value=\"9836\">§ 9836.</num><heading> Designation of Head Start agencies</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc3c395-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authority to designate</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3c396-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary is authorized to designate as a Head Start agency any local public or private nonprofit agency, including community-based and faith-based organizations, or for-profit agency, within a community, pursuant to the requirements of this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3c397-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Interim policy</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding paragraph (1), until such time as the Secretary develops and implements the system for designation renewal under this section, the Secretary is authorized to designate as a Head Start agency, any local public or private nonprofit agency, including community-based and faith-based organizations, or for-profit agency, within a community, in the manner and process utilized by the Secretary prior to <date date=\"2007-12-12\">December 12, 2007</date>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc3c398-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Application for designation renewal</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">To be considered for designation renewal, an entity shall submit an application to the Secretary, at such time and in such manner as the Secretary may require.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc3c399-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> System for designation renewal</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3c39a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall develop a system for designation renewal that integrates the recommendations of the expert panel convened under paragraph (2) to determine if a Head Start agency is delivering a high-quality and comprehensive Head Start program that meets the educational, health, nutritional, and social needs of the children and families it serves, and meets program and financial management requirements and standards described in <ref href=\"/us/usc/t42/s9836a/a/1\">section 9836a(a)(1) of this title</ref>, based on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eaab-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1/A\"><num value=\"A\">(A)</num><content> annual budget and fiscal management data;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eaac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1/B\"><num value=\"B\">(B)</num><content> program reviews conducted under <ref href=\"/us/usc/t42/s9836a/c\">section 9836a(c) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eaad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1/C\"><num value=\"C\">(C)</num><content> annual audits required under <ref href=\"/us/usc/t42/s9842\">section 9842 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eaae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1/D\"><num value=\"D\">(D)</num><content> classroom quality as measured under <ref href=\"/us/usc/t42/s9836a/c/2/F\">section 9836a(c)(2)(F) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eaaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/1/E\"><num value=\"E\">(E)</num><content> Program Information Reports.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3eab0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Expert panel</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 3 months after <date date=\"2007-12-12\">December 12, 2007</date>, the Secretary shall convene an expert panel of 7 members to make recommendations to the Secretary on the development of a transparent, reliable, and valid system for designation renewal.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3eab1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Composition of expert panel</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, in convening such panel, shall appoint the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A/i\"><num value=\"i\">(i)</num><content> One member, who has demonstrated competency, as evidenced by training, expertise, and experience, in early childhood program accreditation.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A/ii\"><num value=\"ii\">(ii)</num><content> One member, who has demonstrated competency (as so evidenced) in research on early childhood development.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A/iii\"><num value=\"iii\">(iii)</num><content> One member, who has demonstrated competency (as so evidenced) in governance and finance of nonprofit organizations.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A/iv\"><num value=\"iv\">(iv)</num><content> One member, who has demonstrated competency (as so evidenced) in delivery of services to populations of children with special needs and their families.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/A/v\"><num value=\"v\">(v)</num><content> One member, who has demonstrated competency (as so evidenced) in assessment and evaluation of programs serving young children.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/B\"><num value=\"B\">(B)</num><content> An employee from the Office of Head Start.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eab9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/3/C\"><num value=\"C\">(C)</num><content> An executive director of a Head Start agency.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3eaba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Expert panel report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Within 9 months after being convened by the Secretary, the expert panel shall issue a report to the Secretary that provides recommendations on a proposed system for designation renewal that takes into account the criteria in subparagraphs (A) through (E) of paragraph (1) to evaluate whether a Head Start agency is fulfilling its mission to deliver a high-quality and comprehensive Head Start program, including adequately meeting its governance, legal, and financial management requirements.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3eabb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Public comment and consideration</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 3 months after receiving the report described in paragraph (4), the Secretary shall publish a notice describing a proposed system for designation renewal in the Federal Register, including a proposal for the transition to such system, providing at least 90 days for public comment. The Secretary shall review and consider public comments prior to finalizing the system for designation renewal described in this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc3eabc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Designation renewal system</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 12 months after publishing a notice describing the proposed system under paragraph (5), the Secretary shall implement the system for designation renewal and use that system to determine—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc3eabd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/6/A\"><num value=\"A\">(A)</num><content> whether a Head Start grantee is successfully delivering a high-quality and comprehensive Head Start program; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc411ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/6/B\"><num value=\"B\">(B)</num><content> whether the grantee has any unresolved deficiencies found during the last triennial review under <ref href=\"/us/usc/t42/s9836a/c\">section 9836a(c) of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc411cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Implementation of the designation renewal system</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc411d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A grantee who is determined under such system—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc411d1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7/A/i\"><num value=\"i\">(i)</num><content> to be delivering a high-quality and comprehensive Head Start program shall be designated (consistent with <ref href=\"/us/usc/t42/s9838\">section 9838 of this title</ref>) as a Head Start agency for the period of 5 years described in <ref href=\"/us/usc/t42/s9833\">section 9833 of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc411d2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7/A/ii\"><num value=\"ii\">(ii)</num><content> to not be delivering a high-quality and comprehensive Head Start program shall be subject to an open competition as described in subsection (d); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc411d3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7/A/iii\"><num value=\"iii\">(iii)</num><content> in the case of an Indian Head Start agency, to not be delivering a high-quality and comprehensive Head Start program shall (notwithstanding clause (ii)) be subject to the requirements of subparagraph (B).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc411d4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/7/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Tribal government consultation and reevaluation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">On making a determination described in subparagraph (A)(iii), the Secretary shall engage in government-to-government consultation with the appropriate tribal government or governments for the purpose of establishing a plan to improve the quality of Head Start programs operated by the Indian Head Start agency. Such plan shall be established and implemented within 6 months after the Secretary’s determination. Not more than 6 months after the implementation of that plan, the Secretary shall reevaluate the performance of the Indian Head Start agency. If the Indian Head Start agency is still not delivering a high-quality and comprehensive Head Start program, the Secretary shall conduct an open competition as described in subsection (d), subject to the limitations described in subsection (e).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc411d5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Transparency, reliability, and validity</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall ensure the system for designation renewal is fair, consistent, and transparent and is applied in a manner that renews designations, in a timely manner, grantees as Head Start agencies for periods of 5 years if such grantees are delivering high-quality and comprehensive Head Start programs. The Secretary shall periodically evaluate whether the criteria of the system are being applied in a manner that is transparent, reliable, and valid.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc411d6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Transition</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc411d7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/9/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each Head Start agency shall be reviewed under the system for designation renewal described in paragraph (6), not later than 3 years after the implementation of such system.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc411d8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/9/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A Head Start agency shall not be subject to the requirements of the system for designation renewal prior to 18 months after <date date=\"2007-12-12\">December 12, 2007</date>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc411d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/9/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Schedule</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall establish and implement a schedule for reviewing each Head Start agency under the system for designation renewal described in paragraph (6), consistent with subparagraphs (A) and (B).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc411da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Reports to Congress</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc411db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10/A\"><num value=\"A\">(A)</num><content> make available to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate the report described in paragraph (4);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc411dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10/B\"><num value=\"B\">(B)</num><content> concurrently with publishing a notice in the Federal Register as described in paragraph (5), provide a report to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate that provides a detailed description of the proposed system described in paragraph (5), including a clear rationale for any differences between the proposed system and the recommendations of the expert panel, if any such differences exist; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc411dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10/C\"><num value=\"C\">(C)</num><chapeau> prior to implementing the system for designation renewal, provide a report to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc411de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10/C/i\"><num value=\"i\">(i)</num><content> summarizing the public comment on the proposed system and the Secretary’s response to such comment; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc411df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/c/10/C/ii\"><num value=\"ii\">(ii)</num><content> describing the final system for designation renewal and the plans for implementation of such system.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc438f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Designation when no entity is renewed</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc438f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If no entity in a community is determined to be successfully delivering a high-quality and comprehensive Head Start program, as specified in subsection (c), the Secretary shall, after conducting an open competition, designate for a 5-year period a Head Start agency from among qualified applicants in such community.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc438f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Considerations for designation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In selecting from among qualified applicants for designation as a Head Start agency, the Secretary shall consider the effectiveness of each such applicant to provide Head Start services, based on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/A\"><num value=\"A\">(A)</num><content> any past performance of such applicant in providing services comparable to Head Start services, including how effectively such applicant provided such comparable services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/B\"><num value=\"B\">(B)</num><content> the plan of such applicant to provide comprehensive health, educational, nutritional, social, and other services needed to aid participating children in attaining their full potential, and to prepare children to succeed in school;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/C\"><num value=\"C\">(C)</num><content> the plan of such applicant to attract and retain qualified staff capable of delivering, including implementing, a high-quality and comprehensive program, including the ability to carry out a research based curriculum aligned with the Head Start Child Outcomes Framework and, as appropriate, State early learning standards;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/D\"><num value=\"D\">(D)</num><content> the ability of such applicant to maintain child-to-teacher ratios and family service worker caseloads that reflect best practices and are tied to high-quality service delivery;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/E\"><num value=\"E\">(E)</num><chapeau> the capacity of such applicant to serve eligible children with—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc438f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/E/i\"><num value=\"i\">(i)</num><content> curricula that are based on scientifically valid research, that are developmentally appropriate, and that promote the school readiness of children participating in the program involved; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc438f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/E/ii\"><num value=\"ii\">(ii)</num><content> teaching practices that are based, as appropriate, on scientifically valid research, that are developmentally appropriate, and that promote the school readiness of children participating in the program involved;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/F\"><num value=\"F\">(F)</num><content> the plan of such applicant to meet standards described in <ref href=\"/us/usc/t42/s9836a/a/1\">section 9836a(a)(1) of this title</ref>, with particular attention to the standards described in subparagraphs (A) and (B) of such section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/G\"><num value=\"G\">(G)</num><content> the proposed budget of the applicant and plan of such applicant to maintain strong fiscal controls and cost-effective fiscal management;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc438fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H\"><num value=\"H\">(H)</num><chapeau> the plan of such applicant to coordinate and collaborate with other public or private entities providing early childhood education and development programs and services for young children in the community involved, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc438fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/i\"><num value=\"i\">(i)</num><content> preschool programs under title I of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s6301\">20 U.S.C. 6301</ref> et seq.);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc438fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/ii\"><num value=\"ii\">(ii)</num><content> programs under section 619 and part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc438ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/iii\"><num value=\"iii\">(iii)</num><content> State prekindergarten programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc43900-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/iv\"><num value=\"iv\">(iv)</num><content> child care programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc43901-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/v\"><num value=\"v\">(v)</num><content> the educational programs that the children in the Head Start program involved will enter at the age of compulsory school attendance; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc43902-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/vi\"><num value=\"vi\">(vi)</num><chapeau> local entities, such as a public or school library, for—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc43903-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/vi/I\"><num value=\"I\">(I)</num><content> conducting reading readiness programs;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc43904-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/vi/II\"><num value=\"II\">(II)</num><content> developing innovative programs to excite children about the world of books, including providing fresh books in the Head Start classroom;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc43905-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/vi/III\"><num value=\"III\">(III)</num><content> assisting in literacy training for Head Start teachers; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc43906-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/H/vi/IV\"><num value=\"IV\">(IV)</num><content> supporting parents and other caregivers in literacy efforts;</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc43907-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/I\"><num value=\"I\">(I)</num><content> the plan of such applicant to coordinate the Head Start program that the applicant proposes to carry out, with public and private entities that are willing to commit resources to assist the Head Start program in meeting its program needs;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc43908-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J\"><num value=\"J\">(J)</num><chapeau> the plan of such applicant—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc43909-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/i\"><num value=\"i\">(i)</num><content> to facilitate the involvement of parents (including grandparents and kinship caregivers, as appropriate) of children participating in the proposed Head Start program, in activities (at home and, if practicable, at the location of the Head Start program) designed to help such parents become full partners in the education of their children;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc4601a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/ii\"><num value=\"ii\">(ii)</num><content> to afford such parents the opportunity to participate in the development and overall conduct of the program at the local level, including transportation assistance, as appropriate;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc4601b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/iii\"><num value=\"iii\">(iii)</num><chapeau> to offer (directly or through referral to local entities, public and school libraries, and entities carrying out family support programs) to such parents—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc4601c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/iii/I\"><num value=\"I\">(I)</num><content> family literacy services; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc4601d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/iii/II\"><num value=\"II\">(II)</num><content> parenting skills training;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc4601e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/iv\"><num value=\"iv\">(iv)</num><content> to offer to parents of participating children substance abuse counseling (either directly or through referral to local entities), if needed, including information on the effect of drug exposure on infants and fetal alcohol syndrome;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc4601f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v\"><num value=\"v\">(v)</num><chapeau> at the option of such applicant, to offer (directly or through referral to local entities) to such parents—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46020-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/I\"><num value=\"I\">(I)</num><content> training in basic child development (including cognitive, social, and emotional development);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46021-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/II\"><num value=\"II\">(II)</num><content> assistance in developing literacy and communication skills;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46022-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/III\"><num value=\"III\">(III)</num><content> opportunities to share experiences with other parents (including parent-mentor relationships);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46023-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/IV\"><num value=\"IV\">(IV)</num><content> regular in-home visitation;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46024-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/V\"><num value=\"V\">(V)</num><content> health services, including information on maternal depression; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46025-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/v/VI\"><num value=\"VI\">(VI)</num><content> any other activity designed to help such parents become full partners in the education of their children;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc46026-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/vi\"><num value=\"vi\">(vi)</num><content> to provide, with respect to each participating family, a family needs assessment that includes consultation with such parents (including foster parents, grandparents, and kinship caregivers, where applicable), in a manner and language that such parents can understand, to the extent practicable, about the benefits of parent involvement and about the activities described in this subparagraph in which such parents may choose to become involved (taking into consideration their specific family needs, work schedules, and other responsibilities); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc46027-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/vii\"><num value=\"vii\">(vii)</num><chapeau> to extend outreach to fathers (including father figures), in appropriate cases, in order to strengthen the role of those fathers in families, in the education of young children, and in the Head Start program, by working directly with the fathers through activities such as—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46028-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/vii/I\"><num value=\"I\">(I)</num><content> in appropriate cases, including the fathers in home visits and providing opportunities for direct father-child interactions; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc46029-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/J/vii/II\"><num value=\"II\">(II)</num><content> targeting increased male participation in the conduct of the program;</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/K\"><num value=\"K\">(K)</num><content> the plan of such applicant to meet the needs of limited English proficient children and their families, including procedures to identify such children, plans to provide trained personnel, and plans to provide services to assist the children in making progress toward the acquisition of the English language, while making meaningful progress in attaining the knowledge, skills, abilities, and development described in <ref href=\"/us/usc/t42/s9836a/a/1/B\">section 9836a(a)(1)(B) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/L\"><num value=\"L\">(L)</num><content> the plan of such applicant to meet the diverse needs of the population served;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/M\"><num value=\"M\">(M)</num><content> the plan of such applicant who chooses to assist younger siblings of children who will participate in the Head Start program to obtain health services from other sources;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/N\"><num value=\"N\">(N)</num><content> the plan of such applicant to meet the needs of children with disabilities, including procedures to identify such children, procedures for referral of such children for evaluation to State or local agencies providing services under section 619 or part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.), and plans for collaboration with those State or local agencies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/O\"><num value=\"O\">(O)</num><content> the plan of such applicant to meet the needs of homeless children, including transportation needs, and the needs of children in foster care; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc4602f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/2/P\"><num value=\"P\">(P)</num><content> other factors related to the requirements of this subchapter.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc46030-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In selecting from among qualified applicants for designation as a Head Start agency, the Secretary shall give priority to applicants that have demonstrated capacity in providing effective, comprehensive, and well-coordinated early childhood education and development services and programs to children and their families.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc48641-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Prohibition against non-Indian Head Start agency receiving a grant for an Indian Head Start program</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc48642-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding any other provision of law, except as provided in paragraph (2), under no condition may a non-Indian Head Start agency receive a grant to carry out an Indian Head Start program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc48643-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In a community in which there is no Indian Head Start agency available for designation to carry out an Indian Head Start program, a non-Indian Head Start agency may receive a grant to carry out an Indian Head Start program but only until such time as an Indian Head Start agency in such community becomes available and is designated pursuant to this section.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc48644-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Interim provider</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If no agency in a community is designated under subsection (d), and there is no qualified applicant in the community, the Secretary shall designate a qualified agency to carry out the Head Start program in the community on an interim basis until a qualified applicant from the community is designated under subsection (d).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc48645-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Parent and community participation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall require that the practice of significantly involving parents and community residents in the area affected by the program involved, in the selection of Head Start agencies, be continued.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc48646-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9836/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Community</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this subchapter, a community may be a city, county, or multicity or multicounty unit within a State, an Indian reservation (including Indians in any off-reservation area designated by an appropriate tribal government in consultation with the Secretary), or a neighborhood or other area (irrespective of boundaries or political subdivisions) that provides a suitable organizational base and possesses the commonality of interest needed to operate a Head Start program.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idacc48647-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/97/35/tVI/s641\">Pub.
