L. 96–386, § 2, Oct. 7, 1980, 94 Stat. 1539.)","seq_in_title":5816,"parent_identifier":"/us/usc/t42/ch101","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch101","level":"chapter","num":"CHAPTER 101—","heading":"MAGNETIC FUSION ENERGY ENGINEERING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id47868c8d-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301\"><num value=\"9301\">§ 9301.</num><heading> Congressional findings and declaration of policy</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id47868c8e-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a\"><num value=\"a\">(a)</num><chapeau> The Congress hereby finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c8f-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/1\"><num value=\"1\">(1)</num><content> the United States must formulate an energy policy designed to meet an impending worldwide shortage of many exhaustible, conventional energy resources in the next few decades;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c90-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/2\"><num value=\"2\">(2)</num><content> the energy policy of the United States must be designed to ensure that energy technologies using essentially inexhaustible resources are commercially available at a time prior to serious depletion of conventional resources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c91-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/3\"><num value=\"3\">(3)</num><content> fusion energy is one of the few known energy sources which are essentially inexhaustible, and thus constitutes a long-term energy option;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c92-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/4\"><num value=\"4\">(4)</num><content> major progress in all aspects of magnetic fusion energy technology during the past decade instills confidence that power production from fusion energy systems is achievable;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c93-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/5\"><num value=\"5\">(5)</num><content> the United States must aggressively pursue research and development programs in magnetic fusion designed to foster advanced concepts and advanced technology and to develop efficient, reliable components and subsystems;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c94-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/6\"><num value=\"6\">(6)</num><content> to ensure the timely commercialization of magnetic fusion energy systems, the United States must demonstrate at an early date the engineering feasibility of magnetic fusion energy systems;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c95-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/7\"><num value=\"7\">(7)</num><content> progress in magnetic fusion energy systems is currently limited by the funds made available rather than technical barriers;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c96-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/8\"><num value=\"8\">(8)</num><content> it is a proper role for the Federal Government to accelerate research, development, and demonstration programs in magnetic fusion energy technologies; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c97-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/a/9\"><num value=\"9\">(9)</num><content> acceleration of the current magnetic fusion program will require a doubling within seven years of the present funding level without consideration of inflation and a 25 per centum increase in funding each of fiscal years 1982 and 1983.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id47868c98-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b\"><num value=\"b\">(b)</num><chapeau> It is therefore declared to be the policy of the United States and the purpose of this chapter to accelerate the national effort in research, development, and demonstration activities related to magnetic fusion energy systems. Further, it is declared to be the policy of the United States and the purpose of this chapter that the objectives of such program shall be—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c99-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/1\"><num value=\"1\">(1)</num><content> to promote an orderly transition from the current research and development program through commercial development;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9a-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/2\"><num value=\"2\">(2)</num><content> to establish a national goal of demonstrating the engineering feasibility of magnetic fusion by the early 1990’s;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9b-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/3\"><num value=\"3\">(3)</num><content> to achieve at the earliest practicable time, but not later than the year 1990, operation of a magnetic fusion engineering device based on the best available confinement concept;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9c-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/4\"><num value=\"4\">(4)</num><content> to establish as a national goal the operation of a magnetic fusion demonstration plant at the turn of the twenty-first century;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9d-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/5\"><num value=\"5\">(5)</num><content> to foster cooperation in magnetic fusion research and development among government, universities, industry, and national laboratories;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9e-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/6\"><num value=\"6\">(6)</num><content> to promote the broad participation of domestic industry in the national magnetic fusion program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868c9f-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/7\"><num value=\"7\">(7)</num><content> to continue international cooperation in magnetic fusion research for the benefit of all nations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868ca0-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/8\"><num value=\"8\">(8)</num><content> to promote greater public understanding of magnetic fusion; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id47868ca1-3271-11e3-ab2f-8f7fedb88afd\" identifier=\"/us/usc/t42/s9301/b/9\"><num value=\"9\">(9)</num><content> to maintain the United States as the world leader in magnetic fusion.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id47868ca2-3271-11e3-ab2f-8f7fedb88afd\">(<ref href=\"/us/pl/96/386/s2\">Pub.
