<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaca2cdca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511"><num value="9511">§ 9511.</num><heading> Grants for sex offense prevention and control</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaca2cdcb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authority of National Center for the Prevention and Control of Sex Offenses; functions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary, acting through the National Center for the Prevention and Control of Sex Offenses (hereafter in this section referred to as the “Center”), may, directly or by grant, carry out the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaca2cdcc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1"><num value="1">(1)</num><chapeau> A continuing study of sex offenses, including a study and investigation of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/A"><num value="A">(A)</num><content> the effectiveness of existing Federal, State, and local laws dealing with sex offenses;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/B"><num value="B">(B)</num><content> the relationship, if any, between traditional legal and social attitudes toward sexual roles, sex offenses, and the formulation of laws dealing with rape;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/C"><num value="C">(C)</num><content> the treatment of the victims of sex offenses by law enforcement agencies, hospitals or other medical institutions, prosecutors, and the courts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/D"><num value="D">(D)</num><chapeau> the causes of sex offenses, identifying to the degree possible—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaca2f4e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/D/i"><num value="i">(i)</num><content> social conditions which encourage sexual attacks, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaca2f4e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/D/ii"><num value="ii">(ii)</num><content> the motives of offenders, and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/E"><num value="E">(E)</num><content> the impact of a sex offense on the victim and family of the victim;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/F"><num value="F">(F)</num><content> sexual assaults in correctional institutions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/G"><num value="G">(G)</num><content> the estimated actual incidence of forcible sex offenses as compared to the reported incidence of forcible sex offenses and the reasons for any difference between the two; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/1/H"><num value="H">(H)</num><content> the effectiveness of existing private and local and State government educational, counseling, and other programs designed to prevent and control sex offenses.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaca2f4e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/2"><num value="2">(2)</num><content> The compilation, analysis, and publication of summaries of the continuing study conducted under paragraph (1) and the research and demonstration projects conducted under paragraph (5). The Secretary shall submit not later than <date date="1983-03-30">March 30, 1983</date>, to the Congress a summary of such study and projects together with a review of their effectiveness and recommendations where appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaca2f4e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/3"><num value="3">(3)</num><chapeau> The development and maintenance of an information clearinghouse with regard to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/3/A"><num value="A">(A)</num><content> the prevention and control of sex offenses;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/3/B"><num value="B">(B)</num><content> the treatment and counseling of the victims of sex offenses and their families; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaca2f4eb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/3/C"><num value="C">(C)</num><content> the rehabilitation of offenders.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaca2f4ec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/4"><num value="4">(4)</num><content> The compilation and publication of training materials for personnel who are engaged or intend to engage in programs designed to prevent and control sex offense.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaca2f4ed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/a/5"><num value="5">(5)</num><content> Assistance to qualified public and nonprofit private entities in conducting research and demonstration projects concerning the prevention and control of sex offense, including projects (A) for the planning, development, implementation, and evaluation of alternative methods used in the prevention and control of sex offense, the treatment and counseling of the victims of sex offense and their families, and the rehabilitation of offenders; (B) for the application of such alternative methods; and (C) for the promotion of community awareness of the specific locations in which, and the specific social and other conditions under which sexual attacks are most likely to occur.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaca2f4ee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/b"><num value="b" class="bold">(b)</num><heading class="bold"> Advisory committee; functions, membership, etc.</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall appoint an advisory committee to advise, consult with, and make recommendations to the Secretary on the implementation of subsection (a). The recommendations of the committee shall be submitted directly to the Secretary without review or revision by any person without the consent of the committee. The Secretary shall appoint to such committee persons who are particularly qualified to assist in carrying out the functions of the committee. A majority of the members of the committee shall be women. Members of the advisory committee shall receive compensation at rates, not to exceed the daily equivalent of the annual rate in effect for grade GS–18 of the General Schedule, for each day (including traveltime) they are engaged in the performance of their duties as members of the advisory committee and, while so serving away from their homes or regular places of business, each member shall be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as authorized by <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref> for persons in Government service employed intermittently.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaca2f4ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/c"><num value="c" class="bold">(c)</num><heading class="bold"> Submission and approval of application; form, manner and contents</heading><content><p style="-uslm-lc:I11" class="indent0">No grant may be made under subsection (a) unless an application therefor is submitted to and approved by the Secretary. The application shall be submitted in such form and manner and contain such information as the Secretary may prescribe.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaca31c00-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">For the purpose of carrying out subsection (a), there are authorized to be appropriated $6,000,000 for the fiscal year ending <date date="1981-09-30">September 30, 1981</date>, $1,500,000 for the fiscal year ending <date date="1982-09-30">September 30, 1982</date>, $1,500,000 for the fiscal year ending <date date="1983-09-30">September 30, 1983</date>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaca31c01-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9511/e"><num value="e" class="bold">(e)</num><heading class="bold"> “Sex offense” defined</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of subsection (a), the term “sex offense” includes statutory and attempted rape and any other criminal sexual assault (whether homosexual or heterosexual) which involves force or the threat of force.</p>
