<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac84224e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Energy Star program</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Energy Star program” means the program established by <ref href="/us/usc/t42/s6294a">section 6294a of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac84224f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> FEMP designated product</heading><content><p style="-uslm-lc:I12" class="indent1">The term “FEMP designated product” means a product that is designated under the Federal Energy Management Program of the Department of Energy as being among the highest 25 percent of equivalent products for energy efficiency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac842250-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Product</heading><content><p style="-uslm-lc:I12" class="indent1">The term “product” does not include any energy consuming product or system designed or procured for combat or combat-related missions.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac842251-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Procurement of energy efficient products</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac842252-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Requirement</heading><chapeau style="-uslm-lc:I12" class="indent1">To meet the requirements of an agency for an energy consuming product in a product category covered by the Energy Star program or the Federal Energy Management Program for designated products, the head of the agency shall, except as provided in paragraph (2), procure—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac842253-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/1/A"><num value="A">(A)</num><content> an Energy Star product; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac842254-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/1/B"><num value="B">(B)</num><content> a FEMP designated product.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac842255-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exceptions</heading><chapeau style="-uslm-lc:I12" class="indent1">The head of an agency is not required to procure an Energy Star product or FEMP designated product under paragraph (1) if the head of the agency finds in writing that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac842256-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/2/A"><num value="A">(A)</num><content> an Energy Star product or FEMP designated product is not cost-effective over the life of the product taking energy cost savings into account; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac842257-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/2/B"><num value="B">(B)</num><content> no Energy Star product or FEMP designated product is reasonably available that meets the functional requirements of the agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac842258-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Procurement planning</heading><content><p style="-uslm-lc:I12" class="indent1">The head of an agency shall incorporate into the specifications for all procurements involving energy consuming products and systems, including guide specifications, project specifications, and construction, renovation, and services contracts that include provision of energy consuming products and systems, and into the factors for the evaluation of offers received for the procurement, criteria for energy efficiency that are consistent with the criteria used for rating Energy Star products and for rating FEMP designated products.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac842259-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Listing of energy efficient products in Federal catalogs</heading><content><p style="-uslm-lc:I11" class="indent0">Energy Star products and FEMP designated products shall be clearly identified and prominently displayed in any inventory or listing of products by the General Services Administration or the Defense Logistics Agency. The General Services Administration or the Defense Logistics Agency shall list in their catalogues, represent as available, and supply only Energy Star products or FEMP designated products for all product categories covered by the Energy Star program or the Federal Energy Management Program, except in cases in which the head of the agency ordering a product specifies in writing that no Energy Star product or FEMP designated product is available to meet the buyer’s functional requirements, or that no Energy Star product or FEMP designated product is cost-effective for the intended application over the life of the product, taking energy cost savings into account.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac84225a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Specific products</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac84496b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d/1"><num value="1">(1)</num><content> In the case of electric motors of 1 to 500 horsepower, agencies shall select only premium efficient motors that meet a standard designated by the Secretary. The Secretary shall designate such a standard not later than 120 days after <date date="2005-08-08">August 8, 2005</date>, after considering the recommendations of associated electric motor manufacturers and energy efficiency groups.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac84496c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d/2"><num value="2">(2)</num><chapeau> All Federal agencies are encouraged to take actions to maximize the efficiency of air conditioning and refrigeration equipment, including appropriate cleaning and maintenance, including the use of any system treatment or additive that will reduce the electricity consumed by air conditioning and refrigeration equipment. Any such treatment or additive must be—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac84496d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d/2/A"><num value="A">(A)</num><content> determined by the Secretary to be effective in increasing the efficiency of air conditioning and refrigeration equipment without having an adverse impact on air conditioning performance (including cooling capacity) or equipment useful life;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac84496e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d/2/B"><num value="B">(B)</num><content> determined by the Administrator of the Environmental Protection Agency to be environmentally safe; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac84496f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/d/2/C"><num value="C">(C)</num><content> shown to increase seasonal energy efficiency ratio (SEER) or energy efficiency ratio (EER) when tested by the National Institute of Standards and Technology according to Department of Energy test procedures without causing any adverse impact on the system, system components, the refrigerant or lubricant, or other materials in the system.<p style="-uslm-lc:I17" class="indent1 firstIndent0">Results of testing described in subparagraph (C) shall be published in the Federal Register for public review and comment. For purposes of this section, a hardware device or primary refrigerant shall not be considered an additive.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac844970-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federally-procured appliances with standby power</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac844971-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition of eligible product</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection, the term “eligible product” means a commercially available, off-the-shelf product that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac844972-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idac844973-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/1/A/i"><num value="i">(i)</num><content> uses external standby power devices; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idac844974-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/1/A/ii"><num value="ii">(ii)</num><content> contains an internal standby power function; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac844975-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/1/B"><num value="B">(B)</num><content> is included on the list compiled under paragraph (4).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac844976-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Federal purchasing requirement</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (3), if an agency purchases an eligible product, the agency shall purchase—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac844977-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/2/A"><num value="A">(A)</num><content> an eligible product that uses not more than 1 watt in the standby power consuming mode of the eligible product; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac844978-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/2/B"><num value="B">(B)</num><content> if an eligible product described in subparagraph (A) is not available, the eligible product with the lowest available standby power wattage in the standby power consuming mode of the eligible product.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac844979-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation</heading><chapeau style="-uslm-lc:I12" class="indent1">The requirements of paragraph (2) shall apply to a purchase by an agency only if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac84497a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/3/A"><num value="A">(A)</num><chapeau> the lower-wattage eligible product is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idac84497b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/3/A/i"><num value="i">(i)</num><content> lifecycle cost-effective; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idac84497c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/3/A/ii"><num value="ii">(ii)</num><content> practicable; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac84497d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/3/B"><num value="B">(B)</num><content> the utility and performance of the eligible product is not compromised by the lower wattage requirement.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idac84497e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Eligible products</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary, in consultation with the Secretary of Defense, the Administrator of the Environmental Protection Agency, and the Administrator of General Services, shall compile a publicly accessible list of cost-effective eligible products that shall be subject to the purchasing requirements of paragraph (2).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac84497f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8259b/f"><num value="f" class="bold">(f)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 180 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall issue guidelines to carry out this section.</p>
