L. 101–549, title V, § 501, Nov. 15, 1990, 104 Stat. 2635.)","seq_in_title":5473,"parent_identifier":"/us/usc/t42/ch85/schV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85","level":"chapter","num":"CHAPTER 85—","heading":"AIR POLLUTION PREVENTION AND CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch85/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"PERMITS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idac6b6a4d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661\"><num value=\"7661\">§ 7661.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this subchapter—</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac6b6a4e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Affected source</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “affected source” shall have the meaning given such term in subchapter IV–A.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac6b6a4f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Major source</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “major source” means any stationary source (or any group of stationary sources located within a contiguous area and under common control) that is either of the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac6b6a50-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/2/A\"><num value=\"A\">(A)</num><content> A major source as defined in <ref href=\"/us/usc/t42/s7412\">section 7412 of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idac6b6a51-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/2/B\"><num value=\"B\">(B)</num><content> A major stationary source as defined in <ref href=\"/us/usc/t42/s7602\">section 7602 of this title</ref> or part D of subchapter I.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac6b6a52-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Schedule of compliance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “schedule of compliance” means a schedule of remedial measures, including an enforceable sequence of actions or operations, leading to compliance with an applicable implementation plan, emission standard, emission limitation, or emission prohibition.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idac6b6a53-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s7661/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Permitting authority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “permitting authority” means the Administrator or the air pollution control agency authorized by the Administrator to carry out a permit program under this subchapter.</p>\n</content>\n</paragraph>\n<sourceCredit id=\"idac6b6a54-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1955-07-14/ch360\">July 14, 1955, ch. 360</ref>, title V, § 501, as added <ref href=\"/us/pl/101/549/tV/s501\">Pub.
