<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0ab4f650-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532"><num value="8532">§ 8532.</num><heading> Middle distillate monitoring program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0ab4f651-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a"><num value="a" class="bold">(a)</num><heading class="bold"> Monitoring program</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id0ab4f652-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/1"><num value="1">(1)</num><content> Not later than 60 days after <date date="1979-11-05">November 5, 1979</date>, the Secretary shall establish and maintain a data collection program for monitoring, at the refining, wholesale, and retail levels, the supply and demand levels of middle distillates on a periodic basis in each State.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0ab4f653-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/2"><num value="2">(2)</num><chapeau> The program to be established under paragraph (1) shall provide for—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id0ab4f654-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/2/A"><num value="A">(A)</num><content> the prompt collection of relevant demand and supply data under the authority available to the Secretary under other law; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id0ab4f655-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/2/B"><num value="B">(B)</num><content> the submission to Congress of periodic reports each containing a concise narrative analysis of the most recent data which the Secretary determines are accurate, and a discussion on a State-by-State basis of trends in such data which the Secretary determines are significant.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0ab4f656-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/3"><num value="3">(3)</num><content> All data and information collected under this program shall be available to the Congress and committees of the Congress, and, in accordance with otherwise applicable law, to appropriate State and Federal agencies and the public.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0ab4f657-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/4"><num value="4">(4)</num><content> Nothing in this subsection authorizes the direct or indirect regulation of the price of any middle distillate.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id0ab4f658-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/a/5"><num value="5">(5)</num><content> For purposes of this section, the term “middle distillate” has the same meaning as given that term in section 211.51 of title 10, Code of Federal Regulations, as in effect on <date date="1979-11-05">November 5, 1979</date>.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0ab4f659-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s8532/b"><num value="b" class="bold">(b)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I11" class="indent0">Before <date date="1979-12-31">December 31, 1979</date>, the President shall submit a report to Congress in which the President shall examine the middle distillate situation, summarizing the data, information, and analyses described in subsection (a) and discussing in detail matters required to be addressed in findings made pursuant to section 760a(d)(1) <ref class="footnoteRef" idref="fn003770">1</ref><note type="footnote" id="fn003770"><num>1</num> See References in Text note below.</note> of title 15.</p>
