<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac6f622d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i"><num value="7671i">§ 7671i.</num><heading> Nonessential products containing chlorofluorocarbons</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac6f622e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/a"><num value="a" class="bold">(a)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall promulgate regulations to carry out the requirements of this section within 1 year after <date date="1990-11-15">November 15, 1990</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac6f622f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b"><num value="b" class="bold">(b)</num><heading class="bold"> Nonessential products</heading><chapeau style="-uslm-lc:I11" class="indent0">The regulations under this section shall identify nonessential products that release class I substances into the environment (including any release occurring during manufacture, use, storage, or disposal) and prohibit any person from selling or distributing any such product, or offering any such product for sale or distribution, in interstate commerce. At a minimum, such prohibition shall apply to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac6f6230-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b/1"><num value="1">(1)</num><content> chlorofluorocarbon-propelled plastic party streamers and noise horns,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac6f6231-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b/2"><num value="2">(2)</num><content> chlorofluorocarbon-containing cleaning fluids for noncommercial electronic and photographic equipment, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac6f6232-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b/3"><num value="3">(3)</num><chapeau> other consumer products that are determined by the Administrator—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac6f6233-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b/3/A"><num value="A">(A)</num><content> to release class I substances into the environment (including any release occurring during manufacture, use, storage, or disposal), and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac6f8944-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/b/3/B"><num value="B">(B)</num><content> to be nonessential.</content>
</subparagraph>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">In determining whether a product is nonessential, the Administrator shall consider the purpose or intended use of the product, the technological availability of substitutes for such product and for such class I substance, safety, health, and other relevant factors.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac6f8945-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/c"><num value="c" class="bold">(c)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I11" class="indent0">Effective 24 months after <date date="1990-11-15">November 15, 1990</date>, it shall be unlawful for any person to sell or distribute, or offer for sale or distribution, in interstate commerce any nonessential product to which regulations under subsection (a) implementing subsection (b) are applicable.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac6f8946-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d"><num value="d" class="bold">(d)</num><heading class="bold"> Other products</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac6f8947-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/1"><num value="1">(1)</num><chapeau> Effective <date date="1994-01-01">January 1, 1994</date>, it shall be unlawful for any person to sell or distribute, or offer for sale or distribution, in interstate commerce—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f8948-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/1/A"><num value="A">(A)</num><content> any aerosol product or other pressurized dispenser which contains a class II substance; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f8949-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/1/B"><num value="B">(B)</num><content> any plastic foam product which contains, or is manufactured with, a class II substance.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac6f894a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/2"><num value="2">(2)</num><chapeau> The Administrator is authorized to grant exceptions from the prohibition under subparagraph (A) of paragraph (1) where—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f894b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/2/A"><num value="A">(A)</num><content> the use of the aerosol product or pressurized dispenser is determined by the Administrator to be essential as a result of flammability or worker safety concerns, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f894c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/2/B"><num value="B">(B)</num><content> the only available alternative to use of a class II substance is use of a class I substance which legally could be substituted for such class II substance.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac6f894d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/3"><num value="3">(3)</num><chapeau> Subparagraph (B) of paragraph (1) shall not apply to—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f894e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/3/A"><num value="A">(A)</num><content> a foam insulation product, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac6f894f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/d/3/B"><num value="B">(B)</num><content> an integral skin, rigid, or semi-rigid foam utilized to provide for motor vehicle safety in accordance with Federal Motor Vehicle Safety Standards where no adequate substitute substance (other than a class I or class II substance) is practicable for effectively meeting such Standards.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac6f8950-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s7671i/e"><num value="e" class="bold">(e)</num><heading class="bold"> Medical devices</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall apply to any medical device as defined in <ref href="/us/usc/t42/s7671/8">section 7671(8) of this title</ref>.</p>
