act [<ref href=\"/us/usc/t42/s7651d/g/5\">42 U.S.C. 7651d(g)(5)</ref>], may reasonably be expected to reach levels greater than 5.60 million tons per year, the Administrator of the Environmental Protection Agency shall take such actions under the Clean Air Act [<ref href=\"/us/usc/t42/s7401\">42 U.S.C. 7401</ref> et seq.] as may be appropriate to ensure that such emissions do not exceed 5.60 million tons per year. Such actions may include the promulgation of new and revised standards of performance for new sources, including units subject to section 405(g)(5) of the Clean Air Act, under section 111(b) of the Clean Air Act [<ref href=\"/us/usc/t42/s7411/b\">42 U.S.C. 7411(b)</ref>], as well as promulgation of standards of performance for existing sources, including units subject to section 405(g)(5) of the Clean Air Act, under authority of this section. For an existing source regulated under this section, ‘standard of performance’ means a standard which the Administrator determines is applicable to that source and which reflects the degree of emission reduction achievable through the application of the best system of continuous emission reduction which (taking into consideration the cost of achieving such emission reduction, and any nonair quality health and environmental impact and energy requirements) the Administrator determines has been adequately demonstrated for that category of sources.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Election</inline>.—</heading><content>Regulations promulgated under section 405(b) of the Clean Air Act [<ref href=\"/us/usc/t42/s7651d/b\">42 U.S.C. 7651d(b)</ref>] shall not prohibit a source from electing to become an affected unit under section 410 of the Clean Air Act [<ref href=\"/us/usc/t42/s7651i\">42 U.S.C. 7651i</ref>].”</content>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For termination, effective <date date=\"2000-05-15\">May 15, 2000</date>, of reporting provisions in <ref href=\"/us/pl/101/549/s406/a\">section 406(a) of Pub. L. 101–549, title IV, § 407</ref>, <date date=\"1990-11-15\">Nov. 15, 1990</date>, <ref href=\"/us/stat/104/2633\">104 Stat. 2633</ref>, provided that: <quotedContent origin=\"/us/pl/101/549/tIV/s407\">“It is the sense of the Congress that the Clean Air Act Amendments of 1990 [<ref href=\"/us/pl/101/549\">Pub. L. 101–549</ref>, see Tables for classification], through the allowance program, allocates the costs of achieving the required reductions in emissions of sulfur dioxide and oxides of nitrogen among sources in the United States. Broad based taxes and emissions fees that would provide for payment of the costs of achieving required emissions reductions by any party or parties other than the sources required to achieve the reductions are undesirable.”</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idac659d6d-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Monitoring of Acid Rain Program in Canada</heading><p><ref href=\"/us/pl/101/549/tIV/s408\">Pub.
