value=\"9628\">§ 9628.</num><heading> State response programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb7dcc4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Assistance to States</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb7dcc5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb7dcc6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> States</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Administrator may award a grant to a State or Indian tribe that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb7dcc7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/A/i\"><num value=\"i\">(i)</num><content> has a response program that includes each of the elements, or is taking reasonable steps to include each of the elements, listed in paragraph (2); or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb7dcc8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> is a party to a memorandum of agreement with the Administrator for voluntary response programs.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb7dcc9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Use of grants by States</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb7dcca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">A State or Indian tribe may use a grant under this subsection to establish or enhance the response program of the State or Indian tribe.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb7dccb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Additional uses</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In addition to the uses under clause (i), a State or Indian tribe may use a grant under this subsection to—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb7dccc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/ii/I\"><num value=\"I\">(I)</num><content> capitalize a revolving loan fund for brownfield remediation under <ref href=\"/us/usc/t42/s9604/k/3\">section 9604(k)(3) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb7dccd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/ii/II\"><num value=\"II\">(II)</num><content> purchase insurance or develop a risk sharing pool, an indemnity pool, or insurance mechanism to provide financing for response actions under a State response program; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb803de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/ii/III\"><num value=\"III\">(III)</num><content> assist small communities, Indian tribes, rural areas, or disadvantaged areas in carrying out activities described in <ref href=\"/us/usc/t42/s9604/k/7/A\">section 9604(k)(7)(A) of this title</ref> with respect to brownfield sites.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb803df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Small communities, Indian tribes, rural areas, and disadvantaged areas</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idacb803e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">To make grants to States or Indian tribes under clause (ii)(III), the Administrator may use, in addition to amounts available to carry out this subsection, not more than $1,500,000 of the amounts made available to carry out <ref href=\"/us/usc/t42/s9604/k/7\">section 9604(k)(7) of this title</ref> in each fiscal year.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idacb803e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Each grant made under subclause (I) may be not more than $20,000.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idacb803e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iii/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Inclusion in other grants</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The Administrator may, at the request of a State or Indian tribe, include a grant under this clause in any other grant to the State or Indian tribe made under this subsection.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb803e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In this subparagraph:</chapeau><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idacb803e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iv/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> Disadvantaged area</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The term “disadvantaged area” means a community with an annual median household income that is less than 80 percent of the statewide annual median household income, as determined by the President based on the latest available decennial census.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idacb803e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/1/B/iv/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Small community</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The term “small community” means a community with a population of not more than 15,000 individuals, as determined by the President based on the latest available decennial census.</p>\n</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb803e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Elements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The elements of a State or Indian tribe response program referred to in paragraph (1)(A)(i) are the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb803e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/A\"><num value=\"A\">(A)</num><content> Timely survey and inventory of brownfield sites in the State.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb803e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/B\"><num value=\"B\">(B)</num><chapeau> Oversight and enforcement authorities or other mechanisms, and resources, that are adequate to ensure that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/B/i\"><num value=\"i\">(i)</num><chapeau> a response action will—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb803ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/B/i/I\"><num value=\"I\">(I)</num><content> protect human health and the environment; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb803eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/B/i/II\"><num value=\"II\">(II)</num><content> be conducted in accordance with applicable Federal and State law; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> if the person conducting the response action fails to complete the necessary response activities, including operation and maintenance or long-term monitoring activities, the necessary response activities are completed.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb803ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C\"><num value=\"C\">(C)</num><chapeau> Mechanisms and resources to provide meaningful opportunities for public participation, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C/i\"><num value=\"i\">(i)</num><content> public access to documents that the State, Indian tribe, or party conducting the cleanup is relying on or developing in making cleanup decisions or conducting site activities;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C/ii\"><num value=\"ii\">(ii)</num><content> prior notice and opportunity for comment on proposed cleanup plans and site activities; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C/iii\"><num value=\"iii\">(iii)</num><chapeau> a mechanism by which—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb803f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C/iii/I\"><num value=\"I\">(I)</num><content> a person that is or may be affected by a release or threatened release of a hazardous substance, pollutant, or contaminant at a brownfield site located in the community in which the person works or resides may request the conduct of a site assessment; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb803f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/C/iii/II\"><num value=\"II\">(II)</num><content> an appropriate State official shall consider and appropriately respond to a request under subclause (I).</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb803f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/2/D\"><num value=\"D\">(D)</num><content> Mechanisms for approval of a cleanup plan, and a requirement for verification by and certification or similar documentation from the State, an Indian tribe, or a licensed site professional to the person conducting a response action indicating that the response is complete.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb803f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Funding</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is authorized to be appropriated to carry out this subsection $50,000,000 for each of fiscal years 2019 through 2023.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb803f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Enforcement in cases of a release subject to State program</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb803f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Enforcement</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb803f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B) and subject to subparagraph (C), in the case of an eligible response site at which—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/A/i\"><num value=\"i\">(i)</num><content> there is a release or threatened release of a hazardous substance, pollutant, or contaminant; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb803f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> a person is conducting or has completed a response action regarding the specific release that is addressed by the response action that is in compliance with the State program that specifically governs response actions for the protection of public health and the environment,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">the President may not use authority under this chapter to take an administrative or judicial enforcement action under <ref href=\"/us/usc/t42/s9606/a\">section 9606(a) of this title</ref> or to take a judicial enforcement action to recover response costs under <ref href=\"/us/usc/t42/s9607/a\">section 9607(a) of this title</ref> against the person regarding the specific release that is addressed by the response action.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb82b0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exceptions</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The President may bring an administrative or judicial enforcement action under this chapter during or after completion of a response action described in subparagraph (A) with respect to a release or threatened release at an eligible response site described in that subparagraph if—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb82b0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/i\"><num value=\"i\">(i)</num><content> the State requests that the President provide assistance in the performance of a response action;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb82b0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> the Administrator determines that contamination has migrated or will migrate across a State line, resulting in the need for further response action to protect human health or the environment, or the President determines that contamination has migrated or is likely to migrate onto property subject to the jurisdiction, custody, or control of a department, agency, or instrumentality of the United States and may impact the authorized purposes of the Federal property;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb82b0d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/iii\"><num value=\"iii\">(iii)</num><chapeau> after taking into consideration the response activities already taken, the Administrator determines that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/iii/I\"><num value=\"I\">(I)</num><content> a release or threatened release may present an imminent and substantial endangerment to public health or welfare or the environment; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/iii/II\"><num value=\"II\">(II)</num><content> additional response actions are likely to be necessary to address, prevent, limit, or mitigate the release or threatened release; or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb82b10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/B/iv\"><num value=\"iv\">(iv)</num><content> the Administrator, after consultation with the State, determines that information, that on the earlier of the date on which cleanup was approved or completed, was not known by the State, as recorded in documents prepared or relied on in selecting or conducting the cleanup, has been discovered regarding the contamination or conditions at a facility such that the contamination or conditions at the facility present a threat requiring further remediation to protect public health or welfare or the environment. Consultation with the State shall not limit the ability of the Administrator to make this determination.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb82b11-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Public record</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The limitations on the authority of the President under subparagraph (A) apply only at sites in States that maintain, update not less than annually, and make available to the public a record of sites, by name and location, at which response actions have been completed in the previous year and are planned to be addressed under the State program that specifically governs response actions for the protection of public health and the environment in the upcoming year. The public record shall identify whether or not the site, on completion of the response action, will be suitable for unrestricted use and, if not, shall identify the institutional controls relied on in the remedy. Each State and tribe receiving financial assistance under subsection (a) shall maintain and make available to the public a record of sites as provided in this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb82b12-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> EPA notification</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb82b13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">In the case of an eligible response site at which there is a release or threatened release of a hazardous substance, pollutant, or contaminant and for which the Administrator intends to carry out an action that may be barred under subparagraph (A), the Administrator shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b14-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/i/I\"><num value=\"I\">(I)</num><content> notify the State of the action the Administrator intends to take; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/i/II\"><num value=\"II\">(II)</num><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/i/II/aa\"><num value=\"aa\">(aa)</num><content> wait 48 hours for a reply from the State under clause (ii); or</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb82b17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/i/II/bb\"><num value=\"bb\">(bb)</num><content> if the State fails to reply to the notification or if the Administrator makes a determination under clause (iii), take immediate action under that clause.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb85228-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> State reply</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Not later than 48 hours after a State receives notice from the Administrator under clause (i), the State shall notify the Administrator if—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb85229-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/ii/I\"><num value=\"I\">(I)</num><content> the release at the eligible response site is or has been subject to a cleanup conducted under a State program; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacb8522a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/ii/II\"><num value=\"II\">(II)</num><content> the State is planning to abate the release or threatened release, any actions that are planned.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacb8522b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/D/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Immediate Federal action</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Administrator may take action immediately after giving notification under clause (i) without waiting for a State reply under clause (ii) if the Administrator determines that one or more exceptions under subparagraph (B) are met.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb8522c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/1/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Report to Congress</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than 90 days after the date of initiation of any enforcement action by the President under clause (ii), (iii), or (iv) of subparagraph (B), the President shall submit to Congress a report describing the basis for the enforcement action, including specific references to the facts demonstrating that enforcement action is permitted under subparagraph (B).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb8522d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Savings provision</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb8522e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Costs incurred prior to limitations</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in paragraph (1) precludes the President from seeking to recover costs incurred prior to <date date=\"2002-01-11\">January 11, 2002</date>, or during a period in which the limitations of paragraph (1)(A) were not applicable.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacb8522f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Effect on agreements between States and EPA</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in paragraph (1)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacb85230-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9628/b/2/B/i\"><num value=\"i\">(i)</num><content> modifies or otherwise affects a memorandum of agreement, memorandum of understanding, or any similar agreement relating to this chapter between a State agency or an Indian tribe and the Administrator that is in effect on or before <date date=\"2002-01-11\">January 11, 2002</date> (which agreement shall remain in effect, subject to the terms of the agreement);
