<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8eb96a2e-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002"><num value="8002">§ 8002.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purpose of this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a2f-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/1"><num value="1">(1)</num><content> the term “congregate housing” means (A) low-rent housing which, as of <date date="1979-01-01">January 1, 1979</date>, was built or under construction, with which there is connected a central dining facility where wholesome and economical meals can be served to such occupants; or (B) low-rent housing constructed after, but not under construction prior to, <date date="1979-01-01">January 1, 1979</date>, connected with which there is a central dining facility to provide wholesome and economical meals for such occupants;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a30-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/2"><num value="2">(2)</num><content> the term “congregate services programs” means programs to be undertaken by a public housing agency or a nonprofit corporation to provide assistance, including personal assistance and nutritional meals, to eligible project residents who, with such assistance, can remain independent and avoid unnecessary institutionalization;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a31-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/3"><num value="3">(3)</num><content> the term “elderly” means sixty-two years of age or over;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a32-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/4"><num value="4">(4)</num><content> the term “eligible project resident” means elderly handicapped individuals, nonelderly handicapped individuals, or temporarily disabled individuals, who are residents of congregate housing projects administered by a public housing agency or by a nonprofit corporation;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a33-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/5"><num value="5">(5)</num><content> the term “handicapped” means having an impairment which (A) is expected to be of long-continued and indefinite duration, and (B) substantially impedes an individual’s ability to live independently unless the individual receives supportive congregate services; such impairment may include a functional disability or frailty which is a normal consequence of the human aging process;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb96a34-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/6"><num value="6">(6)</num><content> the term “personal assistance” means service provided under this chapter which may include, but is not limited to, aid given to eligible project residents in grooming, dressing, and other activities which maintain personal appearance and hygiene;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb99145-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/7"><num value="7">(7)</num><content> the term “professional assessment committee” means a group of at least three persons appointed by a local public housing agency or a nonprofit corporation and shall include qualified medical professionals and other persons professionally competent to appraise the functional abilities of elderly or permanently disabled adult persons, or both, in relation to the performance of the normal tasks of daily living;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb99146-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/8"><num value="8">(8)</num><content> the term “temporarily disabled” means an impairment which (A) is expected to be of no more than six months’ duration, and (B) substantially impedes an individual’s ability to live independently unless the individual receives supportive congregate services; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8eb99147-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s8002/9"><num value="9">(9)</num><content> the term “nonprofit corporation” means any corporation responsible for a housing project assisted under <ref href="/us/usc/t12/s1701q">section 1701q of title 12</ref>.</content>
