<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacd0e249-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b"><num value="9858b">§ 9858b.</num><heading> Lead agency</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacd0e24a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/a"><num value="a" class="bold">(a)</num><heading class="bold"> Designation</heading><content><p style="-uslm-lc:I11" class="indent0">The Governor of a State desiring to receive a grant under this subchapter shall designate an agency (which may be an appropriate collaborative agency), or establish a joint interagency office, that complies with the requirements of subsection (b) to serve as the lead agency for the State under this subchapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacd0e24b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duties</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd0e24c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The lead agency shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacd0e24d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1/A"><num value="A">(A)</num><content> administer, directly or through other governmental or nongovernmental agencies, the financial assistance received under this subchapter by the State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacd0e24e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1/B"><num value="B">(B)</num><content> develop the State plan to be submitted to the Secretary under <ref href="/us/usc/t42/s9858c/a">section 9858c(a) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacd0e24f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1/C"><num value="C">(C)</num><content> in conjunction with the development of the State plan as required under subparagraph (B), hold at least one hearing in the State with sufficient time and Statewide distribution of the notice of such hearing, to provide to the public an opportunity to comment on the provision of child care services under the State plan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacd0e250-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1/D"><num value="D">(D)</num><content> coordinate the provision of services under this subchapter with other Federal, State and local child care and early childhood development programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacd0e251-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/1/E"><num value="E">(E)</num><content> at the option of an Indian tribe or tribal organization in the State, collaborate and coordinate with such Indian tribe or tribal organization in the development of the State plan in a timely manner.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd0e252-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9858b/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Development of plan</heading><content><p style="-uslm-lc:I12" class="indent1">In the development of the State plan described in paragraph (1)(B), the lead agency shall consult with appropriate representatives of units of general purpose local government.</p>
