<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id66990f6a-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253"><num value="8253">§ 8253.</num><heading> Energy management requirements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990f6b-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/a"><num value="a" class="bold">(a)</num><heading class="bold"> Energy performance requirement for Federal buildings</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id66990f6c-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/a/1"><num value="1">(1)</num><content> Subject to paragraph (2), each agency shall apply energy conservation measures to, and shall improve the design for the construction of, the Federal buildings of the agency (including each industrial or laboratory facility) so that the energy consumption per gross square foot of the Federal buildings of the agency in fiscal years 2006 through 2015 is reduced, as compared with the energy consumption per gross square foot of the Federal buildings of the agency in fiscal year 2003, by the percentage specified in the following table:<table xmlns="http://www.w3.org/1999/xhtml" width="50%" style="border-collapse:collapse; border=0;  -uslm-lc: c2,L0,tp0,p7,7/8,s11,13,tp0,p7,7/8,s11,13; " id="id66990f6d-c209-11e6-a3d7-e056b4ef3bc7">

<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f6e-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/a/2"><num value="2">(2)</num><content> An agency may exclude from the requirements of paragraph (1) any building, and the associated energy consumption and gross square footage, in which energy intensive activities are carried out. Each agency shall identify and list in each report made under <ref href="/us/usc/t42/s8258/a">section 8258(a) of this title</ref> the buildings designated by it for such exclusion.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f6f-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/a/3"><num value="3">(3)</num><content> Not later than <date date="2014-12-31">December 31, 2014</date>, the Secretary shall review the results of the implementation of the energy performance requirement established under paragraph (1) and submit to Congress recommendations concerning energy performance requirements for fiscal years 2016 through 2025.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990f70-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/b"><num value="b" class="bold">(b)</num><heading class="bold"> Energy management requirement for Federal agencies</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id66990f71-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/b/1"><num value="1">(1)</num><content> Not later than <date date="2005-01-01">January 1, 2005</date>, each agency shall, to the maximum extent practicable, install in Federal buildings owned by the United States all energy and water conservation measures with payback periods of less than 10 years, as determined by using the methods and procedures developed pursuant to <ref href="/us/usc/t42/s8254">section 8254 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f72-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/b/2"><num value="2">(2)</num><content> The Secretary may waive the requirements of this subsection for any agency for such periods as the Secretary may determine if the Secretary finds that the agency is taking all practicable steps to meet the requirements and that the requirements of this subsection will pose an unacceptable burden upon the agency. If the Secretary waives the requirements of this subsection, the Secretary shall, as part of the report required under <ref href="/us/usc/t42/s8258/b">section 8258(b) of this title</ref>, notify the Congress in writing with an explanation and a justification of the reasons for such waiver.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f73-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/b/3"><num value="3">(3)</num><content> This subsection shall not apply to an agency’s facilities that generate or transmit electric energy or to the uranium enrichment facilities operated by the Department of Energy.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f74-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/b/4"><num value="4">(4)</num><content> An agency may participate in the Environmental Protection Agency’s “Green Lights” program for purposes of receiving technical assistance in complying with the requirements of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990f75-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c"><num value="c" class="bold">(c)</num><heading class="bold"> Exclusions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id66990f76-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id66990f77-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/A"><num value="A">(A)</num><chapeau> An agency may exclude, from the energy performance requirement for a fiscal year established under subsection (a) of this section and the energy management requirement established under subsection (b) of this section, any Federal building or collection of Federal buildings, if the head of the agency finds that—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id66990f78-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/A/i"><num value="i">(i)</num><content> compliance with those requirements would be impracticable;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id66990f79-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/A/ii"><num value="ii">(ii)</num><content> the agency has completed and submitted all federally required energy management reports;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id66990f7a-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/A/iii"><num value="iii">(iii)</num><content> the agency has achieved compliance with the energy efficiency requirements of this chapter, the Energy Policy Act of 1992, Executive orders, and other Federal law; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id66990f7b-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/A/iv"><num value="iv">(iv)</num><content> the agency has implemented all practicable, life cycle cost-effective projects with respect to the Federal building or collection of Federal buildings to be excluded.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id66990f7c-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/B"><num value="B">(B)</num><chapeau> A finding of impracticability under subparagraph (A)(i) shall be based on—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id66990f7d-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/B/i"><num value="i">(i)</num><content> the energy intensiveness of activities carried out in the Federal building or collection of Federal buildings; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id66990f7e-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/1/B/ii"><num value="ii">(ii)</num><content> the fact that the Federal building or collection of Federal buildings is used in the performance of a national security function.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f7f-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/2"><num value="2">(2)</num><content> Each agency shall identify and list, in each report made under <ref href="/us/usc/t42/s8258/a">section 8258(a) of this title</ref>, the Federal buildings designated by it for such exclusion. The Secretary shall review such findings for consistency with the standards for exclusion set forth in paragraph (1), and may within 90 days after receipt of the findings, reverse the exclusion. In the case of any such reversal, the agency shall comply with the requirements of subsections (a) and (b)(1) of this section for the building concerned.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id66990f80-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/c/3"><num value="3">(3)</num><content> Not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall issue guidelines that establish criteria for exclusions under paragraph (1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990f81-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d"><num value="d" class="bold">(d)</num><heading class="bold"> Implementation steps</heading><chapeau>The Secretary shall consult with the Secretary of Defense and the Administrator of General Services in developing guidelines for the implementation of this part. To meet the requirements of this section, each agency shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id66990f82-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/1"><num value="1">(1)</num><chapeau> prepare and submit to the Secretary, not later than <date date="1993-12-31">December 31, 1993</date>, a plan describing how the agency intends to meet such requirements, including how it will—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f83-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/1/A"><num value="A">(A)</num><content> designate personnel primarily responsible for achieving such requirements;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f84-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/1/B"><num value="B">(B)</num><content> identify high priority projects through calculation of payback periods;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f85-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/1/C"><num value="C">(C)</num><content> take maximum advantage of contracts authorized under subchapter VII of this chapter, of financial incentives and other services provided by utilities for efficiency investment, and of other forms of financing to reduce the direct costs to the Government; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f86-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/1/D"><num value="D">(D)</num><content> otherwise implement this part;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id66990f87-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/2"><num value="2">(2)</num><content> perform energy surveys of its Federal buildings to the extent necessary and update such surveys as needed, incorporating any relevant information obtained from the survey conducted pursuant to <ref href="/us/usc/t42/s8258b">section 8258b of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id66990f88-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/3"><num value="3">(3)</num><content> using such surveys, determine the cost and payback period of energy and water conservation measures likely to achieve the requirements of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id66990f89-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/4"><num value="4">(4)</num><content> install energy and water conservation measures that will achieve the requirements of this section through the methods and procedures established pursuant to <ref href="/us/usc/t42/s8254">section 8254 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id66990f8a-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/d/5"><num value="5">(5)</num><content> ensure that the operation and maintenance procedures applied under this section are continued.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990f8b-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e"><num value="e" class="bold">(e)</num><heading class="bold"> Metering of energy use</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990f8c-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Deadline</heading><content><p style="-uslm-lc:I12" class="indent1">By <date date="2012-10-01">October 1, 2012</date>, in accordance with guidelines established by the Secretary under paragraph (2), all Federal buildings shall, for the purposes of efficient use of energy and reduction in the cost of electricity used in such buildings, be metered. Each agency shall use, to the maximum extent practicable, advanced meters or advanced metering devices that provide data at least daily and that measure at least hourly consumption of electricity in the Federal buildings of the agency. Not later than <date date="2016-10-01">October 1, 2016</date>, each agency shall provide for equivalent metering of natural gas and steam, in accordance with guidelines established by the Secretary under paragraph (2). Such data shall be incorporated into existing Federal energy tracking systems and made available to Federal facility managers.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990f8d-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Guidelines</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990f8e-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary, in consultation with the Department of Defense, the General Services Administration, representatives from the metering industry, utility industry, energy services industry, energy efficiency industry, energy efficiency advocacy organizations, national laboratories, universities, and Federal facility managers, shall establish guidelines for agencies to carry out paragraph (1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990f8f-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Requirements for guidelines</heading><chapeau>The guidelines shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990f90-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/i"><num value="i">(i)</num><chapeau> take into consideration—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990f91-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/i/I"><num value="I">(I)</num><content> the cost of metering and the reduced cost of operation and maintenance expected to result from metering;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990f92-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/i/II"><num value="II">(II)</num><content> the extent to which metering is expected to result in increased potential for energy management, increased potential for energy savings and energy efficiency improvement, and cost and energy savings due to utility contract aggregation; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990f93-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/i/III"><num value="III">(III)</num><content> the measurement and verification protocols of the Department of Energy;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990f94-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/ii"><num value="ii">(ii)</num><content> include recommendations concerning the amount of funds and the number of trained personnel necessary to gather and use the metering information to track and reduce energy use;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990f95-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/iii"><num value="iii">(iii)</num><content> establish priorities for types and locations of buildings to be metered based on cost-effectiveness and a schedule of one or more dates, not later than 1 year after the date of issuance of the guidelines, on which the requirements specified in paragraph (1) shall take effect; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990f96-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/2/B/iv"><num value="iv">(iv)</num><content> establish exclusions from the requirements specified in paragraph (1) based on the de minimis quantity of energy use of a Federal building, industrial process, or structure.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990f97-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Plan</heading><chapeau>Not later than 180 days after the date on which guidelines are established under paragraph (2), in a report submitted by the agency under <ref href="/us/usc/t42/s8258/a">section 8258(a) of this title</ref>, each agency shall submit to the Secretary a plan describing the manner in which the agency will implement the requirements of paragraph (1), including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f98-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/3/A"><num value="A">(A)</num><content> how the agency will designate personnel primarily responsible for achieving the requirements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990f99-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/3/B"><num value="B">(B)</num><content> a demonstration by the agency, complete with documentation, of any finding that advanced meters or advanced metering devices (as those terms are used in paragraph (1)), are not practicable.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990f9a-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Best practices report</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990f9b-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 180 days after December 18,2012, the Secretary of Energy, in consultation with the Secretary of Defense and the Administrator of General Services, shall develop, and issue a report on, best practices for the use of advanced metering of energy use in Federal facilities, buildings, and equipment by Federal agencies.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990f9c-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Components</heading><chapeau>The report shall include, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990f9d-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/i"><num value="i">(i)</num><content> summaries and analysis of the reports by agencies under paragraph (3);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990f9e-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/ii"><num value="ii">(ii)</num><chapeau> recommendations on standard requirements or guidelines for automated energy management systems, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990f9f-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/ii/I"><num value="I">(I)</num><content> potential common communications standards to allow data sharing and reporting;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fa0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/ii/II"><num value="II">(II)</num><content> means of facilitating continuous commissioning of buildings and evidence-based maintenance of buildings and building systems; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fa1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/ii/III"><num value="III">(III)</num><content> standards for sufficient levels of security and protection against cyber threats to ensure systems cannot be controlled by unauthorized persons; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990fa2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/iii"><num value="iii">(iii)</num><chapeau> an analysis of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fa3-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/iii/I"><num value="I">(I)</num><content> the types of advanced metering and monitoring systems being piloted, tested, or installed in Federal buildings; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fa4-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/e/4/B/iii/II"><num value="II">(II)</num><content> existing techniques used within the private sector or other non-Federal government buildings.</content>
</subclause>

</subparagraph>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66990fa5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f"><num value="f" class="bold">(f)</num><heading class="bold"> Use of energy and water efficiency measures in Federal buildings</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fa6-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><chapeau>In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fa7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Commissioning</heading><chapeau>The term “commissioning”, with respect to a facility, means a systematic process—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990fa8-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/A/i"><num value="i">(i)</num><chapeau> of ensuring, using appropriate verification and documentation, during the period beginning on the initial day of the design phase of the facility and ending not earlier than 1 year after the date of completion of construction of the facility, that all facility systems perform interactively in accordance with—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fa9-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/A/i/I"><num value="I">(I)</num><content> the design documentation and intent of the facility; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990faa-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/A/i/II"><num value="II">(II)</num><content> the operational needs of the owner of the facility, including preparation of operation personnel; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990fab-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/A/ii"><num value="ii">(ii)</num><content> the primary goal of which is to ensure fully functional systems that can be properly operated and maintained during the useful life of the facility.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fac-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Energy manager</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fad-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>The term “energy manager”, with respect to a facility, means the individual who is responsible for—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fae-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/i/I"><num value="I">(I)</num><content> ensuring compliance with this subsection by the facility; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990faf-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/i/II"><num value="II">(II)</num><content> reducing energy use at the facility.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fb0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Inclusions</heading><chapeau>The term “energy manager” may include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fb1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/ii/I"><num value="I">(I)</num><content> a contractor of a facility;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fb2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/ii/II"><num value="II">(II)</num><content> a part-time employee of a facility; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fb3-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/B/ii/III"><num value="III">(III)</num><content> an individual who is responsible for multiple facilities.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fb4-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Facility</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fb5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The term “facility” means any building, installation, structure, or other property (including any applicable fixtures) owned or operated by, or constructed or manufactured and leased to, the Federal Government.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fb6-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Inclusions</heading><chapeau>The term “facility” includes—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fb7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C/ii/I"><num value="I">(I)</num><content> a group of facilities at a single location or multiple locations managed as an integrated operation; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fb8-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C/ii/II"><num value="II">(II)</num><content> contractor-operated facilities owned by the Federal Government.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fb9-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Exclusions</heading><content><p style="-uslm-lc:I14" class="indent3">The term “facility” does not include any land or site for which the cost of utilities is not paid by the Federal Government.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fba-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Life cycle cost-effective</heading><content><p style="-uslm-lc:I13" class="indent2">The term “life cycle cost-effective”, with respect to a measure, means a measure, the estimated savings of which exceed the estimated costs over the lifespan of the measure, as determined in accordance with <ref href="/us/usc/t42/s8254">section 8254 of this title</ref>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fbb-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> Payback period</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fbc-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>Subject to clause (ii), the term “payback period”, with respect to a measure, means a value equal to the quotient obtained by dividing—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fbd-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/i/I"><num value="I">(I)</num><content> the estimated initial implementation cost of the measure (other than financing costs); by</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fbe-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/i/II"><num value="II">(II)</num><chapeau> the annual cost savings resulting from the measure, including—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id66990fbf-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/i/II/aa"><num value="aa">(aa)</num><content> net savings in estimated energy and water costs; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id66990fc0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/i/II/bb"><num value="bb">(bb)</num><content> operations, maintenance, repair, replacement, and other direct costs.</content>

</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fc1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/E/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Modifications and exceptions</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary, in guidelines issued pursuant to paragraph (6), may make such modifications and provide such exceptions to the calculation of the payback period of a measure as the Secretary determines to be appropriate to achieve the purposes of this chapter.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fc2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/F"><num value="F" class="bold">(F)</num><heading class="bold"> Recommissioning</heading><chapeau>The term “recommissioning” means a process—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990fc3-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/F/i"><num value="i">(i)</num><content> of commissioning a facility or system beyond the project development and warranty phases of the facility or system; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990fc4-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/F/ii"><num value="ii">(ii)</num><content> the primary goal of which is to ensure optimum performance of a facility, in accordance with design or current operating needs, over the useful life of the facility, while meeting building occupancy requirements.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fc5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/1/G"><num value="G" class="bold">(G)</num><heading class="bold"> Retrocommissioning</heading><content><p style="-uslm-lc:I13" class="indent2">The term “retrocommissioning” means a process of commissioning a facility or system that was not commissioned at the time of construction of the facility or system.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fc6-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Facility energy managers</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fc7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each Federal agency shall designate an energy manager responsible for implementing this subsection and reducing energy use at each facility that meets criteria under subparagraph (B).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fc8-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Covered facilities</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall develop criteria, after consultation with affected agencies, energy efficiency advocates, and energy and utility service providers, that cover, at a minimum, Federal facilities, including central utility plants and distribution systems and other energy intensive operations, that constitute at least 75 percent of facility energy use at each agency.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fc9-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Energy and water evaluations</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fca-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Evaluations</heading><content><p style="-uslm-lc:I13" class="indent2">Effective beginning on the date that is 180 days after <date date="2007-12-19">December 19, 2007</date>, and annually thereafter, energy managers shall complete, for each calendar year, a comprehensive energy and water evaluation for approximately 25 percent of the facilities of each agency that meet the criteria under paragraph (2)(B) in a manner that ensures that an evaluation of each such facility is completed at least once every 4 years.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fcb-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Recommissioning and retrocommissioning</heading><content><p style="-uslm-lc:I13" class="indent2">As part of the evaluation under subparagraph (A), the energy manager shall identify and assess recommissioning measures (or, if the facility has never been commissioned, retrocommissioning measures) for each such facility.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fcc-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Implementation of identified energy and water efficiency measures</heading><chapeau>Not later than 2 years after the completion of each evaluation under paragraph (3), each energy manager may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fcd-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/4/A"><num value="A">(A)</num><content> implement any energy- or water-saving measure that the Federal agency identified in the evaluation conducted under paragraph (3) that is life cycle cost-effective; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fce-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/4/B"><num value="B">(B)</num><content> bundle individual measures of varying paybacks together into combined projects.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fcf-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Follow-up on implemented measures</heading><chapeau>For each measure implemented under paragraph (4), each energy manager shall ensure that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fd0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/5/A"><num value="A">(A)</num><content> equipment, including building and equipment controls, is fully commissioned at acceptance to be operating at design specifications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fd1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/5/B"><num value="B">(B)</num><content> a plan for appropriate operations, maintenance, and repair of the equipment is in place at acceptance and is followed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fd2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/5/C"><num value="C">(C)</num><content> equipment and system performance is measured during its entire life to ensure proper operations, maintenance, and repair; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66990fd3-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/5/D"><num value="D">(D)</num><content> energy and water savings are measured and verified.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fd4-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/6"><num value="6" class="bold">(6)</num><heading class="bold"> Guidelines</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fd5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall issue guidelines and necessary criteria that each Federal agency shall follow for implementation of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990fd6-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/6/A/i"><num value="i">(i)</num><content> paragraphs (2) and (3) not later than 180 days after <date date="2007-12-19">December 19, 2007</date>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990fd7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/6/A/ii"><num value="ii">(ii)</num><content> paragraphs (4) and (5) not later than 1 year after <date date="2007-12-19">December 19, 2007</date>.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fd8-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Relationship to funding source</heading><content><p style="-uslm-lc:I13" class="indent2">The guidelines issued by the Secretary under subparagraph (A) shall be appropriate and uniform for measures funded with each type of funding made available under paragraph (10), but may distinguish between different types of measures <ref class="footnoteRef" idref="fn003781">1</ref><note type="footnote" id="fn003781"><num>1</num> So in original. A comma probably should appear.</note> project size, and other criteria the Secretary determines are relevant.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fd9-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7"><num value="7" class="bold">(7)</num><heading class="bold"> Web-based certification</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fda-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>For each facility that meets the criteria established by the Secretary under paragraph (2)(B), the energy manager shall use the web-based tracking system under subparagraph (B)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990fdb-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/A/i"><num value="i">(i)</num><chapeau> to certify compliance with the requirements for—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fdc-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/A/i/I"><num value="I">(I)</num><content> energy and water evaluations under paragraph (3);</content>

<subclause style="-uslm-lc:I16" class="indent4" id="id66990fdd-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/A/i/II"><num value="II">(II)</num><content> implementation of identified energy and water measures under paragraph (4); and</content>
</subclause>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fe0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Deployment</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fe1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>Not later than 1 year after <date date="2007-12-19">December 19, 2007</date>, the Secretary shall develop and deploy a web-based tracking system required under this paragraph in a manner that tracks, at a minimum—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fe2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/i/I"><num value="I">(I)</num><content> the covered facilities;</content>

<subclause style="-uslm-lc:I16" class="indent4" id="id66990fe5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/i/IV"><num value="IV">(IV)</num><content> the measured savings and persistence of savings for implemented measures; and</content>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990fe7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Ease of compliance</heading><chapeau>The Secretary shall ensure that energy manager compliance with the requirements in this paragraph, to the maximum extent practicable—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990fe8-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/ii/I"><num value="I">(I)</num><content> can be accomplished with the use of streamlined procedures and templates that minimize the time demands on Federal employees; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990fe9-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/B/ii/II"><num value="II">(II)</num><content> is coordinated with other applicable energy reporting requirements.</content>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fea-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/C"><num value="C" class="bold">(C)</num><heading class="bold"> Availability</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990feb-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/7/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii), the Secretary shall make the web-based tracking system required under this paragraph available to Congress, other Federal agencies, and the public through the Internet.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990fed-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8"><num value="8" class="bold">(8)</num><heading class="bold"> Benchmarking of Federal facilities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fee-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The energy manager shall enter energy use data for each metered building that is (or is a part of) a facility that meets the criteria established by the Secretary under paragraph (2)(B) into a building energy use benchmarking system, such as the Energy Star Portfolio Manager.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fef-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8/B"><num value="B" class="bold">(B)</num><heading class="bold"> System and guidance</heading><chapeau>Not later than 1 year after <date date="2007-12-19">December 19, 2007</date>, the Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990ff0-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8/B/i"><num value="i">(i)</num><content> select or develop the building energy use benchmarking system required under this paragraph for each type of building; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990ff1-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8/B/ii"><num value="ii">(ii)</num><content> issue guidance for use of the system.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990ff2-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/8/C"><num value="C" class="bold">(C)</num><heading class="bold"> Public disclosure</heading><content><p style="-uslm-lc:I13" class="indent2">Each energy manager shall post the information entered into, or generated by, a benchmarking system under this subsection, on the web-based tracking system under paragraph (7)(B). The energy manager shall update such information each year, and shall include in such reporting previous years’ information to allow changes in building performance to be tracked over time.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66990ff3-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/9"><num value="9" class="bold">(9)</num><heading class="bold"> Federal agency scorecards</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990ff4-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/9/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The Director of the Office of Management and Budget shall issue semiannual scorecards for energy management activities carried out by each Federal agency that includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id66990ff5-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/9/A/i"><num value="i">(i)</num><content> summaries of the status of implementing the various requirements of the agency and its energy managers under this subsection; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id66990ff6-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/9/A/ii"><num value="ii">(ii)</num><content> any other means of measuring performance that the Director considers appropriate.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990ff7-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/9/B"><num value="B" class="bold">(B)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall make the scorecards required under this paragraph available to Congress, other Federal agencies, and the public through the Internet.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990ffa-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/B"><num value="B" class="bold">(B)</num><heading class="bold"> Funding options</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990ffb-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>To carry out this subsection, a Federal agency may use any combination of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id66990ffc-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/B/i/I"><num value="I">(I)</num><content> appropriated funds made available under subparagraph (A); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id66990ffd-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/B/i/II"><num value="II">(II)</num><content> private financing otherwise authorized under Federal law, including financing available through energy savings performance contracts or utility energy service contracts.</content>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id66990ffe-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Combined funding for same measure</heading><content><p style="-uslm-lc:I14" class="indent3">A Federal agency may use any combination of appropriated funds and private financing described in clause (i) to carry out the same measure under this subsection.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id66990fff-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/10/C"><num value="C" class="bold">(C)</num><heading class="bold"> Implementation</heading><content><p style="-uslm-lc:I13" class="indent2">Each Federal agency may implement the requirements under this subsection itself or may contract out performance of some or all of the requirements.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66991000-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/f/11"><num value="11" class="bold">(11)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I12" class="indent1">This subsection shall not be construed to require or to obviate any contractor savings guarantees.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id66991001-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/g"><num value="g" class="bold">(g)</num><heading class="bold"> Large capital energy investments</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66991002-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each Federal agency shall ensure that any large capital energy investment in an existing building that is not a major renovation but involves replacement of installed equipment (such as heating and cooling systems), or involves renovation, rehabilitation, expansion, or remodeling of existing space, employs the most energy efficient designs, systems, equipment, and controls that are life-cycle cost effective.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id66991003-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Process for review of investment decisions</heading><chapeau>Not later than 180 days after <date date="2007-12-19">December 19, 2007</date>, each Federal agency shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id66991004-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/g/2/A"><num value="A">(A)</num><content> develop a process for reviewing each decision made on a large capital energy investment described in paragraph (1) to ensure that the requirements of this subsection are met; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id66991005-c209-11e6-a3d7-e056b4ef3bc7" identifier="/us/usc/t42/s8253/g/2/B"><num value="B">(B)</num><content> report to the Director of the Office of Management and Budget on the process established.</content>
</subparagraph>
