<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8eb6f963-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911"><num value="7911">§ 7911.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f964-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/1"><num value="1">(1)</num><content> The term “Secretary” means the Secretary of Energy.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f965-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/2"><num value="2">(2)</num><content> The term “Commission” means the Nuclear Regulatory Commission.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f966-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/3"><num value="3">(3)</num><content> The term “Administrator” means the Administrator of the Environmental Protection Agency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f967-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/4"><num value="4">(4)</num><content> The term “Indian tribe” means any tribe, band, clan, group, pueblo, or community of Indians recognized as eligible for services provided by the Secretary of the Interior to Indians.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f968-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/5"><num value="5">(5)</num><content> The term “person” means any individual, association, partnership, corporation, firm, joint venture, trust, government entity, and any other entity, except that such term does not include any Indian or Indian tribe.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f969-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6"><num value="6">(6)</num><chapeau> The term “processing site” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8eb6f96a-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/A"><num value="A">(A)</num><chapeau> any site, including the mill, containing residual radioactive materials at which all or substantially all of the uranium was produced for sale to any Federal agency prior to <date date="1971-01-01">January 1, 1971</date> under a contract with any Federal agency, except in the case of a site at or near Slick Rock, Colorado, unless—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8eb6f96b-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/A/i"><num value="i">(i)</num><content> such site was owned or controlled as of <date date="1978-01-01">January 1, 1978</date>, or is thereafter owned or controlled, by any Federal agency, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8eb6f96c-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/A/ii"><num value="ii">(ii)</num><content> a license (issued by the Commission or its predecessor agency under the Atomic Energy Act of 1954 [<ref href="/us/usc/t42/s2011">42 U.S.C. 2011</ref> et seq.] or by a State as permitted under section 274 of such Act [<ref href="/us/usc/t42/s2021">42 U.S.C. 2021</ref>]) for the production at such site of any uranium or thorium product derived from ores is in effect on <date date="1978-01-01">January 1, 1978</date>, or is issued or renewed after such date; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8eb6f96d-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/B"><num value="B">(B)</num><chapeau> any other real property or improvement thereon which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8eb6f96e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/B/i"><num value="i">(i)</num><content> is in the vicinity of such site, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8eb6f96f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/6/B/ii"><num value="ii">(ii)</num><content> is determined by the Secretary, in consultation with the Commission, to be contaminated with residual radioactive materials derived from such site.</content>
</clause>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">Any ownership or control of an area by a Federal agency which is acquired pursuant to a cooperative agreement under this subchapter shall not be treated as ownership or control by such agency for purposes of subparagraph (A)(i). A license for the production of any uranium product from residual radioactive materials shall not be treated as a license for production from ores within the meaning of subparagraph (A)(ii) if such production is in accordance with <ref href="/us/usc/t42/s7918/b">section 7918(b) of this title</ref>.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f970-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/7"><num value="7">(7)</num><chapeau> The term “residual radioactive material” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8eb6f971-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/7/A"><num value="A">(A)</num><content> waste (which the Secretary determines to be radioactive) in the form of tailings resulting from the processing of ores for the extraction of uranium and other valuable constituents of the ores; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8eb6f972-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/7/B"><num value="B">(B)</num><content> other waste (which the Secretary determines to be radioactive) at a processing site which relate to such processing, including any residual stock of unprocessed ores or low-grade materials.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f973-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/8"><num value="8">(8)</num><content> The term “tailings” means the remaining portion of a metal-bearing ore after some or all of such metal, such as uranium, has been extracted.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f974-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/9"><num value="9">(9)</num><content> The term “Federal agency” includes any executive agency as defined in <ref href="/us/usc/t5/s105">section 105 of title 5</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb6f975-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s7911/10"><num value="10">(10)</num><content> The term “United States” means the 48 contiguous States and Alaska, Hawaii, Puerto Rico, the District of Columbia, and the territories and possessions of the United States.</content>
