The Secretary shall encourage Head Start agencies to provide compensation according to salary scales that are based on training and experience.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idaccf5c21-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9848/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Limitation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccf5c22-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9848/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding any other provision of law, no Federal funds may be used to pay any part of the compensation of an individual employed by a Head Start agency, if such compensation, including non-Federal funds, exceeds an amount equal to the rate payable for level II of the Executive Schedule under <ref href=\"/us/usc/t5/s5313\">section 5313 of title 5</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idaccf5c23-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9848/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Compensation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In this subsection, the term “compensation”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccf5c24-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9848/b/2/A\"><num value=\"A\">(A)</num><content> includes salary, bonuses, periodic payments, severance pay, the value of any vacation time, the value of a compensatory or paid leave benefit not excluded by subparagraph (B), and the fair market value of any employee perquisite or benefit not excluded by subparagraph (B); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idaccf5c25-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s9848/b/2/B\"><num value=\"B\">(B)</num><content> excludes any Head Start agency expenditure for a health, medical, life insurance, disability, retirement, or any other employee welfare or pension benefit.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idaccf5c26-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/97/35/tVI/s653\">Pub.
