<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0aadf1fa-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374"><num value="8374">§ 8374.</num><heading> Emergency authorities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf1fb-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a"><num value="a" class="bold">(a)</num><heading class="bold"> Coal allocation authority</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf1fc-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1"><num value="1">(1)</num><chapeau> If the President—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id0aadf1fd-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1/A"><num value="A">(A)</num><content> declares a severe energy supply interruption, as defined in <ref href="/us/usc/t42/s6202/8">section 6202(8) of this title</ref>, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id0aadf1fe-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1/B"><num value="B">(B)</num><chapeau> finds, and publishes such finding, that a national or regional fuel supply shortage exists or may exist which the President determines—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id0aadf1ff-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1/B/i"><num value="i">(i)</num><content> is, or is likely to be, of significant scope and duration, and of an emergency nature;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id0aadf200-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1/B/ii"><num value="ii">(ii)</num><content> causes, or may cause, major adverse impact on public health, safety, or welfare or on the economy; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id0aadf201-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/1/B/iii"><num value="iii">(iii)</num><content> results, or is likely to result, from an interruption in the supply of coal or from sabotage, or an act of God;</content>
</clause>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the President may, by order, allocate coal (and require the transportation thereof) for the use of any electric powerplant or major fuel-burning installation, in accordance with such terms and conditions as he may prescribe, to insure reliability of electric service or prevent unemployment, or protect public health, safety, or welfare.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf202-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/a/2"><num value="2">(2)</num><content> For purposes of this subsection, the term “coal” means anthracite and bituminous coal and lignite (but does not mean any fuel derivative thereof).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf203-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/b"><num value="b" class="bold">(b)</num><heading class="bold"> Emergency prohibition on use of natural gas or petroleum</heading><content><p style="-uslm-lc:I11" class="indent0">If the President declares a severe energy supply interruption, as defined in <ref href="/us/usc/t42/s6202/8">section 6202(8) of this title</ref>, the President may, by order, prohibit any electric powerplant or major fuel-burning installation from using natural gas or petroleum, or both, as a primary energy source for the duration of such interruption. Notwithstanding any other provision of this section, any suspension of emission limitations or other requirements of applicable implementation plans, as defined in section 7410(d) <ref class="footnoteRef" idref="fn003759">1</ref><note type="footnote" id="fn003759"><num>1</num> See References in Text note below.</note> of this title, required by such prohibition shall be issued only in accordance with <ref href="/us/usc/t42/s7410/f">section 7410(f) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf204-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/c"><num value="c" class="bold">(c)</num><heading class="bold"> Emergency stays</heading><content><p style="-uslm-lc:I11" class="indent0">The President may, by order, stay the application of any provision of this chapter, or any rule or order thereunder, applicable to any new or existing electric powerplant, if the President finds, and publishes such finding, that an emergency exists, due to national, regional, or systemwide shortages of coal or other alternate fuels, or disruption of transportation facilities, which emergency is likely to affect reliability of service of any such electric powerplant.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf205-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/d"><num value="d" class="bold">(d)</num><heading class="bold"> Duration of emergency orders</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf206-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/d/1"><num value="1">(1)</num><content> Except as provided in paragraph (3), any order issued by the President under this section shall not be effective for longer than the duration of the interruption or emergency, or 90 days, whichever is less.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf207-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/d/2"><num value="2">(2)</num><content> Any such order may be extended by a subsequent order which the President shall transmit to the Congress in accordance with <ref href="/us/usc/t42/s6421">section 6421 of this title</ref>. Such order shall be subject to congressional review pursuant to such section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf208-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/d/3"><num value="3">(3)</num><content> Notwithstanding paragraph (1), the effectiveness of any order issued under this section shall not terminate under this subsection during the 15-calendar-day period during which any such subsequent order described in paragraph (2) is subject to congressional review under <ref href="/us/usc/t42/s6421">section 6421 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0aadf209-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/d/4"><num value="4">(4)</num><content> For purposes of this subsection, the provisions of this subsection supersede the provisions of subchapter II of chapter 34 of title 50.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf20a-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/e"><num value="e" class="bold">(e)</num><heading class="bold"> Delegation of authority prohibited</heading><content><p style="-uslm-lc:I11" class="indent0">The authority of the President to issue any order under this section may not be delegated. This subsection shall not be construed to prevent the President from directing any Federal agency to issue rules or regulations or take such other action, consistent with this section, in the implementation of such order.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0aadf20b-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8374/f"><num value="f" class="bold">(f)</num><heading class="bold"> Publication and reports to Congress of orders</heading><content><p style="-uslm-lc:I11" class="indent0">Any order issued under this section shall be published in the Federal Register. To the greatest extent practicable, the President shall, before issuing any order under this section, but in no event later than 5 days after issuing such order, report to the Congress of his intention to issue such order and state his reasons therefor.</p>
