<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaccfaa60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a"><num value="9852a">§ 9852a.</num><heading> Parental consent requirement for nonemergency intrusive physical examinations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccfaa61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition</heading><chapeau style="-uslm-lc:I11" class="indent0">The term “nonemergency intrusive physical examination” means, with respect to a child, a physical examination that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaccfaa62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a/a/1"><num value="1">(1)</num><content> is not immediately necessary to protect the health or safety of the child involved or the health or safety of another individual; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaccfaa63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a/a/2"><num value="2">(2)</num><content> requires incision or is otherwise invasive, or involves exposure of private body parts.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccfaa64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I11" class="indent0">A Head Start agency shall obtain written parental consent before administration of any nonemergency intrusive physical examination of a child in connection with participation in a program under this subchapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idaccfaa65-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9852a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to prohibit agencies from using established methods, for handling cases of suspected or known child abuse and neglect, that are in compliance with applicable Federal, State, or tribal law.</p>
