L. 100–42, § 1(c)(2), May 21, 1987, 101 Stat. 310.)","seq_in_title":5638,"parent_identifier":"/us/usc/t42/ch92/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch92","level":"chapter","num":"CHAPTER 92—","heading":"POWERPLANT AND INDUSTRIAL FUEL USE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch92/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd7e1a63b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302\"><num value=\"8302\">§ 8302.</num><heading> Definitions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd7e1a63c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Generally</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Unless otherwise expressly provided, for the purposes of this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a63d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/1\"><num value=\"1\">(1)</num><content> The term “Secretary” means the Secretary of Energy.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a63e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/2\"><num value=\"2\">(2)</num><content> The term “person” means any (A) individual, corporation, company, partnership, association, firm, institution, society, trust, joint venture, or joint stock company, (B) any State, the District of Columbia, Puerto Rico, and any territory or possession of the United States, or (C) any agency or instrumentality (including any municipality) thereof.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a63f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a640-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/A\"><num value=\"A\">(A)</num><chapeau> Except as provided in subparagraph (B), the term “natural gas” means any fuel consisting in whole or in part of—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a641-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/A/i\"><num value=\"i\">(i)</num><content> natural gas;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a642-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> liquid petroleum gas;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a643-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/A/iii\"><num value=\"iii\">(iii)</num><content> synthetic gas derived from petroleum or natural gas liquids; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a644-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/A/iv\"><num value=\"iv\">(iv)</num><content> any mixture of natural gas and synthetic gas.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a645-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/B\"><num value=\"B\">(B)</num><chapeau> The term “natural gas” does not include—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a646-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/B/i\"><num value=\"i\">(i)</num><content> natural gas which is commercially unmarketable (either by reason of quality or quantity), as determined under rules prescribed by the Secretary;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a647-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/B/ii\"><num value=\"ii\">(ii)</num><content> natural gas produced by the user from a well the maximum efficient production rate of which is less than 250 million Btu’s per day;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a648-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/B/iii\"><num value=\"iii\">(iii)</num><content> natural gas to the extent the exclusion of such gas is provided for in subsection (b); or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a649-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/3/B/iv\"><num value=\"iv\">(iv)</num><content> synthetic gas, derived from coal or other alternate fuel, the heat content of which is less than 600 Btu’s per cubic foot at 14.73 pounds per square inch (absolute) and 60 degrees Fahrenheit.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a64a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/4\"><num value=\"4\">(4)</num><chapeau> The term “petroleum” means crude oil and products derived from crude oil, other than—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a64b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/4/A\"><num value=\"A\">(A)</num><content> synthetic gas derived from crude oil;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a64c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/4/B\"><num value=\"B\">(B)</num><content> liquid petroleum gas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a64d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/4/C\"><num value=\"C\">(C)</num><content> liquid, solid, or gaseous waste byproducts of refinery operations which are commercially unmarketable, either by reason of quality or quantity, as determined under rules prescribed by the Secretary; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a64e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/4/D\"><num value=\"D\">(D)</num><content> petroleum coke or waste gases from industrial operations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a64f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/5\"><num value=\"5\">(5)</num><content> The term “coal” means anthracite and bituminous coal, lignite, and any fuel derivative thereof.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a650-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/6\"><num value=\"6\">(6)</num><chapeau> The term “alternate fuel” means electricity or any fuel, other than natural gas or petroleum, and includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a651-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/6/A\"><num value=\"A\">(A)</num><content> petroleum coke, shale oil, uranium, biomass, and municipal, industrial, or agricultural wastes, wood, and renewable and geothermal energy sources;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a652-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/6/B\"><num value=\"B\">(B)</num><content> liquid, solid, or gaseous waste byproducts of refinery or industrial operations which are commercially unmarketable, either by reason of quality or quantity, as determined under rules prescribed by the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a653-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/6/C\"><num value=\"C\">(C)</num><content> waste gases from industrial operations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a654-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7\"><num value=\"7\">(7)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a655-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/A\"><num value=\"A\">(A)</num><chapeau> The terms “electric powerplant” and “powerplant” mean any stationary electric generating unit, consisting of a boiler, a gas turbine, or a combined cycle unit, which produces electric power for purposes of sale or exchange and—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a656-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/A/i\"><num value=\"i\">(i)</num><content> has the design capability of consuming any fuel (or mixture thereof) at a fuel heat input rate of 100 million Btu’s per hour or greater; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a657-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/A/ii\"><num value=\"ii\">(ii)</num><content> is in a combination of two or more electric generating units which are located at the same site and which in the aggregate have a design capability of consuming any fuel (or mixture thereof) at a fuel heat input rate of 250 million Btu’s per hour or greater.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a658-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/B\"><num value=\"B\">(B)</num><chapeau> For purposes of subparagraph (A), the term “electric generating unit” does not include—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a659-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/B/i\"><num value=\"i\">(i)</num><content> any electric generating unit subject to the licensing jurisdiction of the Nuclear Regulatory Commission; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a65a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/B/ii\"><num value=\"ii\">(ii)</num><content> any cogeneration facility, less than half of the annual electric power generation of which is sold or exchanged for resale, as determined by the Secretary.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a65b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/7/C\"><num value=\"C\">(C)</num><content> For purposes of clause (ii) of subparagraph (A), there shall be excluded any unit which has a design capability to consume any fuel (including any mixture thereof) that does not equal or exceed 100 million Btu’s per hour and the exclusion of which for purposes of such clause is determined by the Secretary, by rule, to be appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a65c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/8\"><num value=\"8\">(8)</num><chapeau> The term “new electric powerplant” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a65d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/8/A\"><num value=\"A\">(A)</num><content> any electric powerplant for which construction or acquisition began on a date on or after <date date=\"1978-11-09\">November 9, 1978</date>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a65e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/8/B\"><num value=\"B\">(B)</num><chapeau> any electric powerplant for which construction or acquisition began on a date after <date date=\"1977-04-20\">April 20, 1977</date>, and before <date date=\"1978-11-09\">November 9, 1978</date>, unless the Secretary finds the construction or acquisition of such powerplant could not be canceled, rescheduled, or modified to comply with the applicable requirements of this chapter without—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a65f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/8/B/i\"><num value=\"i\">(i)</num><content> adversely affecting electric system reliability (as determined by the Secretary after consultation with the Federal Energy Regulatory Commission and the appropriate State authority), or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a660-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/8/B/ii\"><num value=\"ii\">(ii)</num><content> imposing substantial financial penalty (as determined under rules prescribed by the Secretary).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a661-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/9\"><num value=\"9\">(9)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a662-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/9/A\"><num value=\"A\">(A)</num><content> The term “existing electric powerplant” means any electric powerplant other than a new electric powerplant.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a663-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/9/B\"><num value=\"B\">(B)</num><content> Any powerplant treated under this chapter as an existing electric powerplant shall not be treated thereafter as a new electric powerplant merely by reason of a transfer of ownership.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a664-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10\"><num value=\"10\">(10)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a665-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/A\"><num value=\"A\">(A)</num><chapeau> The terms “major fuel-burning installation” and “installation” means a stationary unit consisting of a boiler, gas turbine unit, combined cycle unit, or internal combustion engine which—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a666-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/A/i\"><num value=\"i\">(i)</num><content> has a design capability of consuming any fuel (or mixture thereof) at a fuel heat input rate of 100 million Btu’s per hour or greater; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a667-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/A/ii\"><num value=\"ii\">(ii)</num><content> is in a combination of two or more such units which are located at the same site and which in the aggregate have a design capability of consuming any fuel (or mixture thereof) at a fuel heat input rate of 250 million Btu’s per hour or greater.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a668-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/B\"><num value=\"B\">(B)</num><chapeau> The terms “major fuel-burning installation” and “installation” do not include—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a669-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/B/i\"><num value=\"i\">(i)</num><content> any electric powerplant; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a66a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/B/ii\"><num value=\"ii\">(ii)</num><content> any pump or compressor used solely in connection with the production, gathering, transmission, storage, or distribution of gases or liquids, but only if there is certification to the Secretary of such use (in accordance with rules prescribed by the Secretary).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a66b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/10/C\"><num value=\"C\">(C)</num><content> For purposes of clause (ii) of subparagraph (A), there shall be excluded any unit which has a design capability to consume any fuel (including any mixture thereof) that does not equal or exceed 100 million Btu’s per hour and the exclusion of which for purposes of such clause is determined by the Secretary, by rule to be appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a66c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/11\"><num value=\"11\">(11)</num><chapeau> The term “new major fuel-burning installation” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a66d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/11/A\"><num value=\"A\">(A)</num><content> any major fuel-burning installation on which construction or acquisition began on a date on or after <date date=\"1978-11-09\">November 9, 1978</date>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a66e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/11/B\"><num value=\"B\">(B)</num><chapeau> any major fuel-burning installation on which construction or acquisition began on a date after <date date=\"1977-04-20\">April 20, 1977</date>, and before <date date=\"1978-11-09\">November 9, 1978</date>, unless the Secretary finds the construction or acquisition of such installation could not be canceled, rescheduled, or modified to comply with applicable requirements of this chapter without—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a66f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/11/B/i\"><num value=\"i\">(i)</num><content> incurring significant operational detriment of the unit (as determined by the Secretary); or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a670-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/11/B/ii\"><num value=\"ii\">(ii)</num><content> imposing substantial financial penalty (as determined under rules prescribed by the Secretary).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a671-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12\"><num value=\"12\">(12)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a672-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12/A\"><num value=\"A\">(A)</num><content> The term “existing major fuel-burning installation” means any installation which is not a new major fuel-burning installation.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a673-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12/B\"><num value=\"B\">(B)</num><chapeau> Such term does not include a major fuel-burning installation for the extraction of mineral resources located—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a674-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12/B/i\"><num value=\"i\">(i)</num><content> on or above the Continental Shelf of the United States, or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a675-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12/B/ii\"><num value=\"ii\">(ii)</num><content> on wetlands areas adjacent to the Continental Shelf of the United States,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">where coal storage is not practicable or would produce adverse effects on environmental quality.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a676-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/12/C\"><num value=\"C\">(C)</num><content> Any installation treated as an existing major fuel-burning installation shall not be treated thereafter as a new major fuel-burning installation merely by reason of a transfer of ownership.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a677-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13\"><num value=\"13\">(13)</num><chapeau> The term “construction or acquisition began” means, when used with reference to a certain date, that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a678-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13/A\"><num value=\"A\">(A)</num><content> construction in accordance with final drawings or equivalent design documents (as defined by the Secretary, by rule) began on or after that date; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a679-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a67a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13/B/i\"><num value=\"i\">(i)</num><chapeau> construction or acquisition had been contracted for on or after that date, or (ii) if the construction or acquisition had been contracted for before such date, such construction or acquisition could be canceled, rescheduled, or modified to comply with the applicable requirements of this chapter—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a67b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13/B/i/I\"><num value=\"I\">(I)</num><content> without imposing substantial financial penalty, as determined under rules prescribed by the Secretary; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd7e1a67c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/13/B/i/II\"><num value=\"II\">(II)</num><content> in the case of a powerplant, without adversely affecting electric system reliability (as determined by the Secretary after consultation with the Federal Energy Regulatory Commission and the appropriate State authority).</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a67d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/14\"><num value=\"14\">(14)</num><content> The term “construction” means substantial onsite construction or reconstruction, as defined by rule by the Secretary.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a67e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/15\"><num value=\"15\">(15)</num><chapeau> The term “primary energy source” means the fuel or fuels used by any existing or new electric powerplant, except it does not include, as determined under rules prescribed by the Secretary—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a67f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/15/A\"><num value=\"A\">(A)</num><content> the minimum amounts of fuel required for unit ignition, startup, testing, flame stabilization, and control uses, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a680-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/15/B\"><num value=\"B\">(B)</num><content> the minimum amounts of fuel required to alleviate or prevent (i) unanticipated equipment outages and (ii) emergencies directly affecting the public health, safety, or welfare which would result from electric power outages.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a681-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16\"><num value=\"16\">(16)</num><chapeau> The term “site limitation” means, when used with respect to any powerplant, any specific physical limitation associated with a particular site which relates to the use of coal or other alternate fuels as a primary energy source for such powerplant, such as—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a682-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16/A\"><num value=\"A\">(A)</num><content> inaccessibility to coal or other alternate fuels;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a683-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16/B\"><num value=\"B\">(B)</num><content> lack of transportation facilities for coal or other alternate fuels;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a684-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16/C\"><num value=\"C\">(C)</num><content> lack of adequate land or facilities for the handling, use, and storage of coal or other alternate fuels;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a685-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16/D\"><num value=\"D\">(D)</num><content> lack of adequate land or facilities for the control or disposal of wastes from such powerplant, including lack of pollution control equipment or devices necessary to assure compliance with applicable environmental requirements; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a686-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/16/E\"><num value=\"E\">(E)</num><content> lack of an adequate and reliable supply of water, including water for use in compliance with applicable environmental requirements.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a687-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/17\"><num value=\"17\">(17)</num><chapeau> The term “applicable environmental requirements” includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a688-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/17/A\"><num value=\"A\">(A)</num><content> any standard, limitation, or other requirement established by or pursuant to Federal or State law (including any final order of any Federal or State court) applicable to emissions of environmental pollutants (including air and water pollutants) or disposal of solid waste residues resulting from the use of coal or other alternate fuels or natural gas or petroleum as a primary energy source or from the operation of pollution control equipment in connection with such use, taking into account any variance of law granted or issued in accordance with Federal law or in accordance with State law to the extent consistent with Federal law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a689-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/17/B\"><num value=\"B\">(B)</num><content> any other standard, limitation, or other requirement established by, or pursuant to, the Clean Air Act [<ref href=\"/us/usc/t42/s7401\">42 U.S.C. 7401</ref> et seq.], the Federal Water Pollution Control Act [<ref href=\"/us/usc/t33/s1251\">33 U.S.C. 1251</ref> et seq.], the Solid Waste Disposal Act [<ref href=\"/us/usc/t42/s6901\">42 U.S.C. 6901</ref> et seq.], or the National Environmental Policy Act of 1969 [<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.].</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/18\"><num value=\"18\">(18)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/18/A\"><num value=\"A\">(A)</num><content> The term “peakload powerplant” means a powerplant the electrical generation of which in kilowatt hours does not exceed, for any 12-calendar-month period, such powerplant’s design capacity multiplied by 1,500 hours.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/18/B\"><num value=\"B\">(B)</num><content> The term “intermediate load powerplant” means a powerplant (other than a peakload powerplant), the electrical generation of which in kilowatt hours does not exceed, for any 12-calendar-month period, such powerplant’s design capacity multiplied by 3,500 hours.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/18/C\"><num value=\"C\">(C)</num><content> The term “base load powerplant” means a powerplant the electrical generation of which in kilowatt hours exceeds, for any 12-calendar-month period, such powerplant’s design capacity multiplied by 3,500 hours.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/18/D\"><num value=\"D\">(D)</num><content> Not later than 90 days after <date date=\"1978-11-09\">November 9, 1978</date>, the Federal Energy Regulatory Commission shall prescribe rules under which a powerplant’s design capacity may be determined for purposes of this paragraph.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a68f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/19\"><num value=\"19\">(19)</num><chapeau> the <ref class=\"footnoteRef\" idref=\"fn003755\">1</ref><note type=\"footnote\" id=\"fn003755\"><num>1</num> So in original. Probably should be capitalized.</note> term “cogeneration facility” means an electric powerplant which produces—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a690-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/19/A\"><num value=\"A\">(A)</num><content> electric power; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a691-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/19/B\"><num value=\"B\">(B)</num><content> any other form of useful energy (such as steam, gas, or heat) which is, or will be, used for industrial, commercial, or space heating purposes.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a692-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/20\"><num value=\"20\">(20)</num><content> The term “cost”, unless the context indicates otherwise, means total costs (both operating and capital) incurred over the estimated remaining useful life of an electric powerplant, discounted to present value, as determined by the Secretary (in the case of powerplants, in consultation with the State regulatory authorities). In the case of an electric powerplant, such costs shall take into account any change required in the use of existing electric powerplants in the relevant dispatching system and other economic factors which are included in planning for the production, transmission, and distribution of electric power within such system.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a693-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/21\"><num value=\"21\">(21)</num><content> The term “State regulatory authority” means any State agency which has ratemaking authority with respect to the sale of electricity by any State regulated electric utility.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a694-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/22\"><num value=\"22\">(22)</num><content> The term “air pollution control agency” has the same meaning as given such term by section 302(b) of the Clean Air Act [<ref href=\"/us/usc/t42/s7602/b\">42 U.S.C. 7602(b)</ref>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a695-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/23\"><num value=\"23\">(23)</num><content> The term “electric utility” means any person, including any affiliate, or Federal agency which sells electric power.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a696-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/24\"><num value=\"24\">(24)</num><content> The term “affiliate”, when used in relation to a person, means another person which controls, is controlled by, or is under common control with, such person.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a697-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/25\"><num value=\"25\">(25)</num><chapeau> The term “Federal agency” means each authority of the Government of the United States, whether or not it is within or subject to review by another agency, but does not include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a698-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/25/A\"><num value=\"A\">(A)</num><content> the Congress;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a699-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/25/B\"><num value=\"B\">(B)</num><content> the courts of the United States;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a69a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/25/C\"><num value=\"C\">(C)</num><content> the governments of the territories or possessions of the United States; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd7e1a69b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/25/D\"><num value=\"D\">(D)</num><content> the government of the District of Columbia.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a69c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/26\"><num value=\"26\">(26)</num><content> The term “Btu” means British thermal unit.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a69d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/27\"><num value=\"27\">(27)</num><content> the term “Mcf” means, when used in relation to natural gas, 1,000 cubic feet of natural gas.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a69e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/28\"><num value=\"28\">(28)</num><content> The term “mixture”, when used in relation to fuels used in a unit, means a mixture of such fuels or a combination of such fuels used simultaneously or alternately in such unit.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a69f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/a/29\"><num value=\"29\">(29)</num><content> The term “fluidized bed combustion” means combustion of fuel in connection with a bed of inert material, such as limestone or dolomite, which is held in a fluid-like state by the means of air or other gases being passed through such materials.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd7e1a6a0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Special rules relating to definitions of natural gas and alternate fuel</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idd7e1a6a1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/1\"><num value=\"1\">(1)</num><chapeau> Subject to paragraph (2), natural gas which is to be used by a powerplant shall for purposes of this chapter (other than this subsection), be excluded from the definition of “natural gas” under subsection (a)(3)(B)(iii) and shall be included within the definition of “alternate fuel” under subsection (a)(6) if the person proposing to use such natural gas certifies to the Secretary (together with such supporting documents as the Secretary may require) that—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/1/A\"><num value=\"A\">(A)</num><content> such person owns, or is entitled to receive, at the point of manufacture, synthetic gas derived from coal or another alternate fuel;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/1/B\"><num value=\"B\">(B)</num><content> the Btu content of such synthetic gas is equal to, or greater than, the Btu content of the natural gas to be covered by this subsection by reason of such certification, plus the approximate Btu content of any natural gas consumed or lost in transportation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/1/C\"><num value=\"C\">(C)</num><content> such person delivers, or arranges for the delivery of, such synthetic gas to a pipeline or pipelines which by transport or displacement are capable of delivering such synthetic gas, mixed with natural gas, to such person; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/1/D\"><num value=\"D\">(D)</num><content> all necessary permits, licenses, or approvals from appropriate Federal, State, and local agencies (including Indian tribes) have been obtained for construction and operation of the facilities for the manufacture of the synthetic gas involved.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idd7e1a6a6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/2\"><num value=\"2\">(2)</num><chapeau> The application of paragraph (1) with respect to the use of natural gas by any powerplant shall be conditioned on the person using such natural gas submitting to the Secretary a report not later than one year after certification is made under paragraph (1), and annually thereafter, containing the following information:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/2/A\"><num value=\"A\">(A)</num><content> the source, amount, quality, and point of delivery to the pipeline of the synthetic gas to which paragraph (1) applied during the annual period ending with the calendar month preceding the date of such report; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd7e1a6a8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/2/B\"><num value=\"B\">(B)</num><content> the amount, quality, and point of delivery by the pipeline to such person of the natural gas covered by paragraph (1) which is used by the person during such annual period.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idd7e1a6a9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s8302/b/3\"><num value=\"3\">(3)</num><content> Repealed. <ref href=\"/us/pl/100/42/s1/c/2/H\">Pub.
