or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacb9d871-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/a/2\"><num value=\"2\">(2)</num><content> against the President or any other officer of the United States (including the Administrator of the Environmental Protection Agency and the Administrator of the ATSDR) where there is alleged a failure of the President or of such other officer to perform any act or duty under this chapter, including an act or duty under <ref href=\"/us/usc/t42/s9620\">section 9620 of this title</ref> (relating to Federal facilities), which is not discretionary with the President or such other officer.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">Paragraph (2) shall not apply to any act or duty under the provisions of <ref href=\"/us/usc/t42/s9660\">section 9660 of this title</ref> (relating to research, development, and demonstration).</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9d872-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Venue</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb9d873-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Actions under subsection (a)(1)</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any action under subsection (a)(1) shall be brought in the district court for the district in which the alleged violation occurred.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb9d874-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Actions under subsection (a)(2)</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any action brought under subsection (a)(2) may be brought in the United States District Court for the District of Columbia.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9d875-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Relief</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The district court shall have jurisdiction in actions brought under subsection (a)(1) to enforce the standard, regulation, condition, requirement, or order concerned (including any provision of an agreement under <ref href=\"/us/usc/t42/s9620\">section 9620 of this title</ref>), to order such action as may be necessary to correct the violation, and to impose any civil penalty provided for the violation. The district court shall have jurisdiction in actions brought under subsection (a)(2) to order the President or other officer to perform the act or duty concerned.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9d876-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Rules applicable to subsection (a)(1) actions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb9d877-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Notice</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">No action may be commenced under subsection (a)(1) before 60 days after the plaintiff has given notice of the violation to each of the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb9d878-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d/1/A\"><num value=\"A\">(A)</num><content> The President.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb9d879-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d/1/B\"><num value=\"B\">(B)</num><content> The State in which the alleged violation occurs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacb9d87a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d/1/C\"><num value=\"C\">(C)</num><content> Any alleged violator of the standard, regulation, condition, requirement, or order concerned (including any provision of an agreement under <ref href=\"/us/usc/t42/s9620\">section 9620 of this title</ref>).</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">Notice under this paragraph shall be given in such manner as the President shall prescribe by regulation.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacb9d87b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Diligent prosecution</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No action may be commenced under paragraph (1) of subsection (a) if the President has commenced and is diligently prosecuting an action under this chapter, or under the Solid Waste Disposal Act [<ref href=\"/us/usc/t42/s6901\">42 U.S.C. 6901</ref> et seq.] to require compliance with the standard, regulation, condition, requirement, or order concerned (including any provision of an agreement under <ref href=\"/us/usc/t42/s9620\">section 9620 of this title</ref>).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9d87c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Rules applicable to subsection (a)(2) actions</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No action may be commenced under paragraph (2) of subsection (a) before the 60th day following the date on which the plaintiff gives notice to the Administrator or other department, agency, or instrumentality that the plaintiff will commence such action. Notice under this subsection shall be given in such manner as the President shall prescribe by regulation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9d87d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Costs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The court, in issuing any final order in any action brought pursuant to this section, may award costs of litigation (including reasonable attorney and expert witness fees) to the prevailing or the substantially prevailing party whenever the court determines such an award is appropriate. The court may, if a temporary restraining order or preliminary injunction is sought, require the filing of a bond or equivalent security in accordance with the Federal Rules of Civil Procedure.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9ff8e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Intervention</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In any action under this section, the United States or the State, or both, if not a party may intervene as a matter of right. For other provisions regarding intervention, see <ref href=\"/us/usc/t42/s9613\">section 9613 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9ff8f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Other rights</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This chapter does not affect or otherwise impair the rights of any person under Federal, State, or common law, except with respect to the timing of review as provided in <ref href=\"/us/usc/t42/s9613/h\">section 9613(h) of this title</ref> or as otherwise provided in <ref href=\"/us/usc/t42/s9658\">section 9658 of this title</ref> (relating to actions under State law).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacb9ff90-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9659/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Definitions</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The terms used in this section shall have the same meanings as when used in subchapter I.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idacb9ff91-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/96/510/tIII/s310\">Pub.
