Such an agency shall also be empowered to transfer funds so received, and to delegate powers to other agencies, subject to the powers of its governing board and its overall program responsibilities. The power to transfer funds and delegate powers shall include the power to make transfers and delegations covering component projects in all cases where this will contribute to efficiency and effectiveness or otherwise further program objectives.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc6a9f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Family and community involvement; family services</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be so designated, a Head Start agency shall, at a minimum, do all the following to involve and serve families and communities:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/1\"><num value=\"1\">(1)</num><content> Provide for the regular and direct participation of parents and community residents in the implementation of the Head Start program, including decisions that influence the character of such program, consistent with paragraphs (2)(D) and (3)(C) of subsection (c).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/2\"><num value=\"2\">(2)</num><content> Seek the involvement of parents, community residents, and local business in the design and implementation of the program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/3\"><num value=\"3\">(3)</num><chapeau> Establish effective procedures—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/3/A\"><num value=\"A\">(A)</num><content> to facilitate and seek the involvement of parents of participating children in activities designed to help such parents become full partners in the education of their children; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/3/B\"><num value=\"B\">(B)</num><content> to afford such parents the opportunity to participate in the development and overall conduct of the program at the local level, including transportation assistance as appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/4\"><num value=\"4\">(4)</num><chapeau> Offer (directly or through referral to local entities, public and school libraries, and entities carrying out family support programs) to such parents—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/4/A\"><num value=\"A\">(A)</num><content> family literacy services; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/4/B\"><num value=\"B\">(B)</num><content> parenting skills training.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/5\"><num value=\"5\">(5)</num><content> Offer to parents of participating children substance abuse counseling (either directly or through referral to local entities), if needed, including information on the effect of drug exposure on infants and fetal alcohol syndrome.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6a9fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6\"><num value=\"6\">(6)</num><chapeau> At the option of such agency, offer (directly or through referral to local entities) to such parents—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/A\"><num value=\"A\">(A)</num><content> training in basic child development (including cognitive, social, and emotional development);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6a9ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/B\"><num value=\"B\">(B)</num><content> assistance in developing literacy and communication skills;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6aa00-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/C\"><num value=\"C\">(C)</num><content> opportunities to share experiences with other parents (including parent-mentor relationships);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6aa01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/D\"><num value=\"D\">(D)</num><content> health services, including information on maternal depression;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6aa02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/E\"><num value=\"E\">(E)</num><content> regular in-home visitation; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6aa03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/6/F\"><num value=\"F\">(F)</num><content> any other activity designed to help such parents become full partners in the education of their children.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/7\"><num value=\"7\">(7)</num><content> Provide, with respect to each participating family, a family needs assessment that includes consultation with such parents (including foster parents, grandparents, and kinship caregivers, where applicable), in a manner and language that such parents can understand (to the extent practicable), about the benefits of parent involvement and about the activities described in this subsection in which such parents may choose to be involved (taking into consideration their specific family needs, work schedules, and other responsibilities).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/8\"><num value=\"8\">(8)</num><content> Consider providing services to assist younger siblings of children participating in its Head Start program to obtain health services from other sources.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/9\"><num value=\"9\">(9)</num><content> Perform community outreach to encourage individuals previously unaffiliated with Head Start programs to participate in its Head Start program as volunteers.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/10\"><num value=\"10\">(10)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/10/A\"><num value=\"A\">(A)</num><content> Inform custodial parents in single-parent families that participate in programs, activities, or services carried out or provided under this subchapter about the availability of child support services for purposes of establishing paternity and acquiring child support.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/10/B\"><num value=\"B\">(B)</num><content> Refer eligible parents to the child support offices of State and local governments.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/11\"><num value=\"11\">(11)</num><content> Provide to parents of limited English proficient children outreach and information, in an understandable and uniform format and, to the extent practicable, in a language that the parents can understand.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/12\"><num value=\"12\">(12)</num><content> Provide technical and other support needed to enable parents and community residents to secure, on their own behalf, available assistance from public and private sources.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6aa0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13\"><num value=\"13\">(13)</num><chapeau> Promote the continued involvement of the parents (including foster parents, grandparents, and kinship caregivers, as appropriate) of children that participate in Head Start programs in the education of their children upon transition of their children to school, by working with the local educational agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6f82d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A\"><num value=\"A\">(A)</num><chapeau> to provide training to the parents—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f82e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A/i\"><num value=\"i\">(i)</num><content> to inform the parents about their rights and responsibilities concerning the education of their children; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f82f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A/ii\"><num value=\"ii\">(ii)</num><chapeau> to enable the parents—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc6f830-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A/ii/I\"><num value=\"I\">(I)</num><content> to understand and work with schools in order to communicate with teachers and other school personnel;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc6f831-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A/ii/II\"><num value=\"II\">(II)</num><content> to support the schoolwork of their children; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc6f832-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/A/ii/III\"><num value=\"III\">(III)</num><content> to participate as appropriate in decisions relating to the education of their children; and</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc6f833-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/13/B\"><num value=\"B\">(B)</num><content> to take other actions, as appropriate and feasible, to support the active involvement of the parents with schools, school personnel, and school-related organizations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6f834-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/14\"><num value=\"14\">(14)</num><content> Establish effective procedures for timely referral of children with disabilities to the State or local agency providing services under section 619 or part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.), and collaboration with that agency, consistent with <ref href=\"/us/usc/t42/s9835/d/3\">section 9835(d)(3) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6f835-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/15\"><num value=\"15\">(15)</num><content> Establish effective procedures for providing necessary early intervening services to children with disabilities prior to an eligibility determination by the State or local agency responsible for providing services under section 619 or part C of such Act, consistent with <ref href=\"/us/usc/t42/s9835/d/2\">section 9835(d)(2) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc6f836-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/b/16\"><num value=\"16\">(16)</num><content> At the option of the Head Start agency, partner with an institution of higher education and a nonprofit organization to provide college students with the opportunity to serve as mentors or reading partners for Head Start participants.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc6f837-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Program governance</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Upon receiving designation as a Head Start agency, the agency shall establish and maintain a formal structure for program governance, for the oversight of quality services for Head Start children and families and for making decisions related to program design and implementation. Such structure shall include the following:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc6f838-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Governing body</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc6f839-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The governing body shall have legal and fiscal responsibility for the Head Start agency.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc6f83a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Composition</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The governing body shall be composed as follows:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f83b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/i\"><num value=\"i\">(i)</num><content> Not less than 1 member shall have a background and expertise in fiscal management or accounting.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f83c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/ii\"><num value=\"ii\">(ii)</num><content> Not less than 1 member shall have a background and expertise in early childhood education and development.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f83d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/iii\"><num value=\"iii\">(iii)</num><content> Not less than 1 member shall be a licensed attorney familiar with issues that come before the governing body.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f83e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/iv\"><num value=\"iv\">(iv)</num><chapeau> Additional members shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc6f83f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/iv/I\"><num value=\"I\">(I)</num><content> reflect the community to be served and include parents of children who are currently, or were formerly, enrolled in Head Start programs; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc6f840-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/iv/II\"><num value=\"II\">(II)</num><content> are selected for their expertise in education, business administration, or community affairs.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f841-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/v\"><num value=\"v\">(v)</num><content> Exceptions shall be made to the requirements of clauses (i) through (iv) for members of a governing body when those members oversee a public entity and are selected to their positions with the public entity by public election or political appointment.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f842-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/B/vi\"><num value=\"vi\">(vi)</num><content> If a person described in clause (i), (ii), or (iii) is not available to serve as a member of the governing body, the governing body shall use a consultant, or an other individual with relevant expertise, with the qualifications described in that clause, who shall work directly with the governing body.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc6f843-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Conflict of interest</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Members of the governing body shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f844-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/C/i\"><num value=\"i\">(i)</num><content> not have a financial conflict of interest with the Head Start agency (including any delegate agency);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f845-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/C/ii\"><num value=\"ii\">(ii)</num><content> not receive compensation for serving on the governing body or for providing services to the Head Start agency;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc6f846-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/C/iii\"><num value=\"iii\">(iii)</num><content> not be employed, nor shall members of their immediate family be employed, by the Head Start agency (including any delegate agency); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e57-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/C/iv\"><num value=\"iv\">(iv)</num><content> operate as an entity independent of staff employed by the Head Start agency.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc71e58-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Exception</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If an individual holds a position as a result of public election or political appointment, and such position carries with it a concurrent appointment to serve as a member of a Head Start agency governing body, and such individual has any conflict of interest described in clause (ii) or (iii) of subparagraph (C)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e59-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/D/i\"><num value=\"i\">(i)</num><content> such individual shall not be prohibited from serving on such body and the Head Start agency shall report such conflict to the Secretary; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e5a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/D/ii\"><num value=\"ii\">(ii)</num><content> if the position held as a result of public election or political appointment provides compensation, such individual shall not be prohibited from receiving such compensation.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc71e5b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Responsibilities</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The governing body shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e5c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/i\"><num value=\"i\">(i)</num><content> have legal and fiscal responsibility for administering and overseeing programs under this subchapter, including the safeguarding of Federal funds;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e5d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/ii\"><num value=\"ii\">(ii)</num><content> adopt practices that assure active, independent, and informed governance of the Head Start agency, including practices consistent with subsection (d)(1), and fully participate in the development, planning, and evaluation of the Head Start programs involved;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e5e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iii\"><num value=\"iii\">(iii)</num><content> be responsible for ensuring compliance with Federal laws (including regulations) and applicable State, tribal, and local laws (including regulations); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc71e5f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv\"><num value=\"iv\">(iv)</num><chapeau> be responsible for other activities, including—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e60-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/I\"><num value=\"I\">(I)</num><content> selecting delegate agencies and the service areas for such agencies;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e61-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/II\"><num value=\"II\">(II)</num><content> establishing procedures and criteria for recruitment, selection, and enrollment of children;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e62-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/III\"><num value=\"III\">(III)</num><content> reviewing all applications for funding and amendments to applications for funding for programs under this subchapter;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e63-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/IV\"><num value=\"IV\">(IV)</num><content> establishing procedures and guidelines for accessing and collecting information described in subsection (d)(2);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e64-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/V\"><num value=\"V\">(V)</num><chapeau> reviewing and approving all major policies of the agency, including—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e65-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/V/aa\"><num value=\"aa\">(aa)</num><content> the annual self-assessment and financial audit;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e66-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/V/bb\"><num value=\"bb\">(bb)</num><content> such agency’s progress in carrying out the programmatic and fiscal provisions in such agency’s grant application, including implementation of corrective actions; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e67-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/V/cc\"><num value=\"cc\">(cc)</num><content> personnel policies of such agencies regarding the hiring, evaluation, termination, and compensation of agency employees;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e68-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VI\"><num value=\"VI\">(VI)</num><content> developing procedures for how members of the policy council are selected, consistent with paragraph (2)(B);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e69-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VII\"><num value=\"VII\">(VII)</num><chapeau> approving financial management, accounting, and reporting policies, and compliance with laws and regulations related to financial statements, including the—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e6a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VII/aa\"><num value=\"aa\">(aa)</num><content> approval of all major financial expenditures of the agency;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e6b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VII/bb\"><num value=\"bb\">(bb)</num><content> annual approval of the operating budget of the agency;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e6c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VII/cc\"><num value=\"cc\">(cc)</num><content> selection (except when a financial auditor is assigned by the State under State law or is assigned under local law) of independent financial auditors who shall report all critical accounting policies and practices to the governing body; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc71e6d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VII/dd\"><num value=\"dd\">(dd)</num><content> monitoring of the agency’s actions to correct any audit findings and of other action necessary to comply with applicable laws (including regulations) governing financial statement and accounting practices;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/VIII\"><num value=\"VIII\">(VIII)</num><content> reviewing results from monitoring conducted under <ref href=\"/us/usc/t42/s9836a/c\">section 9836a(c) of this title</ref>, including appropriate followup activities;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/IX\"><num value=\"IX\">(IX)</num><content> approving personnel policies and procedures, including policies and procedures regarding the hiring, evaluation, compensation, and termination of the Executive Director, Head Start Director, Director of Human Resources, Chief Fiscal Officer, and any other person in an equivalent position with the agency;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc71e70-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/X\"><num value=\"X\">(X)</num><chapeau> establishing, adopting, and periodically updating written standards of conduct that establish standards and formal procedures for disclosing, addressing, and resolving—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc74581-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/X/aa\"><num value=\"aa\">(aa)</num><content> any conflict of interest, and any appearance of a conflict of interest, by members of the governing body, officers and employees of the Head Start agency, and consultants and agents who provide services or furnish goods to the Head Start agency; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacc74582-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/X/bb\"><num value=\"bb\">(bb)</num><content> complaints, including investigations, when appropriate; and</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc74583-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/1/E/iv/XI\"><num value=\"XI\">(XI)</num><content> to the extent practicable and appropriate, at the discretion of the governing body, establishing advisory committees to oversee key responsibilities related to program governance and improvement of the Head Start program involved.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc74584-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Policy council</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc74585-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Consistent with paragraph (1)(E), each Head Start agency shall have a policy council responsible for the direction of the Head Start program, including program design and operation, and long- and short-term planning goals and objectives, taking into account the annual communitywide strategic planning and needs assessment and self-assessment.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc74586-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Composition and selection</heading><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74587-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/B/i\"><num value=\"i\">(i)</num><content> The policy council shall be elected by the parents of children who are currently enrolled in the Head Start program of the Head Start agency.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74588-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/B/ii\"><num value=\"ii\">(ii)</num><chapeau> The policy council shall be composed of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc74589-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/B/ii/I\"><num value=\"I\">(I)</num><content> parents of children who are currently enrolled in the Head Start program of the Head Start agency (including any delegate agency), who shall constitute a majority of the members of the policy council; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacc7458a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/B/ii/II\"><num value=\"II\">(II)</num><content> members at large of the community served by the Head Start agency (including any delegate agency), who may include parents of children who were formerly enrolled in the Head Start program of the agency.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc7458b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Conflict of interest</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Members of the policy council shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc7458c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/C/i\"><num value=\"i\">(i)</num><content> not have a conflict of interest with the Head Start agency (including any delegate agency); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc7458d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/C/ii\"><num value=\"ii\">(ii)</num><content> not receive compensation for serving on the policy council or for providing services to the Head Start agency.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacc7458e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Responsibilities</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The policy council shall approve and submit to the governing body decisions about each of the following activities:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc7458f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/i\"><num value=\"i\">(i)</num><content> Activities to support the active involvement of parents in supporting program operations, including policies to ensure that the Head Start agency is responsive to community and parent needs.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74590-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/ii\"><num value=\"ii\">(ii)</num><content> Program recruitment, selection, and enrollment priorities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74591-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/iii\"><num value=\"iii\">(iii)</num><content> Applications for funding and amendments to applications for funding for programs under this subchapter, prior to submission of applications described in this clause.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74592-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/iv\"><num value=\"iv\">(iv)</num><content> Budget planning for program expenditures, including policies for reimbursement and participation in policy council activities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74593-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/v\"><num value=\"v\">(v)</num><content> Bylaws for the operation of the policy council.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74594-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/vi\"><num value=\"vi\">(vi)</num><content> Program personnel policies and decisions regarding the employment of program staff, consistent with paragraph (1)(E)(iv)(IX), including standards of conduct for program staff, contractors, and volunteers and criteria for the employment and dismissal of program staff.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74595-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/vii\"><num value=\"vii\">(vii)</num><content> Developing procedures for how members of the policy council of the Head Start agency will be elected.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc74596-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/2/D/viii\"><num value=\"viii\">(viii)</num><content> Recommendations on the selection of delegate agencies and the service areas for such agencies.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc74597-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Policy committees</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each delegate agency shall create a policy committee, which shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc74598-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/3/A\"><num value=\"A\">(A)</num><content> be elected and composed of members, consistent with paragraph (2)(B) (with respect to delegate agencies);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc74599-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/3/B\"><num value=\"B\">(B)</num><content> follow procedures to prohibit conflict of interest, consistent with clauses (i) and (ii) of paragraph (2)(C) (with respect to delegate agencies); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc7459a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/c/3/C\"><num value=\"C\">(C)</num><content> be responsible for approval and submission of decisions about activities as they relate to the delegate agency, consistent with paragraph (2)(D) (with respect to delegate agencies).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc7459b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Program governance administration</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc76cac-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Impasse policies</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall develop policies, procedures, and guidance for Head Start agencies concerning—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cad-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/1/A\"><num value=\"A\">(A)</num><content> the resolution of internal disputes, including any impasse in the governance of Head Start programs; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/1/B\"><num value=\"B\">(B)</num><content> the facilitation of meaningful consultation and collaboration about decisions of the governing body and policy council.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc76caf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Conduct of responsibilities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each Head Start agency shall ensure the sharing of accurate and regular information for use by the governing body and the policy council, about program planning, policies, and Head Start agency operations, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/A\"><num value=\"A\">(A)</num><content> monthly financial statements, including credit card expenditures;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/B\"><num value=\"B\">(B)</num><content> monthly program information summaries;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/C\"><num value=\"C\">(C)</num><content> program enrollment reports, including attendance reports for children whose care is partially subsidized by another public agency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/D\"><num value=\"D\">(D)</num><content> monthly reports of meals and snacks provided through programs of the Department of Agriculture;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/E\"><num value=\"E\">(E)</num><content> the financial audit;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/F\"><num value=\"F\">(F)</num><content> the annual self-assessment, including any findings related to such assessment;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/G\"><num value=\"G\">(G)</num><content> the communitywide strategic planning and needs assessment of the Head Start agency, including any applicable updates;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/H\"><num value=\"H\">(H)</num><content> communication and guidance from the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cb8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/2/I\"><num value=\"I\">(I)</num><content> the program information reports.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacc76cb9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Training and technical assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Appropriate training and technical assistance shall be provided to the members of the governing body and the policy council to ensure that the members understand the information the members receive and can effectively oversee and participate in the programs of the Head Start agency.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc76cba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Collaboration and coordination</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be so designated, a Head Start agency shall collaborate and coordinate with public and private entities, to the maximum extent practicable, to improve the availability and quality of services to Head Start children and families, including carrying out the following activities:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cbb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/1\"><num value=\"1\">(1)</num><content> Conduct outreach to schools in which children participating in the Head Start program will enroll following the program, local educational agencies, the local business community, community-based organizations, faith-based organizations, museums, and libraries to generate support and leverage the resources of the entire local community in order to improve school readiness.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cbc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cbd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2/A\"><num value=\"A\">(A)</num><content> In communities where both a public prekindergarten program and a Head Start program operate, collaborate and coordinate activities with the local educational agency or other public agency responsible for the operation of the prekindergarten program and providers of prekindergarten, including outreach activities to identify eligible children.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cbe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2/B\"><num value=\"B\">(B)</num><chapeau> With the permission of the parents of children enrolled in the Head Start program, regularly communicate with the schools in which the children will enroll following the program, to—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cbf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2/B/i\"><num value=\"i\">(i)</num><content> share information about such children;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cc0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> collaborate with the teachers in such schools regarding professional development and instructional strategies, as appropriate; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc76cc1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/2/B/iii\"><num value=\"iii\">(iii)</num><content> ensure a smooth transition to school for such children.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cc2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/3\"><num value=\"3\">(3)</num><content> Coordinate activities and collaborate with programs under the Child Care and Development Block Grant Act of 1990 [<ref href=\"/us/usc/t42/s9857\">42 U.S.C. 9857</ref> et seq.], the agencies responsible for administering <ref href=\"/us/usc/t42/s5106a\">section 5106a of this title</ref> and parts B and E of title IV of the Social Security Act [<ref href=\"/us/usc/t42/s620\">42 U.S.C. 620</ref> et seq., 670 et seq.], programs under subtitle B of title VII of the McKinney-Vento Homeless Assistance Act (<ref href=\"/us/usc/t42/s11431\">42 U.S.C. 11431</ref> et seq.), programs under section 619 and part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.), and other entities providing early childhood education and development programs or services, serving the children and families served by the Head Start agency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc76cc3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/4\"><num value=\"4\">(4)</num><chapeau> Take steps to coordinate activities with the local educational agency serving the community involved and with schools in which children participating in the Head Start program will enroll following the program, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793d4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/4/A\"><num value=\"A\">(A)</num><content> collaborating on the shared use of transportation and facilities, in appropriate cases;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793d5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/4/B\"><num value=\"B\">(B)</num><content> collaborating to reduce the duplication and enhance the efficiency of services while increasing the program participation of underserved populations of eligible children; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793d6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/4/C\"><num value=\"C\">(C)</num><content> exchanging information on the provision of noneducational services to such children.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc793d7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5\"><num value=\"5\">(5)</num><chapeau> Enter into a memorandum of understanding, not later than 1 year after <date date=\"2007-12-12\">December 12, 2007</date>, with the appropriate local entity responsible for managing publicly funded preschool programs in the service area of the Head Start agency, that shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793d8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/i\"><num value=\"i\">(i)</num><content> provide for a review of each of the activities described in clause (ii); and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii\"><num value=\"ii\">(ii)</num><chapeau> include plans to coordinate, as appropriate, activities regarding—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/I\"><num value=\"I\">(I)</num><content> educational activities, curricular objectives, and instruction;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/II\"><num value=\"II\">(II)</num><content> public information dissemination and access to programs for families contacting the Head Start program or any of the preschool programs;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/III\"><num value=\"III\">(III)</num><content> selection priorities for eligible children to be served by programs;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/IV\"><num value=\"IV\">(IV)</num><content> service areas;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/V\"><num value=\"V\">(V)</num><content> staff training, including opportunities for joint staff training on topics such as academic content standards, instructional methods, curricula, and social and emotional development;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/VI\"><num value=\"VI\">(VI)</num><content> program technical assistance;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/VII\"><num value=\"VII\">(VII)</num><content> provision of additional services to meet the needs of working parents, as applicable;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/VIII\"><num value=\"VIII\">(VIII)</num><content> communications and parent outreach for smooth transitions to kindergarten as required in paragraphs (3) and (6) of <ref href=\"/us/usc/t42/s9837a/a\">section 9837a(a) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/IX\"><num value=\"IX\">(IX)</num><content> provision and use of facilities, transportation, and other program elements; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/A/ii/X\"><num value=\"X\">(X)</num><content> other elements mutually agreed to by the parties to such memorandum;</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/B\"><num value=\"B\">(B)</num><chapeau> be submitted to the Secretary and the State Director of Head Start Collaboration not later than 30 days after the parties enter into such memorandum, except that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/B/i\"><num value=\"i\">(i)</num><content> where there is an absence of publicly funded preschool programs in the service area of a Head Start agency, this paragraph shall not apply; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacc793e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/B/ii\"><num value=\"ii\">(ii)</num><content> where the appropriate local entity responsible for managing the publicly funded preschool programs is unable or unwilling to enter into such a memorandum, this paragraph shall not apply and the Head Start agency shall inform the Secretary and the State Director of Head Start Collaboration of such inability or unwillingness; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/e/5/C\"><num value=\"C\">(C)</num><content> be revised periodically and renewed biennially by the parties to such memorandum, in alignment with the beginning of the school year.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc793e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Quality standards, curricula, and assessment</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be so designated, each Head Start agency shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc793ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/1\"><num value=\"1\">(1)</num><content> take steps to ensure, to the maximum extent practicable, that children maintain the developmental and educational gains achieved in Head Start programs and build upon such gains in further schooling;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc793eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/2\"><num value=\"2\">(2)</num><content> establish a program with the standards set forth in <ref href=\"/us/usc/t42/s9836a/a/1\">section 9836a(a)(1) of this title</ref>, with particular attention to the standards set forth in subparagraphs (A) and (B) of such section;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc793ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3\"><num value=\"3\">(3)</num><chapeau> implement a research-based early childhood curriculum that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3/A\"><num value=\"A\">(A)</num><content> promotes young children’s school readiness in the areas of language and cognitive development, early reading and mathematics skills, socio-emotional development, physical development, and approaches to learning;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3/B\"><num value=\"B\">(B)</num><content> is based on scientifically valid research and has standardized training procedures and curriculum materials to support implementation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3/C\"><num value=\"C\">(C)</num><content> is comprehensive and linked to ongoing assessment, with developmental and learning goals and measurable objectives;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc793f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3/D\"><num value=\"D\">(D)</num><content> is focused on improving the learning environment, teaching practices, family involvement, and child outcomes across all areas of development; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacc7bb01-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/3/E\"><num value=\"E\">(E)</num><content> is aligned with the Head Start Child Outcomes Framework developed by the Secretary and, as appropriate, State early learning standards;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb02-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/4\"><num value=\"4\">(4)</num><content> implement effective interventions and support services that help promote the school readiness of children participating in the program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb03-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/5\"><num value=\"5\">(5)</num><content> use research-based assessment methods that reflect the characteristics described in <ref href=\"/us/usc/t42/s9836a/b/2\">section 9836a(b)(2) of this title</ref> in order to support the educational instruction and school readiness of children in the program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb04-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/6\"><num value=\"6\">(6)</num><content> use research-based developmental screening tools that have been demonstrated to be standardized, reliable, valid, and accurate for the child being assessed, to the maximum extent practicable, for the purpose of meeting the relevant standards described in <ref href=\"/us/usc/t42/s9836a/a/1\">section 9836a(a)(1) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb05-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/7\"><num value=\"7\">(7)</num><content> adopt, in consultation with experts in child development and with classroom teachers, an evaluation to assess whether classroom teachers have mastered the functions discussed in <ref href=\"/us/usc/t42/s9843a/a/1\">section 9843a(a)(1) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/8\"><num value=\"8\">(8)</num><content> use the information provided from the assessment conducted under <ref href=\"/us/usc/t42/s9836a/c/2/F\">section 9836a(c)(2)(F) of this title</ref> to inform professional development plans, as appropriate, that lead to improved teacher effectiveness;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/9\"><num value=\"9\">(9)</num><content> establish goals and measurable objectives for the provision of health, educational, nutritional, and social services provided under this subchapter and related to the program mission and to promote school readiness; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idacc7bb08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/f/10\"><num value=\"10\">(10)</num><content> develop procedures for identifying children who are limited English proficient, and informing the parents of such children about the instructional services used to help children make progress towards acquiring the knowledge and skills described in <ref href=\"/us/usc/t42/s9836a/a/1/B\">section 9836a(a)(1)(B) of this title</ref> and acquisition of the English language.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc7bb09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Funded enrollment; waiting list</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each Head Start agency shall enroll 100 percent of its funded enrollment and maintain an active waiting list at all times with ongoing outreach to the community and activities to identify underserved populations.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idacc7bb0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9837/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Technical assistance and training plan</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In order to receive funds under this subchapter, a Head Start agency shall develop an annual technical assistance and training plan.
