<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac8a3c7a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351"><num value="8351">§ 8351.</num><heading> Temporary exemptions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a3c7b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/a"><num value="a" class="bold">(a)</num><heading class="bold"> Temporary exemption due to lack of alternate fuel supply, site limitations, or environmental requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary shall, by order, grant such an exemption for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that for the period of the proposed exemption, despite diligent good faith efforts—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac8a3c7c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/a/1"><num value="1">(1)</num><content> it is likely that an adequate and reliable supply of coal or other alternate fuel of the quality necessary to conform with design and operational requirements for use as a primary energy source, will not be available to such powerplant at a cost (taking into account associated facilities for the transportation and use of such fuel) which, based upon the best practicable estimates, does not substantially exceed the costs, as determined by rule by the Secretary, of using imported petroleum as a primary energy source;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8a3c7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/a/2"><num value="2">(2)</num><content> one or more site limitations exist which would not permit the operation of such a powerplant using coal or any other alternate fuel as a primary energy source; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8a3c7e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/a/3"><num value="3">(3)</num><content> the prohibitions of <ref href="/us/usc/t42/s8341">section 8341 of this title</ref> could not be satisfied without violating applicable environmental requirements.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a3c7f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/b"><num value="b" class="bold">(b)</num><heading class="bold"> Temporary exemption based upon future use of synthetic fuels</heading><chapeau style="-uslm-lc:I11" class="indent0">After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary, by order, shall grant an exemption under this subsection for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac8a3c80-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/b/1"><num value="1">(1)</num><content> the petitioner will comply with the prohibitions of part A by the end of the proposed exemption by the use of a synthetic fuel derived from coal or another alternate fuel; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8a3c81-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/b/2"><num value="2">(2)</num><content> the petitioner is not able to comply with such prohibitions by the use of such synthetic fuel until the end of the proposed exemption.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The effectiveness of an exemption under this subsection is conditioned on the petitioner filing and maintaining a compliance plan meeting the requirements of <ref href="/us/usc/t42/s8354/b">section 8354(b) of this title</ref>.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a3c82-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/c"><num value="c" class="bold">(c)</num><heading class="bold"> Temporary exemption based upon use of innovative technologies</heading><content><p style="-uslm-lc:I11" class="indent0">After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary, by order, shall grant an exemption under this subsection for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that such powerplant will comply with such prohibitions at the expiration of such exemption by the adoption of a technology for the use of coal or another alternate fuel which at the time of the granting of the exemption is determined by the Secretary to be an innovative technology. The effectiveness of an exemption under this subsection is conditioned on the petitioner filing and maintaining a compliance plan meeting the requirements of <ref href="/us/usc/t42/s8354/b">section 8354(b) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a3c83-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/d"><num value="d" class="bold">(d)</num><heading class="bold"> Temporary exemption for units to be retired</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac8a6394-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/d/1"><num value="1">(1)</num><content> After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary shall, by order, grant an exemption under this subsection for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that such powerplant is to permanently cease operation at or before the expiration of the exemption period. An exemption under this subsection is conditioned on the petitioner filing and maintaining a compliance plan meeting the requirements of section 8354(b) (other than paragraph (1)(B)) of this title.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8a6395-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/d/2"><num value="2">(2)</num><content> Notwithstanding any other provision of this chapter, an exemption under this part may not be granted for any powerplant once an exemption under this subsection has been granted for such powerplant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a6396-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/e"><num value="e" class="bold">(e)</num><heading class="bold"> Temporary public interest exemption</heading><content><p style="-uslm-lc:I11" class="indent0">After consideration of a petition (and comments thereon) for an exemption for a powerplant from one or more of the prohibitions of part A for a powerplant, the Secretary may, by order, grant an exemption under this subsection for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that for the period of the proposed exemption the issuance of such exemption is in the public interest and is consistent with the purposes of this chapter.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a6397-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/f"><num value="f" class="bold">(f)</num><heading class="bold"> Temporary exemption for peakload powerplants</heading><content><p style="-uslm-lc:I11" class="indent0">After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary shall, by order, grant an exemption under this subsection for the use of natural gas or petroleum, if the petitioner certifies that such powerplant is to be operated solely as a peakload powerplant.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a6398-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/g"><num value="g" class="bold">(g)</num><heading class="bold"> Temporary exemption for powerplants where necessary to maintain reliability of service</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac8a6399-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/g/1"><num value="1">(1)</num><content> After consideration of a petition (and comments thereon) for an exemption from one or more of the prohibitions of part A for a powerplant, the Secretary shall, by order, grant an exemption under this subsection for the use of natural gas or petroleum, if he finds that the petitioner has demonstrated that such exemption is necessary to prevent impairment of reliability of service.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8a639a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/g/2"><num value="2">(2)</num><content> Notwithstanding any other provision of this chapter, an exemption under this part (other than a permanent exemption under <ref href="/us/usc/t42/s8352/f">section 8352(f) of this title</ref> for the use of petroleum) may not be granted for any powerplant for which an exemption under this subsection has been granted.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8a639b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h"><num value="h" class="bold">(h)</num><heading class="bold"> Duration of temporary exemptions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac8a639c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/1"><num value="1">(1)</num><content> Except as provided in paragraphs (2) and (3), exemptions under this section for any powerplant may not exceed, taking into account any extension or renewal, 5 years.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8a639d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idac8a639e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/2/A"><num value="A">(A)</num><content> An exemption under subsection (a)(1) may be granted for a period of more than 5 years, but may not exceed, taking into account any extension or renewal, 10 years.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idac8a639f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/2/B"><num value="B">(B)</num><content> Subject to paragraph (3), an exemption under subsections (b), (c), and (g) may be extended beyond the 5-year limit under paragraph (1), but such exemption, so extended, may not exceed 10 years.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8a63a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/3"><num value="3">(3)</num><content> An exemption under subsections (d), (f), and (g) for the use of natural gas by a powerplant may not extend beyond <date date="1994-12-31">December 31, 1994</date>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8a63a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8351/h/4"><num value="4">(4)</num><content> In computing the 5-year and 10-year limitations of paragraphs (1) and (2) in the case of any exemption under this section, the period before the prohibition on the use of natural gas and petroleum would first apply (if the exemption had not been granted) shall be disregarded.</content>
