Such persons shall be paid wages which shall not be lower than whichever is the highest of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac78d80a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/a/1\"><num value=\"1\">(1)</num><content> the minimum wage which would be applicable to the employee under the Fair Labor Standards Act of 1938 [<ref href=\"/us/usc/t29/s201\">29 U.S.C. 201</ref> et seq.], if section 6(a)(1) of such Act [<ref href=\"/us/usc/t29/s206/a/1\">29 U.S.C. 206(a)(1)</ref>] applied to the resident and if he or she were not exempt under section 13 [<ref href=\"/us/usc/t29/s213\">29 U.S.C. 213</ref>] thereof;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac78d80b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/a/2\"><num value=\"2\">(2)</num><content> the State or local minimum wage for the most nearly comparable covered employment; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idac78d80c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/a/3\"><num value=\"3\">(3)</num><content> the prevailing rates of pay for persons employed in similar public occupations by the same employer.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac78d80d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Tax treatment of services received</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No service provided to a public housing resident or to a resident of a housing project assisted under <ref href=\"/us/usc/t12/s1701q\">section 1701q of title 12</ref> under this chapter, except for wages paid under subsection (a) of this section, may be treated as income for the purpose of any other program or provision of State or Federal law.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac78d80e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Individuals receiving aid considered residents of own household</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Individuals receiving services assisted under this chapter shall be deemed to be residents of their own households, and not to be residents of a public institution, for the purpose of any other program or provision of State or Federal law.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idac78d80f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s8009/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may issue regulations to carry out the provisions of this chapter.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idac78d810-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/95/557/tIV/s410\">Pub.
