<chapeau style="-uslm-lc:I11" class="blockIndent0">As used in this chapter—</chapeau><paragraph class="indent1" id="id3851c5e9-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/1"><num value="1">(1)</num><content> The term “alcohol” means alcohol (including methanol and ethanol) which is produced from biomass and which is suitable for use by itself or in combination with other substances as a fuel or as a substitute for petroleum or petrochemical feedstocks.</content>
</paragraph>
<paragraph class="indent1" id="id3851c5ea-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/2"><num value="2">(2)</num><subparagraph class="indent1" id="id3851c5eb-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/2/A"><num value="A">(A)</num><content> The term “biomass” means any organic matter which is available on a renewable basis, including agricultural crops and agricultural wastes and residues, wood and wood wastes and residues, animal wastes, municipal wastes, and aquatic plants.</content>
</subparagraph>
<subparagraph class="indent1" id="id3851c5ec-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/2/B"><num value="B">(B)</num><content> For purposes of subchapter I of this chapter, such term does not include municipal wastes; and for purposes of subchapter III of this chapter, such term does not include aquatic plants and municipal wastes.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id3851ecfd-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/3"><num value="3">(3)</num><content> The term “biomass fuel” means any gaseous, liquid, or solid fuel produced by conversion of biomass.</content>
</paragraph>
<paragraph class="indent1" id="id3851ecfe-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/4"><num value="4">(4)</num><chapeau> The term “biomass energy” means—</chapeau><subparagraph class="indent2" id="id3851ecff-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/4/A"><num value="A">(A)</num><content> biomass fuel; or</content>
</subparagraph>
<subparagraph class="indent2" id="id3851ed00-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/4/B"><num value="B">(B)</num><content> energy or steam derived from the direct combustion of biomass for the generation of electricity, mechanical power, or industrial process heat.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id3851ed01-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/5"><num value="5">(5)</num><chapeau> The term “biomass energy project” means any facility (or portion of a facility) located in the United States which is primarily for—</chapeau><subparagraph class="indent2" id="id3851ed02-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/5/A"><num value="A">(A)</num><content> the production of biomass fuel (and byproducts); or</content>
</subparagraph>
<subparagraph class="indent2" id="id3851ed03-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/5/B"><num value="B">(B)</num><content> the combustion of biomass for the purpose of generating industrial process heat, mechanical power, or electricity (including cogeneration).</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id3851ed04-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/6"><num value="6">(6)</num><content> The term “Btu” means British thermal unit.</content>
</paragraph>
<paragraph class="indent1" id="id3851ed05-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/7"><num value="7">(7)</num><chapeau> The term “cogeneration” means the combined generation by any facility of—</chapeau><subparagraph class="indent2" id="id3851ed06-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/7/A"><num value="A">(A)</num><content> electrical or mechanical power, and</content>
</subparagraph>
<subparagraph class="indent2" id="id3851ed07-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/7/B"><num value="B">(B)</num><content> steam or forms of useful energy (such as heat) which are used for industrial, commercial, heating, or cooling purposes.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id38521418-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/8"><num value="8">(8)</num><content> The term “cooperative” means any agricultural association, as that term is defined in <ref href="/us/usc/t12/s1141j/a">section 1141j(a) of title 12</ref>.</content>
</paragraph>
<paragraph class="indent1" id="id38521419-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9"><num value="9">(9)</num><subparagraph class="indent1" id="id3852141a-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/A"><num value="A">(A)</num><chapeau> The term “construction” means—</chapeau><clause class="indent2" id="id3852141b-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/A/i"><num value="i">(i)</num><content> the construction or acquisition of any biomass energy project;</content>
</clause>
<clause class="indent2" id="id3852141c-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/A/ii"><num value="ii">(ii)</num><content> the conversion of any facility to a biomass energy project; or</content>
</clause>
<clause class="indent2" id="id3852141d-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/A/iii"><num value="iii">(iii)</num><content> the expansion or improvement of any biomass energy project which increases the capacity or efficiency of that facility to produce biomass energy.</content>
</clause>
</subparagraph>
<subparagraph class="indent1" id="id3852141e-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/B"><num value="B">(B)</num><chapeau> Such term includes—</chapeau><clause class="indent2" id="id3852141f-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/B/i"><num value="i">(i)</num><content> the acquisition of equipment and machinery for use in or at the site of a biomass energy project; and</content>
</clause>
<clause class="indent2" id="id38521420-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/B/ii"><num value="ii">(ii)</num><content> the acquisition of land and improvements thereon for the construction, expansion, or improvement of such a project, or the conversion of a facility to such a proj­ect.</content>
</clause>
</subparagraph>
<subparagraph class="indent1" id="id38523b31-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/9/C"><num value="C">(C)</num><content> Such term does not include the acquisition of any facility which was operated as a biomass energy project before the acquisition.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id38523b32-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/10"><num value="10">(10)</num><content> The term “Federal agency” means any Executive agency, as defined in <ref href="/us/usc/t5/s105">section 105 of title 5</ref>.</content>
</paragraph>
<paragraph class="indent1" id="id38523b33-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11"><num value="11">(11)</num><subparagraph class="indent1" id="id38523b34-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/A"><num value="A">(A)</num><chapeau> The term “financial assistance” means any of the following forms of financial assistance provided under this chapter, or any combination of such forms:</chapeau><clause class="indent2" id="id38523b35-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/A/i"><num value="i">(i)</num><content> loans,</content>
</clause>
<clause class="indent2" id="id38523b36-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/A/ii"><num value="ii">(ii)</num><content> loan guarantees,</content>
</clause>
<clause class="indent2" id="id38523b37-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/A/iii"><num value="iii">(iii)</num><content> price guarantees, and</content>
</clause>
<clause class="indent2" id="id38523b38-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/A/iv"><num value="iv">(iv)</num><content> purchase agreements.</content>
</clause>
</subparagraph>
<subparagraph class="indent1" id="id38523b39-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/11/B"><num value="B">(B)</num><content> Such term includes any commitment to provide such assistance.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id38523b3a-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/12"><num value="12">(12)</num><content> The term “Indian tribe” means any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act [<ref href="/us/usc/t43/s1601">43 U.S.C. 1601</ref> et seq.] which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</content>
</paragraph>
<paragraph class="indent1" id="id3852624b-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/13"><num value="13">(13)</num><content> The term “motor fuel” means gasoline, kerosene, and middle distillates (including diesel fuel).</content>
</paragraph>
<paragraph class="indent1" id="id3852624c-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/14"><num value="14">(14)</num><subparagraph class="indent1" id="id3852624d-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/14/A"><num value="A">(A)</num><chapeau> The term “municipal waste” means any organic matter, including sewage, sewage sludge, and industrial or commercial waste, and mixtures of such matter and inorganic refuse—</chapeau><clause class="indent2" id="id3852624e-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/14/A/i"><num value="i">(i)</num><content> from any publicly or privately operated municipal waste collection or similar disposal system, or</content>
</clause>
<clause class="indent2" id="id3852624f-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/14/A/ii"><num value="ii">(ii)</num><content> from similar waste flows (other than such flows which constitute agricultural wastes or residues, or wood wastes or residues from wood harvesting activities or production of forest products).</content>
</clause>
</subparagraph>
<subparagraph class="indent1" id="id38526250-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/14/B"><num value="B">(B)</num><content> Such term does not include any hazardous waste, as determined by the Secretary of Energy for purposes of this chapter.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id38526251-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/15"><num value="15">(15)</num><subparagraph class="indent1" id="id38526252-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/15/A"><num value="A">(A)</num><chapeau> The term “municipal waste energy project” means any facility (or portion of a facility) located in the United States primarily for—</chapeau><clause class="indent2" id="id38528963-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/15/A/i"><num value="i">(i)</num><content> the production of biomass fuel (and byproducts) from municipal waste; or</content>
</clause>
<clause class="indent2" id="id38528964-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/15/A/ii"><num value="ii">(ii)</num><content> the combustion of municipal waste for the purpose of generating steam or forms of useful energy, including industrial process heat, mechanical power, or electricity (including cogeneration).</content>
</clause>
</subparagraph>
<subparagraph class="indent1" id="id38528965-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/15/B"><num value="B">(B)</num><content> Such term includes any necessary transportation, preparation, and disposal equipment and machinery for use in or at the site of the facility involved.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id38528966-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/16"><num value="16">(16)</num><content> The term “Office of Alcohol Fuels” means the Office of Alcohol Fuels established under <ref href="/us/usc/t42/s8820">section 8820 of this title</ref>.</content>
</paragraph>
<paragraph class="indent1" id="id38528967-f63c-11e2-8470-abc29ba29c4d" identifier="/us/usc/t42/s8802/17"><num value="17">(17)</num><content> The term “person” means any individual, company, cooperative, partnership, corporation, association, consortium, unincorporated organization, trust, estate, or any entity organized for a common business purpose, any State or local government (including any special purpose district or similar governmental unit) or any agency or instrumentality thereof, or any Indian tribe or tribal organization.</content>
</paragraph>
