<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8055bbf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803"><num value="8803">§ 8803.</num><heading> Funding</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8055bc0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authorization of appropriations</heading><chapeau style="-uslm-lc:I11" class="indent0">To the extent provided in advance in appropriation Acts, for the two year period beginning <date date="1980-10-01">October 1, 1980</date>, there is authorized to be appropriated and transferred $1,170,000,000 from the Energy Security Reserve established in the Treasury of the United States under title II of the Act entitled “An Act making appropriations for the Department of the Interior and related agencies for the fiscal year ending <date date="1980-09-30">September 30, 1980</date>, and for other purposes” (<ref href="/us/pl/96/126">Public Law 96–126</ref>; <ref href="/us/stat/93/970">93 Stat. 970</ref>) and made available for obligation by such Act only to the extent provided in advance in appropriation Acts, as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8055bc1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/a/1"><num value="1">(1)</num><content> $460,000,000 to the Secretary of Agriculture for carrying out activities under subchapter I, except of the amount of the financial assistance provided by the Secretary of Agriculture under subchapter I, up to one-third shall be for small-scale biomass energy projects;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8055bc2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/a/2"><num value="2">(2)</num><content> $460,000,000 to the Secretary of Energy for carrying out biomass energy activities under subchapter I, of which at least $500,000,000 <ref class="footnoteRef" idref="fn003774">1</ref><note type="footnote" id="fn003774"><num>1</num> So in original. <ref href="/us/pl/97/35">Pub. L. 97–35</ref> decreased appropriation to $460,000,000 from $600,000,000 without amending sum of $500,000,000.</note> shall be available to the Office of Alcohol Fuels for carrying out its activities, and any amount not made available to the Office of Alcohol Fuels shall be available to the Secretary to carry out the purposes of subchapter I under available authorities of the Secretary, including authorities under subchapter I; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8055bc3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/a/3"><num value="3">(3)</num><content> $250,000,000 shall be available to the Secretary of Energy for carrying out activities under subchapter II.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8055bc4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/b"><num value="b" class="bold">(b)</num><heading class="bold"> Availability of funds until expended</heading><content><p style="-uslm-lc:I11" class="indent0">Funds made available under subsection (a) shall remain available until expended.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8055bc5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c"><num value="c" class="bold">(c)</num><heading class="bold"> Determinations respecting amount of appropriations remaining available</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd8055bc6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/1"><num value="1">(1)</num><chapeau> For purposes of determining the amount of such appropriations which remain available for purposes of this chapter—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8055bc7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/1/A"><num value="A">(A)</num><content> loans shall be counted at the initial face value of the loan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8055bc8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/1/B"><num value="B">(B)</num><content> loan guarantees shall be counted at the initial face value of such loan guarantee;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8055bc9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/1/C"><num value="C">(C)</num><content> price guarantees and purchase agreements shall be counted at the value determined by the Secretary concerned as of the date of each such contract based upon the Secretary’s determination of the maximum potential liability of the United States under the contract; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8055bca-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/1/D"><num value="D">(D)</num><content> any increase in the liability of the United States pursuant to any amendment or other modification to a contract for a loan, loan guarantee, price guarantee, or purchase agreement, shall be counted to the extent of such increase.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8055bcb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/2"><num value="2">(2)</num><content> Determinations under paragraph (1) shall be made in accordance with generally accepted accounting principles, consistently applied.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8055bcc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/3"><num value="3">(3)</num><content> If more than one form of financial assistance is to be provided to any one project, the obligations and commitments thereunder shall be counted at the maximum potential exposure of the United States on such project at any time during the life of such project.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8055bcd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s8803/c/4"><num value="4">(4)</num><content> Any commitment to provide financial assistance shall be treated the same as such assistance for purposes of this subsection; except that any such commitment which is nullified or voided for any reason shall not be considered for purposes of this subsection.</content>
