<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac8c5f3e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402"><num value="8402">§ 8402.</num><heading> Loans to assist powerplant acquisitions of air pollution control equipment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c5f3f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authority to make loans</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may, in accordance with the provisions of this section and such rules and regulations as he shall prescribe, make a loan (and may make a commitment to loan) to any person who owns or operates any existing electric powerplant converting to coal or other alternate fuel as its primary energy source after the effective date of this chapter for the purpose of financing the purchase and installation of one or more certified air pollution control devices for such electric powerplant.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c5f40-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limitations and conditions</heading><chapeau style="-uslm-lc:I11" class="indent0">A loan made under this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac8c5f41-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/1"><num value="1">(1)</num><content> not exceed two-thirds of the cost of purchasing and installing the certified air pollution control devices;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c5f42-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/2"><num value="2">(2)</num><content> have a maturity date not extending beyond 10 years after the date such loan is made;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c5f43-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/3"><num value="3">(3)</num><content> bear interest at a rate not less than (A) a rate determined by the Secretary of the Treasury, taking into consideration the average market yield of outstanding Treasury obligations of comparable maturity, plus (B) 1 percent;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c5f44-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/4"><num value="4">(4)</num><content> be made on the condition of payment to the Secretary of a loan fee in an amount equal to (A) such insurance fee as the Secretary determines is necessary to avoid a Federal revenue loss under this section, plus (B) 1 percent of the loan amount; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c5f45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/5"><num value="5">(5)</num><chapeau> be made only if the Secretary finds that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c5f46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/5/A"><num value="A">(A)</num><content> the financial assistance applied for is not otherwise available from other Federal agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c5f47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/5/B"><num value="B">(B)</num><content> the applicant is unable to obtain sufficient funds on reasonable terms and conditions from any other source;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8658-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/5/C"><num value="C">(C)</num><content> there is continued reasonable assurance of full repayment of the principal, interest, and fees; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8659-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/b/5/D"><num value="D">(D)</num><content> competition among private entities for the provision of air pollution control devices for electric powerplants using coal as their primary energy source to be assisted under this section will be in no way limited or precluded.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c865a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/c"><num value="c" class="bold">(c)</num><heading class="bold"> Allocation and priorities</heading><chapeau style="-uslm-lc:I11" class="indent0">In making loans or commitments to loan pursuant to this section, the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac8c865b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/c/1"><num value="1">(1)</num><content> allocate a minimum of 25 percent of available financial assistance to existing small municipal and rural powerplants; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c865c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/c/2"><num value="2">(2)</num><content> give priority consideration to requests for financial assistance by existing electric powerplants subject to any prohibition under subchapter III (or under <ref href="/us/usc/t15/s792">section 792 of title 15</ref>).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c865d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac8c865e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1"><num value="1">(1)</num><chapeau> The term “certified pollution control device” means a new identifiable device which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c865f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1/A"><num value="A">(A)</num><content> is used, in connection with a powerplant, to abate or control atmospheric pollution by removing, altering, disposing, storing, or preventing the emission of pollutants;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8660-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1/B"><num value="B">(B)</num><content> the appropriate State air pollution control agency has certified to the Administrator of the Environmental Protection Agency that such device is needed to meet, and is in conformity with, State requirements for abatement or control of atmospheric pollution or contamination;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8661-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1/C"><num value="C">(C)</num><content> the Administrator of the Environmental Protection Agency has certified to the Secretary as not duplicating or displacing existing air pollution control devices with a remaining useful economic life in excess of 2 years and as otherwise being in furtherance of the requirements and purposes of the Clean Air Act [<ref href="/us/usc/t42/s7401">42 U.S.C. 7401</ref> et seq.];</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8662-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1/D"><num value="D">(D)</num><content> does not constitute or include a building, or a structural component of a building, other than a building used exclusively for the purposes set forth in subparagraph (A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8663-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/1/E"><num value="E">(E)</num><content> the construction of which began after the effective date of this chapter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac8c8664-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/2"><num value="2">(2)</num><chapeau> The term “small municipal or rural cooperative electric powerplant” means an electric generating unit, which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8665-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/2/A"><num value="A">(A)</num><content> by design is not capable of consuming fuel at a fuel heat input rate in excess of a rate determined appropriate by the Secretary by rule; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac8c8666-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/d/2/B"><num value="B">(B)</num><content> is owned or operated by a municipality or a rural electric cooperative.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c8667-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/e"><num value="e" class="bold">(e)</num><heading class="bold"> Records</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac8c8668-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/e/1"><num value="1">(1)</num><content> The Secretary shall require all persons receiving financial assistance under this section to keep such records as the Secretary shall prescribe, including records which fully disclose the amount and disposition by such recipient of the proceeds of such assistance, the total cost of the project or undertaking in connection with which such assistance was given or used, the amount of that portion of the cost of the project or undertaking supplied by other sources, and such other records as will facilitate an effective audit.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8c8669-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/e/2"><num value="2">(2)</num><chapeau> The Secretary and the Comptroller General of the United States, or any of their duly authorized representatives, shall, until the later of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idac8c866a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/e/2/A"><num value="A">(A)</num><content> the expiration of 3 years after completion of the project or undertaking referred to in subsection (a), or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idac8c866b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/e/2/B"><num value="B">(B)</num><content> full repayment of interest and principal on a loan made under this section, occurs,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">have access for the purposes of audit, evaluation, examination to any books, documents, papers, and records of such receipts which in the opinion of the Secretary or the Comptroller General may be related or pertinent to such loan.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8c866c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/f"><num value="f" class="bold">(f)</num><heading class="bold"> Default</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idac8cad7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/f/1"><num value="1">(1)</num><content> If there is a default in any payment by the obligor of interest or principal due under a loan entered into by the Secretary under this section and such default has continued for 90 days, the Secretary has the right to demand payment of such unpaid amount, unless the Secretary finds that such default has been rem­edied, or a satisfactory plan to remedy such default by the obligor has been accepted by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8cad7e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/f/2"><num value="2">(2)</num><content> In demanding payment of unpaid interest or principal by the obligor, the Secretary has all rights specified in the loan-related agreements with respect to any security which he held with respect to the loan, including the authority to complete, maintain, operate, lease, sell, or otherwise dispose of any property acquired pursuant to such loan or related agreements.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idac8cad7f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/f/3"><num value="3">(3)</num><content> If there is a default under any loan, the Secretary shall notify the Attorney General who shall take such action against the obligator or other parties liable thereunder as is, in his discretion, necessary to protect the interests of the United States. The holder of such loan shall make available to the United States all records and evidence necessary to prosecute any such suit.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8cad80-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/g"><num value="g" class="bold">(g)</num><heading class="bold"> Deposit of receipts</heading><content><p style="-uslm-lc:I11" class="indent0">Amounts received by the Secretary as principal, interest, fees, proceeds from security acquired following default, or other amounts received by the Secretary in connection with loans made under this section shall be paid into the Treasury of the United States as miscellaneous receipts.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac8cad81-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s8402/h"><num value="h" class="bold">(h)</num><heading class="bold"> Authorization of appropriation</heading><content><p style="-uslm-lc:I11" class="indent0">There are hereby authorized to be appropriated to the Secretary such sums as may be necessary to carry out the purposes of this section, but not to exceed $400,000,000 for fiscal year 1979 and $400,000,000 for fiscal year 1980. Authority granted to the Secretary under subsection (a) may be exercised only to the extent as may be provided in advance in appropriation Acts.</p>
