L. 110–134, § 19, Dec. 12, 2007, 121 Stat. 1430.)","seq_in_title":5942,"parent_identifier":"/us/usc/t42/ch105/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch105","level":"chapter","num":"CHAPTER 105—","heading":"COMMUNITY SERVICES PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch105/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"HEAD START PROGRAMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idaccc9cd5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a\"><num value=\"9843a\">§ 9843a.</num><heading> Staff qualifications and development</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccc9cd6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Classroom teachers</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccc9cd7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Professional requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall ensure that each Head Start classroom in a center-based program is assigned 1 teacher who has demonstrated competency to perform functions that include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccc9cd8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/1/A\"><num value=\"A\">(A)</num><content> planning and implementing learning experiences that advance the intellectual and physical development of children, including improving the readiness of children for school by developing their literacy, phonemic, and print awareness, their understanding and use of language, their understanding and use of increasingly complex and varied vocabulary, their appreciation of books, their understanding of early math and early science, their problem-solving abilities, and their approaches to learning;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacccc3e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/1/B\"><num value=\"B\">(B)</num><content> establishing and maintaining a safe, healthy learning environment;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacccc3ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/1/C\"><num value=\"C\">(C)</num><content> supporting the social and emotional development of children; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacccc3eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/1/D\"><num value=\"D\">(D)</num><content> encouraging the involvement of the families of the children in a Head Start program and supporting the development of relationships between children and their families.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacccc3ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Degree requirements</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacccc3ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Head Start teachers</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that not later than <date date=\"2013-09-30\">September 30, 2013</date>, at least 50 percent of Head Start teachers nationwide in center-based programs have—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc3ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/A/i\"><num value=\"i\">(i)</num><content> a baccalaureate or advanced degree in early childhood education; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc3ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/A/ii\"><num value=\"ii\">(ii)</num><content> a baccalaureate or advanced degree and coursework equivalent to a major relating to early childhood education, with experience teaching preschool-age children.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacccc3f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Additional staff</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that, not later than <date date=\"2013-09-30\">September 30, 2013</date>, all—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc3f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/i\"><num value=\"i\">(i)</num><chapeau> Head Start education coordinators, including those that serve as curriculum specialists, nationwide in center-based programs—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/i/I\"><num value=\"I\">(I)</num><content> have the capacity to offer assistance to other teachers in the implementation and adaptation of curricula to the group and individual needs of children in a Head Start classroom; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/i/II\"><num value=\"II\">(II)</num><chapeau> have—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacccc3f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/i/II/aa\"><num value=\"aa\">(aa)</num><content> a baccalaureate or advanced degree in early childhood education; or</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacccc3f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/i/II/bb\"><num value=\"bb\">(bb)</num><content> a baccalaureate or advanced degree and coursework equivalent to a major relating to early childhood education, with experience teaching preschool-age children; and</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc3f6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/ii\"><num value=\"ii\">(ii)</num><chapeau> Head Start teaching assistants nationwide in center-based programs have—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3f7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/ii/I\"><num value=\"I\">(I)</num><content> at least a child development associate credential;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3f8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/ii/II\"><num value=\"II\">(II)</num><content> enrolled in a program leading to an associate or baccalaureate degree; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3f9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/B/ii/III\"><num value=\"III\">(III)</num><content> enrolled in a child development associate credential program to be completed within 2 years.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacccc3fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Progress</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idacccc3fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Implementation</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i/I\"><num value=\"I\">(I)</num><chapeau> require Head Start agencies to—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacccc3fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i/I/aa\"><num value=\"aa\">(aa)</num><content> describe continuing progress each year toward achieving the goals described in subparagraphs (A) and (B); and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idacccc3fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i/I/bb\"><num value=\"bb\">(bb)</num><content> annually submit to the Secretary a report indicating the number and percentage of classroom personnel described in subparagraphs (A) and (B) in center-based programs with child development associate credentials or associate, baccalaureate, or advanced degrees;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc3ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i/II\"><num value=\"II\">(II)</num><content> compile and submit a summary of all program reports described in subclause (I)(bb) to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idacccc400-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/C/i/III\"><num value=\"III\">(III)</num><content> not impose any penalties or sanctions on any individual Head Start agency, program, or staff in the monitoring of local agencies and programs under this subchapter not meeting the requirements of subparagraph (A) or (B).</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idacccc401-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In this paragraph a reference to a Head Start agency, or its program, services, facility, or personnel, shall not be considered to be a reference to an Early Head Start agency, or its program, services, facility, or personnel.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idacccc402-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Alternative credentialing and degree requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall ensure that, for center-based programs, each Head Start classroom that does not have a teacher who meets the qualifications described in clause (i) or (ii) of paragraph (2)(A) is assigned one teacher who has the following during the period specified:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idacccc403-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A\"><num value=\"A\">(A)</num><chapeau> Through <date date=\"2011-09-30\">September 30, 2011</date>—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc404-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A/i\"><num value=\"i\">(i)</num><content> a child development associate credential that is appropriate to the age of children being served in center-based programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idacccc405-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> a State-awarded certificate for preschool teachers that meets or exceeds the requirements for a child development associate credential;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb16-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A/iii\"><num value=\"iii\">(iii)</num><content> an associate degree in early childhood education;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb17-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A/iv\"><num value=\"iv\">(iv)</num><content> an associate degree in a related field and coursework equivalent to a major relating to early childhood education, with experience teaching preschool-age children; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb18-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/A/v\"><num value=\"v\">(v)</num><content> a baccalaureate degree and has been admitted into the Teach For America program, passed a rigorous early childhood content exam, such as the Praxis II, participated in a Teach For America summer training institute that includes teaching preschool children, and is receiving ongoing professional development and support from Teach For America’s professional staff.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccceb19-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/B\"><num value=\"B\">(B)</num><chapeau> As of <date date=\"2011-10-01\">October 1, 2011</date>—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/B/i\"><num value=\"i\">(i)</num><content> an associate degree in early childhood education;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/B/ii\"><num value=\"ii\">(ii)</num><content> an associate degree in a related field and coursework equivalent to a major relating to early childhood education, with experience teaching preschool-age children; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/3/B/iii\"><num value=\"iii\">(iii)</num><content> a baccalaureate degree and has been admitted into the Teach For America program, passed a rigorous early childhood content exam, such as the Praxis II, participated in a Teach For America summer training institute that includes teaching preschool children, and is receiving ongoing professional development and support from Teach For America’s professional staff.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccceb1d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Waiver</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">On request, the Secretary shall grant—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccceb1e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/A\"><num value=\"A\">(A)</num><chapeau> through <date date=\"2011-09-30\">September 30, 2011</date>, a 180-day waiver ending on or before <date date=\"2011-09-30\">September 30, 2011</date>, of the requirements of paragraph (3)(A) for a Head Start agency that can demonstrate that the agency has attempted unsuccessfully to recruit an individual who has the qualifications described in any of clauses (i) through (iv) of paragraph (3)(A) with respect to an individual who—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb1f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/A/i\"><num value=\"i\">(i)</num><content> is enrolled in a program that grants a credential, certificate, or degree described in clauses (i) through (iv) of paragraph (3)(A); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb20-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/A/ii\"><num value=\"ii\">(ii)</num><content> will receive such credential, certificate, or degree under the terms of such program not later than 180 days after beginning employment as a teacher with such agency; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccceb21-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/B\"><num value=\"B\">(B)</num><chapeau> as of <date date=\"2011-10-01\">October 1, 2011</date>, a 3-year waiver of the requirements of paragraph (3)(B) for a Head Start agency that can demonstrate that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb22-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/B/i\"><num value=\"i\">(i)</num><content> the agency has attempted unsuccessfully to recruit an individual who has the qualifications described in clause (i) or (ii) of such paragraph, with respect to an individual who is enrolled in a program that grants a degree described in clause (i) or (ii) of such paragraph and will receive such degree in a reasonable time; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccceb23-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/B/ii\"><num value=\"ii\">(ii)</num><chapeau> each Head Start classroom has a teacher who has, at a minimum—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaccceb24-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/B/ii/I\"><num value=\"I\">(I)</num><content> a child development associate credential that is appropriate to the age of children being served in center-based programs; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idaccceb25-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/4/B/ii/II\"><num value=\"II\">(II)</num><content> a State-awarded certificate for preschool teachers that meets or exceeds the requirements for a child development associate credential.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccceb26-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Teacher in-service requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each Head Start teacher shall attend not less than 15 clock hours of professional development per year. Such professional development shall be high-quality, sustained, intensive, and classroom-focused in order to have a positive and lasting impact on classroom instruction and the teacher’s performance in the classroom, and regularly evaluated by the program for effectiveness.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccceb27-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Service requirements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall establish requirements to ensure that, in order to enable Head Start agencies to comply with the requirements of paragraph (2)(A), individuals who receive financial assistance under this subchapter to pursue a degree described in paragraph (2)(A) shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccceb28-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/6/A\"><num value=\"A\">(A)</num><content> teach or work in a Head Start program for a minimum of 3 years after receiving the degree; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccceb29-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/6/B\"><num value=\"B\">(B)</num><content> repay the total or a prorated amount of the financial assistance received based on the length of service completed after receiving the degree.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd123a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/a/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Use of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall require that any Federal funds provided directly or indirectly to comply with paragraph (2)(A) shall be used toward degrees awarded by an institution of higher education, as defined by section 1001 or 1002 of title 20.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd123b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Mentor teachers</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd123c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> “Mentor teacher” defined; function</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this subsection, the term “mentor teacher” means an individual responsible for observing and assessing the classroom activities of a Head Start program and providing on-the-job guidance and training to the Head Start program staff and volunteers, in order to improve the qualifications and training of classroom staff, to maintain high quality education services, and to promote career development, in Head Start programs.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd123d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirement</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In order to assist Head Start agencies in establishing positions for mentor teachers, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd123e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/2/A\"><num value=\"A\">(A)</num><content> provide technical assistance and training to enable Head Start agencies to establish such positions;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd123f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/2/B\"><num value=\"B\">(B)</num><content> give priority consideration, in providing assistance pursuant to subparagraph (A), to Head Start programs that have substantial numbers of new classroom staff or that are experiencing difficulty in meeting applicable education standards;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd1240-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/2/C\"><num value=\"C\">(C)</num><content> encourage Head Start programs to give priority consideration for such positions to Head Start teachers at the appropriate level of career advancement in such programs; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd1241-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/b/2/D\"><num value=\"D\">(D)</num><content> promote the development of model curricula, designed to ensure the attainment of appropriate competencies of mentor teachers in Head Start programs.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd1242-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Family service workers</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To improve the quality and effectiveness of staff providing in-home and other services (including needs assessment, development of service plans, family advocacy, and coordination of service delivery) to families of children participating in Head Start programs, the Secretary, in coordination with concerned public and private agencies and organizations examining the issues of standards and training for family service workers, shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd1243-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c/1\"><num value=\"1\">(1)</num><content> review, and, as necessary, revise or develop new qualification standards for Head Start staff providing such services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd1244-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c/2\"><num value=\"2\">(2)</num><content> review, and as necessary, revise or develop maximum caseload requirements, as suggested by best practices;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd1245-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c/3\"><num value=\"3\">(3)</num><content> promote the development of model curricula (on subjects including parenting training and family literacy) designed to ensure the attainment of appropriate competencies by individuals working or planning to work in the field of early childhood and family services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd1246-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c/4\"><num value=\"4\">(4)</num><content> promote the establishment of a credential that indicates attainment of the competencies and that is accepted nationwide; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd1247-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/c/5\"><num value=\"5\">(5)</num><content> promote the use of appropriate strategies to meet the needs of special populations (including populations of limited English proficient children).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd1248-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Head Start Fellowships</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd1249-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Authority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may establish a program of fellowships, to be known as “Head Start Fellowships”, in accordance with this subsection. The Secretary may award the fellowships to individuals, to be known as “Head Start Fellows”, who are staff in local Head Start programs or other individuals working in the field of child development and family services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd124a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The fellowship program established under this subsection shall be designed to enhance the ability of Head Start Fellows to make significant contributions to programs authorized under this subchapter, by providing opportunities to expand their knowledge and experience through exposure to activities, issues, resources, and new approaches, in the field of child development and family services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd124b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Assignments of Fellows</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaccd124c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Placement sites</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Fellowship positions under the fellowship program may be located (subject to subparagraphs (B) and (C))—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccd124d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A/i\"><num value=\"i\">(i)</num><content> in agencies of the Department of Health and Human Services administering programs authorized under this subchapter (in national or regional offices of such agencies);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccd395e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A/ii\"><num value=\"ii\">(ii)</num><content> in local Head Start agencies and programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccd395f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A/iii\"><num value=\"iii\">(iii)</num><content> in institutions of higher education;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccd3960-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A/iv\"><num value=\"iv\">(iv)</num><content> in public or private entities and organizations concerned with services to children and families; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idaccd3961-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/A/v\"><num value=\"v\">(v)</num><content> in other appropriate settings.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaccd3962-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Limitation for Fellows other than Head Start employees</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A Head Start Fellow who is not an employee of a local Head Start agency or program may be placed only in a fellowship position located in an agency or program specified in clause (i) or (ii) of subparagraph (A).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idaccd3963-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> No placement in lobbying organizations</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Head Start Fellowship positions may not be located in any agency (including a center) whose primary purpose, or one of whose major purposes, is to influence Federal, State, or local legislation.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd3964-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Selection of Fellows</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Head Start Fellowships shall be awarded on a competitive basis to individuals (other than Federal employees) selected from among applicants who are working, on the date of application, in local Head Start programs or otherwise working in the field of child development and children and family services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd3965-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Duration</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Head Start Fellowships shall be for terms of 1 year, and may be renewed for a term of 1 additional year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd3966-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Authorized expenditures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">From amounts made available under <ref href=\"/us/usc/t42/s9835/a/2/E\">section 9835(a)(2)(E) of this title</ref>, the Secretary is authorized to make expenditures of not to exceed $1,000,000 for any fiscal year, for stipends and other reasonable expenses of the fellowship program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd3967-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Status of Fellows</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as otherwise provided in this paragraph, Head Start Fellows shall not be considered to be employees or otherwise in the service or employment of the Federal Government. Head Start Fellows shall be considered to be employees for purposes of compensation for injuries under chapter 81 of title 5. Head Start Fellows assigned to positions located in agencies specified in paragraph (3)(A)(i) shall be considered employees in the executive branch of the Federal Government for the purposes of chapter 11 of title 18 and for purposes of any administrative standards of conduct applicable to the employees of the agency to which they are assigned.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccd3968-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/d/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall promulgate regulations to carry out this subsection.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd3969-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Model staffing plans</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 1 year after <date date=\"1994-05-18\">May 18, 1994</date>, the Secretary, in consultation with appropriate public agencies, private agencies, and organizations and with individuals with expertise in the field of children and family services, shall develop model staffing plans to provide guidance to local Head Start agencies and programs on the numbers, types, responsibilities, and qualifications of staff required to operate a Head Start program.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd396a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Professional development plans</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each Head Start agency and program shall create, in consultation with an employee, a professional development plan for all full-time Head Start employees who provide direct services to children and shall ensure that such plans are regularly evaluated for their impact on teacher and staff effectiveness. The agency and the employee shall implement the plan to the extent feasible and practicable.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccd396b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Staff recruitment and selection procedures</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Before a Head Start agency employs an individual, such agency shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd396c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/1\"><num value=\"1\">(1)</num><content> conduct an interview of such individual;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd396d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/2\"><num value=\"2\">(2)</num><content> verify the personal and employment references provided by such individual; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idaccd396e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/3\"><num value=\"3\">(3)</num><chapeau> obtain—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd396f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/3/A\"><num value=\"A\">(A)</num><content> a State, tribal, or Federal criminal record check covering all jurisdictions where the grantee provides Head Start services to children;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd3970-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/3/B\"><num value=\"B\">(B)</num><content> a State, tribal, or Federal criminal record check as required by the law of the jurisdiction where the grantee provides Head Start services; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccd6081-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9843a/g/3/C\"><num value=\"C\">(C)</num><content> a criminal record check as otherwise required by Federal law.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaccd6082-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/97/35/tVI/s648A\">Pub.
