<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idac9e87dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122"><num value="9122">§ 9122.</num><heading> Recordkeeping and public access to information</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac9e87dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/a"><num value="a" class="bold">(a)</num><heading class="bold"> Records and reports</heading><content><p style="-uslm-lc:I11" class="indent0">Each licensee shall establish and maintain such records, make such reports, and provide such information as the Administrator, after consultation with other interested Federal departments and agencies, shall by regulation prescribe to carry out the provisions of this chapter. Each licensee shall submit such reports and shall make available such records and information as the Administrator may request.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idac9e87de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b"><num value="b" class="bold">(b)</num><heading class="bold"> Confidential information</heading><chapeau style="-uslm-lc:I11" class="indent0">Any information reported to or collected by the Administrator under this chapter which is exempt from disclosure pursuant to <ref href="/us/usc/t5/s552/b/4">section 552(b)(4) of title 5</ref> (relating to trade secrets and commercial or financial information which is privileged or confidential) shall not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idac9e87df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/1"><num value="1">(1)</num><chapeau> be publicly disclosed by the Administrator or by any other officer or employee of the United States, unless the Administrator has—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac9e87e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/1/A"><num value="A">(A)</num><content> determined that the disclosure is necessary to protect the public health or safety or the environment against an unreasonable risk of injury, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac9e87e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/1/B"><num value="B">(B)</num><content> notified the person who submitted the information 10 days before the disclosure is to be made, unless the delay resulting from such notice would be detrimental to the public health or safety or the environment, or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idac9e87e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2"><num value="2">(2)</num><chapeau> be otherwise disclosed except—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idac9e87e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idac9e87e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2/A/i"><num value="i">(i)</num><content> to other Federal and adjacent coastal State government departments and agencies for official use,</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idac9e87e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2/A/ii"><num value="ii">(ii)</num><content> to any committee of the Congress of appropriate jurisdiction, or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idac9eaef6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2/A/iii"><num value="iii">(iii)</num><content> pursuant to court order, and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idac9eaef7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9122/b/2/B"><num value="B">(B)</num><content> when the Administrator has taken appropriate steps to inform the recipient of the confidential nature of the information.</content>
