<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaccb3dab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841"><num value="9841">§ 9841.</num><heading> Appeals, notice, hearing, and mediation; alternative agency for Indian tribe</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccb3dac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a"><num value="a" class="bold">(a)</num><heading class="bold"> Notice requirements; suspension or termination of assistance stayed pending hearing; mediation</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall prescribe—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3dad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/1"><num value="1">(1)</num><content> procedures to assure that special notice of and an opportunity for a timely and expeditious appeal to the Secretary will be provided for an agency or organization which desires to serve as a delegate agency under this subchapter and whose application to the Head Start agency has been wholly or substantially rejected or has not been acted upon within a period of time deemed reasonable by the Secretary, in accordance with regulations which the Secretary shall prescribe;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3dae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/2"><num value="2">(2)</num><content> procedures to assure that financial assistance under this subchapter shall not be suspended, except in emergency situations, unless the recipient agency has been given reasonable notice and opportunity to show cause why such action should not be taken;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3daf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/3"><num value="3">(3)</num><chapeau> procedures to assure that financial assistance under this subchapter may be terminated or reduced, and an application for refunding may be denied, after the recipient has been afforded reasonable notice and opportunity for a full and fair hearing, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/3/A"><num value="A">(A)</num><content> a right to file a notice of appeal of a decision not later than 30 days after notice of the decision from the Secretary; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/3/B"><num value="B">(B)</num><content> access to a full and fair hearing of the appeal, not later than 120 days after receipt by the Secretary of the notice of appeal;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3db2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4"><num value="4">(4)</num><chapeau> procedures (including mediation procedures) are developed and published, to be used in order to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4/A"><num value="A">(A)</num><chapeau> resolve in a timely manner conflicts potentially leading to an adverse action between—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idaccb3db4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4/A/i"><num value="i">(i)</num><content> recipients of financial assistance under this subchapter; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idaccb3db5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4/A/ii"><num value="ii">(ii)</num><content> delegate agencies, or policy councils of Head Start agencies;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4/B"><num value="B">(B)</num><content> avoid the need for an administrative hearing on an adverse action; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/4/C"><num value="C">(C)</num><content> prohibit a Head Start agency from expending financial assistance awarded under this subchapter for the purpose of paying legal fees, or other costs incurred, pursuant to an appeal under paragraph (3);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3db8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/5"><num value="5">(5)</num><chapeau> procedures to assure that the Secretary may suspend financial assistance to a recipient under this subchapter—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3db9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/5/A"><num value="A">(A)</num><content> except as provided in subparagraph (B), for not more than 30 days; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaccb3dba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/5/B"><num value="B">(B)</num><content> in the case of a recipient under this subchapter that has multiple and recurring deficiencies for 180 days or more and has not made substantial and significant progress toward meeting the goals of the grantee’s quality improvement plan or eliminating all deficiencies identified by the Secretary, during the hearing of an appeal described in paragraph (3), for any amount of time; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3dbb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/a/6"><num value="6">(6)</num><content> procedures to assure that in cases where a Head Start agency prevails in a decision under paragraph (4), the Secretary may determine and provide a reimbursement to the Head Start agency for fees deemed reasonable and customary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccb3dbc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/b"><num value="b" class="bold">(b)</num><heading class="bold"> Notification of conflict by Head Start agency to regional office</heading><chapeau style="-uslm-lc:I11" class="indent0">In prescribing procedures for the mediation described in subsection (a)(4), the Secretary shall specify—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaccb3dbd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/b/1"><num value="1">(1)</num><content> the date by which a Head Start agency engaged in a conflict described in subsection (a)(4) will notify the appropriate regional office of the Department of the conflict; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb64ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/b/2"><num value="2">(2)</num><content> a reasonable period for the mediation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccb64cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/c"><num value="c" class="bold">(c)</num><heading class="bold"> Timeline for administrative hearing</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall also specify—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaccb64d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/c/1"><num value="1">(1)</num><content> a timeline for an administrative hearing, if necessary, on an adverse action; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccb64d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/c/2"><num value="2">(2)</num><content> a timeline by which the person conducting the administrative hearing shall issue a decision based on the hearing.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccb64d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/d"><num value="d" class="bold">(d)</num><heading class="bold"> Termination of designation not stayed upon appeal</heading><content><p style="-uslm-lc:I11" class="indent0">In any case in which a termination, reduction, or suspension of financial assistance under this subchapter is upheld in an administrative hearing under this section, such termination, reduction, or suspension shall not be stayed pending any judicial appeal of such administrative decision.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccb64d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e"><num value="e" class="bold">(e)</num><heading class="bold"> Establishment of alternative agency by Indian tribe</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idaccb64d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/1"><num value="1">(1)</num><chapeau> The Secretary shall by regulation specify a process by which an Indian tribe may identify and establish an alternative agency, and request that the alternative agency be designated under <ref href="/us/usc/t42/s9836">section 9836 of this title</ref> as the Head Start agency providing services to the tribe, if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaccb64d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/1/A"><num value="A">(A)</num><content> the Secretary terminates financial assistance under this section to the only agency that was receiving financial assistance to provide Head Start services to the Indian tribe; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaccb64d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/1/B"><num value="B">(B)</num><content> the tribe would otherwise be precluded from providing such services to the members of the tribe.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaccb64d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/2"><num value="2">(2)</num><chapeau> The regulation required by this subsection shall prohibit such designation of an alternative agency that includes an employee who—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idaccb64d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/2/A"><num value="A">(A)</num><content> served on the administrative staff or program staff of the agency described in paragraph (1)(A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaccb64d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/2/B"><num value="B">(B)</num><chapeau> was responsible for a deficiency that—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idaccb64da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/2/B/i"><num value="i">(i)</num><content> relates to the performance standards or financial management standards described in <ref href="/us/usc/t42/s9836a/a/1">section 9836a(a)(1) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaccb64db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9841/e/2/B/ii"><num value="ii">(ii)</num><content> was the basis for the termination of financial assistance described in paragraph (1)(A);</content>
