L. 99–563, § 11(c)(1), Oct. 27, 1986, 100 Stat. 3177.)","seq_in_title":5888,"parent_identifier":"/us/usc/t42/ch103/schIV","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch103","level":"chapter","num":"CHAPTER 103—","heading":"COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch103/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"POLLUTION INSURANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idacbbacc2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671\"><num value=\"9671\">§ 9671.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this subchapter—</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacbbacc3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Insurance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “insurance” means primary insurance, excess insurance, reinsurance, surplus lines insurance, and any other arrangement for shifting and distributing risk which is determined to be insurance under applicable State or Federal law.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacbbacc4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Pollution liability</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “pollution liability” means liability for injuries arising from the release of hazardous substances or pollutants or contaminants.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacbbd3d5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Risk retention group</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “risk retention group” means any corporation or other limited liability association taxable as a corporation, or as an insurance company, formed under the laws of any State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacbbd3d6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/3/A\"><num value=\"A\">(A)</num><content> whose primary activity consists of assuming and spreading all, or any portion, of the pollution liability of its group members;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacbbd3d7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/3/B\"><num value=\"B\">(B)</num><content> which is organized for the primary purpose of conducting the activity described under subparagraph (A);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacbbd3d8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/3/C\"><num value=\"C\">(C)</num><content> which is chartered or licensed as an insurance company and authorized to engage in the business of insurance under the laws of any State; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacbbd3d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/3/D\"><num value=\"D\">(D)</num><content> which does not exclude any person from membership in the group solely to provide for members of such a group a competitive advantage over such a person.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacbbd3da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Purchasing group</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “purchasing group” means any group of persons which has as one of its purposes the purchase of pollution liability insurance on a group basis.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacbbd3db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9671/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Marianas, and any other territory or possession over which the United States has jurisdiction.</p>\n</content>\n</paragraph>\n<sourceCredit id=\"idacbbd3dc-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/96/510/tIV/s401\">Pub.
