L. 100–616, § 2, Nov. 5, 1988, 102 Stat. 3192.)","seq_in_title":5524,"parent_identifier":"/us/usc/t42/ch88/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch88","level":"chapter","num":"CHAPTER 88—","heading":"URANIUM MILL TAILINGS RADIATION CONTROL","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch88/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"REMEDIAL ACTION PROGRAM","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id0a93b3b5-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916\"><num value=\"7916\">§ 7916.</num><heading> Acquisition of land by Secretary; transfer of public lands by Secretary of the Interior to Secretary; consultations with Governor; consent of Governor; transfer from Federal agency to Secretary</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Where necessary or appropriate in order to consolidate in a safe and environmentally sound manner the location of residual radioactive materials which are removed from processing sites under cooperative agreements under this subchapter, or where otherwise necessary for the permanent disposition and stabilization of such materials in such manner—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0a93b3b6-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/1\"><num value=\"1\">(1)</num><content> the Secretary may acquire land and interests in land for such purposes by purchase, donation, or under any other authority of law or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0a93b3b7-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2\"><num value=\"2\">(2)</num><chapeau> the Secretary of the Interior may transfer permanently to the Secretary to carry out the purposes of this chapter, public lands under the jurisdiction of the Bureau of Land Management in the vicinity of processing sites in the following counties:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3b8-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/A\"><num value=\"A\">(A)</num><content> Apache County in the State of Arizona;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3b9-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/B\"><num value=\"B\">(B)</num><content> Mesa, Gunnison, Moffat, Montrose, Garfield, and San Miguel Counties in the State of Colorado;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3ba-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/C\"><num value=\"C\">(C)</num><content> Boise County in the State of Idaho;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3bb-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/D\"><num value=\"D\">(D)</num><content> Billings and Bowman Counties in the State of North Dakota;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3bc-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/E\"><num value=\"E\">(E)</num><content> Grand and San Juan Counties in the State of Utah;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3bd-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/F\"><num value=\"F\">(F)</num><content> Converse and Fremont Counties in the State of Wyoming; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0a93b3be-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s7916/2/G\"><num value=\"G\">(G)</num><content> Any other county in the vicinity of a processing site, if no site in the county in which a processing site is located is suitable.</content>\n</subparagraph>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Any permanent transfer of lands under the jurisdiction of the Bureau of Land Management by the Secretary of the Interior to the Secretary shall not take place until the Secretary complies with the requirements of the National Environmental Policy Act (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.) with respect to the selection of a site for the permanent disposition and stabilization of residual radioactive materials. <ref href=\"/us/usc/t43/s1714\">Section 1714 of title 43</ref> shall not apply to this transfer of jurisdiction. Prior to acquisition of land under paragraph (1) or (2) of this subsection <ref class=\"footnoteRef\" idref=\"fn003720\">1</ref><note type=\"footnote\" id=\"fn003720\"><num>1</num> So in original. Probably should be “section”.</note> in any State, the Secretary shall consult with the Governor of such State. No lands may be acquired under such paragraph (1) or (2) in any State in which there is no (1) processing site designated under this subchapter or (2) active uranium mill operation, unless the Secretary has obtained the consent of the Governor of such State.
